I HAVE JUST COME OF THE PHONE WITH THE LAWYER

APARENTLY THERE IS NO POINT IN CANCELLING JUST YET AS THE COURTS CLOSE FOR AUGUST AND REOPEN SEPTEMBER  IF YOU ARE CANCELLING YOU NEED TO GO OVER TO SPAIN TO YOUR SOLICITOR AND GIVE HIM POWER OF ATTERNEY FOR THE COURTS ( NOT THE POWER OF ATTERNEY FOR YOUR APARTMENT) AND THE COST IS ABOUT 10%

SO I PERSONALLY AM WAITING TILL SEPTEMBER THEN IF NO WORKERS I AM CANCELLING

Hi all, just spoken to Laura at urbasa, call back in 3 weeks, guess that blows out july start date. When confronted about ever being finished unable to give answer just have to wait till October dead line.

Any news from the estate agent who has sold several and was visiting last week.

Just how much money is to be thrown at this bog up, all everyone ever wanted was what they paid for in good faith..we want to pull out but don't know when it is wise to do so without the loss of a lot of money.  No sound or consistent advice makes us just hang on, and on and on...........

Thanks Gabe, taking a rather selfish perspective if people do cancel their contracts and those properties are re sold at a higher figure may help all of us, Urbasa get more money to finish, we get our apartments and the cancelled contracts get their money back. Time consuming yes but plausible.

this is good news because we dont have to take the estate agents to court as well as long as urbasa pay up

Hi, yes I think that come October we will seriously be looking into cancelling.  We need to look for a solicitor and see what the process is etc but I think it has to be done..... very sad after all this time but hey, how long do you wait otherwise?!

Come the new year if nothing has happened we too will be looking into cancelling, however not sure if we would get anything back from them if we do, all we would expect is our liability to purchase to be resinded ,just cant see them saying yes just sign here and we will give you all your money back plus 3.5% can you?

Hello all,

Just a few points for you all.

1. The palmera properties office in Alicante is now closed and completely empty.

2.I have been researching cancelling Amarion 111 with a solicitor and she has quoted me an initial payment of 1,500 euros followed by a further payment of 2,500 euros at a later date.

3. I was on this site as Jamrock

We are still for joint action as this should prove the least expensive route as well as the most forceful in court, as stated we are giving them to the end of the year before we make our decision, I for one don’t fancy paying 10% just to get back what’s rightfully ours

Regards

Graham and Christine

Hi All,
Asked Ainhoa Reyes about cancelling contracts the other day and if a Solicitor was required? Just got a reply as follows:-
With regards to your enquiry, I hereby inform you a solicitor is not
needed for the cancellation of your contract. If you so wish involve a
solicitor it is more of a personal choice. All you must do is send a
signed letter with the purchase details, explaining the reason of your
cancellation. This letter is passed onto our jurisdictional department and
they arrange a meeting with the sales department in order to check the
amounts that must be returned.  I know Palmera must return a certain
amount, this must be checked too
.  Once everything is clear the financial
department will proceed with the return.
This process can take some time but I wont be able to tell you how much time.

Anywhow, a letter will be sent aprox as from 15 days to all clients
informing them of the situation.  I suggest you wait until you receive
this letter before you make your final decision.

I hope your questions have been answered.

Yours Faithfully,

Ainhoa Reyes
Grupo Empresarial Urbasa, S. L.
Not to sure how much Palmera are going to give us back though - Big Fat zero I think.
Wait for another letter now then!!
Cheers, Glynn

hello glynndeakin

i have looked into this a little more and aparently urbasa have taken all your money and they have paid some of this money out to there clients ( palmera ) for getting the sale

i have been told you should get back what you paid in full from urbasa and if they want to claim it back from palmera , well thats up to them

we need to find out how long it takes for urbasa to pay us our money back i am not willing to wait another year

going to email them to try to find out

thanks for the info

Hi Guys

What about hanging on, bearing in mind what we paid for the property y and what is worth now,  I go to the complex every 3 weeks as i live between england  and spain, my other house is just around the courner from Am3, I have been told by james that 90 per cent is finished, and another builder will come in and eventually take over the rest.  I dont know about you guys, I am going to sit and wait over the next 6 months, and see what happens
