Court action against Urbassa

Hi All, after conversation with solicitor tonight, advise is to see if any point in court action. Which means court investigation into them. Will cost 2000 euros ish. plus someone needs to go over to sort it for couple of days. I feel this is the only way to find the truth about Urbassas Situation. Only then can we make a decision on full court action. Which would cost an extra 10% of money paid. The more people that join us, the cheaper it will be for all of us. I THINK THIS IS THE WAY TO GO NOW THE MORE PEOPLE JOIN US NOW THE CHEAPER IT WILL BE IN THE LONG RUN ALSO IF SOMEBODY DOES'NT JOIN THIS GROUP IT MAY COST MORE IN THE LONG RUN YOU MINT HAVE TO GET A SOLICITOR ON YOUR OWN COSTING A COUPLE OF THOUSAND

IF IT COST US 2000 EURO'S  

10 PEOPLE THAT IS 200 EURO'S EACH

20 PEOPLE 100 EURO'S EACH   AND SO ON

ALL OF THIS IS GOING TO HAPPEN IN JULY,  URBASA SAID THEY ARE STARTING WORK IN JULY  DO ANY OF YOU THINK THIS IS GOING TO HAPPEN

Hi JPD I received the phone call from sunday paper and the guy is off ill but they said to let us know he will ring 2moz,they think we are on the right route and they hinted he might give us a bit of help have to wait and see.Glad to see we are all ralling together for court action,lets hope a few more log on and see it is in there best interests to join forces,Gabe

You certainly have our support but I am wondering what if anything can be done legally before October and without possibily damaging our legal rights.

It would be an understatement to say that Urbasa is at the very least putting us all thru a lot of anxiety, stress and frustration by giving false promises instead of being open and frank with us but as I see it its so far its an issue of morales rather than legalities.

If some legal action can guarantee to get an honest response from Urbasa and to push them into starting up again build mode then I am all for it and would gladly contribute towards a lawyers expenses. but it will take  the services of a very upfront lawyer who will give 100pct honest, unbiased and accurate advice as to how we should proceed.

Whatever action is contemplated can someone kindly send me a pm

Hi all fellow sufferers.I am new on this site, but you can count us in with any legal action ,although I have a feeling this will be pointless and more money down the drain.The bottom line is that both Palmera and Urbasa are totally full of crap and the finances to proceed with the build simply aren't there.Unfortunately the list of excuses just goes on and on without any credibility to any of the reasons they always come out with.I feel our chances are no better than 50/50 but at least I suppose that gives us some hope.Numerous builders are going under in Spain and sinking without trace and without any consideration for any purchasers.My parents live in Spain and have done so for some time and they are currently marketing their own property, only to be told that the housing market is totally flat and many builders and estate agents are going bust at a frightening rate.If we were Spanish ,any bank guarantee would more than likely carry some weight, but as Brits the laws change to suit the locals.This is not fantasy, this is fact and I have this information from my parents who were told this through a Spanish friend of theirs with interest in property.It really is just a case of sit and wait as trying to put pressure on the Spanish is a total waste of time as they always do exactly what they want to do and not to suit others.Palmera have been the biggest load of idiots in all this as they have told more lies thay anybody, and are more unreliable , untrustworthy and deceitful than anyone I have ever dealt with.I have numerous family members who have bought in Spain recently and all what has happened is beyond belief to all of them, although not totally unheard of.We are like everyone else in keeping our fingers crossed and hopefully we may eventually receive some news.It would almost be better to know for definite that the whole thing is off, because then at least we can sink our finances to something else as they are still lots of bargains to be had in the current market, although we would be against buying off plan again.Best of luck to all concerned .You never know, it may just work out for us all.

Welcome  to the site Boo ( Andy and Nicki)  Yes read your comments and do agree. How long do we wait? Will we even get anywhere? Will we end up losing all our money? Will we get SOMETHING back? .......Will we get our apts? Questions none of us can answer who knows whats best to do? We are just going on what our solicitor says that he thinks now would be the time to start digging deeper and get more answers hopefully NOT lies.

Any way Andy and Nicki, nice to have more Amarions on here the more the merrier....erm well, we are maybe not a merry bunch at the minute, but we do keep each other going!

now we have got a few of us sticking together about the solicitor its just when do we go and approach them should we wait a little longer, urbasa did say they was starting work again in july or do we act immediatly

i personally think wait till middle of july its only 3 weeks off and it gives them a chance to get the builders in then, if nothing as happened by then we should go over and sort the solicitor out

Hi all, There is an article relevant to our situation in the articles of interest which is located on this page on the right hand column. It is titled Bank Guarantee for renting property, but if you read the second paragraph it relates to us who are buying off plan and what we should by law have in our package.

Hi Blacksmith read the article but it still doesn't help our situation, as we dont have bank guarantees and no bank is going to give them now as Urbasa are in too much debt.

Or do you know some way we could get guarantees?

Hi Snowqueen Debaz and myself got in touch with channel 4 selling propertys abroad and both had a reply, I spoke to them again on Monday and the are still not sure if  they are doing another series but they will be in touch if they are.Yesterday I rang Sol Mar propertys who were agent for Palmeria props who I bought from they no longer deal with them anymore, the lady said someone would ring me back but noone did.Surprise the phone rang this morning and it was a guy called Justin one of the partners of Sol Mar we had a lond conversation and it turns out he himself has bought one of the apts sold one to his parents and another to a friend,he is off to spain next week and going to try and find some answers and will ring me when he gets back.While on the phone I did tell him about our website but already Knew about us, but I think he thinks it's all blown out of proportion, like to see his face when he realises it,s true.(to be fair he did say he had concerns) lets hope when he comes back he will want to join forces with us. I posted before that I am sure that before they started building at the site there was a hoarding outside with a picture of amarion 3 and a mention of association with Banco Pastor who I imagine would have wanted all the proper procedures in place i.e Bank guarantees etc, and also it proves the point that we shouldnt have to ask for these, it should by law be there for us. Its a pity there is no photo of this hoarding.

Hi Gabe we bought through sol mar in Darlington Barry spoke to Justin about 6 weeks back, we were just saying the other day we need to ring him to see if he had found anything more out,He told us the same he had sold to friends and was not that worrid, but then he didnot say they no longer deal with Palmera.

Gabe I , just had an automated reply  from channel 4 asking for contact details and pictures.not heard anything since.

HI Phil, No, I think it was next to that one, maybe where the cement silo is. We didnt have a digital camera then, but I shall have to look thru our old type photos and see if we caught anything. It  was there before they even broke ground, late in 2003 ish
