I was told by the estate agent that the building was guaranteed by the bank when i first put a deposit down 3 years ago,or else i wouldnt have purchsed in the first place.Has anybody else been told this as I believe this is a sales  misell and as such pressure should be put on the estate agent to get a refund and not just on the builder.

Hi all

We too were told that we were covered by a bank guarantee , we only found out about a year ago when things had come to a standstill on the site and we asked our solicitor to look into it . Our solicitor said there was not a lot that could be done at this stage.

I bought in March 2004 and was told by the agent for Palmera Properties that in the unlikey event anything went wrong I was covered by a bank guarantee.

Same here, word for word. Palmera told us that a bank Guarantee was in place. I assume it is with Banco Pastor as Palmera set up our bank account and mortguage offer with them. I did try to e mail them a couple of months ago, but got no responce. This is the e mail address I was given if anyone else wants to try

Yep me too.

I put my deposit down in July 03, and asked all the questions. I even asked for a letter confirming this, but surprise surprise, that didn't come. Unfortunately this is all hearsay, and without something in writing, we don't have a hells chance at this point.

Yes as with everyone else Palmera Properties told us we had a bank guarantee so we would not loose any money and the property would be finished no matter what., we thought we had covered every angle as we did a lot of checking. we possibly would have bought through some else had we known we had no bank guaratee.  The bank Palmera Properties told us to use was Banco Banesto.

When we put our deposit down with Palmera we asked aover the phone for a breakdown of costs,when we were read out the list there  was an amount for insurance,when we enquired as to what this was for,we were told it was to cover our deposit. Unfortunately we never got a written breakdown.

Hi Phil have tried three times today and had no answer, unless I have the wrong number! Can anyone let us have  a number for them please, will check it with mine, could be that they are just not answering and that does not surprise me at all!!!!!

All of us that bought through Palmera (majority I think) were told we had a bank guarantee but we dont seem to have one!! So are we up the creek without a paddle?? We are thinking of taking action against Palmera. But what about all the other people who bought through someone else??? Have you all got bank guarantees? Or have you been conned too?? Is it that they used the same solicitor who we cant seem to find anymore( not that they ever got in touch really or we had any dealings with them)

The whole thing stinks!

We all must do something to get our hard earned cash back or indeed our apartments. I wait desperately for my solicitor to get back to me on Tuesday! I am just hoping its not too late! !!!

we was told we got a bank guarantee   but no paperwork to show it and we are not with palmera

i have emailed solicitor waiting for him to ring me i have also emailed the agent waiting for them to get back to me

dont know were we go from here i guess i will have to wait for them to get back to me

We bought through Palmera the solicitor we had was

Phone number 0034 952219871    There was a girl there called Caron who was English.  Palmera don't use them anymore or should I say the solicitors don't have anything to do with Palmera anymore.  Last time I spoke to them they said the money we had paid them for solicitors work so far was now all completed and you could instruct them again to work for you or get another solicitor.  (Silly me I thought the money we paid at the start was to cover all the work up till completion - wrong again).

I phoned them on Thursday to ask about Bank Guarantees but they shut at 1 p.m. our time.  So if you ring do it in the morning.

hi we also were told by palmera guarantees were in place,a in unlikely event bank would take over and get building finished,suppose that is another one of their lies. have any of you e mailed palmera and got replies,only they dont seem to be answering our e mails.

Palmera in Benalmadena.  Tel Number 0034 952576543  Customer Services people only their in the mornings they shut at 1 p.m. our time.  You can still get through in the afternoon but they will refer you to Customer Services telling you to ring in the morning.

 

Email   info@palmeraproperties.com   Never had a reply back from e-mailing though.

Hi Ya,

Just Spoken to 'Banco Pastor', who's sign board can be seen on various photo's and our mortgage was arranged with, they tell me that my bank account has now been closed (due to the length of time it's just been sitting there with no money in I guess) and , Quote '' they are not funding any developments by that name in Almoradi''

So looks like the orignial bank funding the project has pulled out!!

CAn just wait and stick it out I suppose.

If there are no bank guarantees in place as required by law,and urbasa and palmera know there are none in place, then its reasonable to think that the original funding bank knows about them. It seems that even the largest of institutions can break the law with not a single thought to the people who in good faith have put their money into Spain to have it stolen virtually by law.

Hi Glynndeakin

We opened a bank account with Banco Pastor in the beginning we had to put in £50.  This was very quickly used up with Bank Charges.  We then closed the account.  If you think that everyone has done the same 144 flats x £50 = £72,000 pounds they have done very well haven't they.  Also looking on our English copy of our Contract we see that under sub section  VII it states

"The residential unit described on recitals VII is encumbered with 56,000 euros in virtue of a mortgage loan granted by the Banco Pastor and formalised in a public deed on the 24th October 2004 before the notary public of Elche Mr Carlos Monedero San Martin, number 1,425 of his protocol.  Nevertheless, the Buyer shall take the necessary steps in order to increase such mortgage."

If Banco Pastor are now saying that they are not funding any development in Almoradi we must ask the question does anyone have a Mortgage set up or not or has it all been cancelled by the bank without us knowing?

We changed our minds and went with the Halifax a long time ago.

It makes you wonder if anything on these Contacts are worth anything at all!!

Hi all just got a email from my solicitor it says

DEAR PHIL:
 
ON FRIDAY I HAVE SPOKEN WITH URBASA AND THEY TOLD ME THAT THEY WILL START THE WORKS IN THE AMARION BUILDING ON SEPTEMBER.
 
I WILL ASK THEM A BANK GUARANTEE FOR THE PAYMENTS DONE FOR YOU TO TRY THE COVER THE POSSIBLE BANKRUPTCY.
 
THE LAST NEWS THAT I HAVE ARE GOODS BECAUSE THEY ARE SELLING PLOTS TO OBTAIN MONEY TO FINISHING AMARION BLOCKS AND OTHER BLOCKS.
