Hi Black smith just put a photo on the shared photos this was taken April 05 the poster is coming off but it does mention banco pastor,is this the one you mean?

is it worth any of you that is with this bank asking them if they know anything seeing there sign was there 

i wonder what it said on this sign its there for a reason ( does it say bank guarantee ? ) or something like that

I would like to know how many people there now are SIGNED UP for this SYNDICATE with regards to the HIRING of a SPANISH solicitor? I would suggest we wait up until the end of July as a DEADLINE (Since this is when they say they are going to start work) to see what develops with regards URBASA or OTHER building Sub-Contractors. As I and probable 75% of other Amarionairs believe the answer will be nothing then may I suggest we have a count up to see how many in the SYNDICATE so that we know first hand what further outlay each INDIVIDUAL person is going to be faced with.Whoever we decide upon to be our SPOKEPERSON is going to be faced with EXPENSES (FLIGHTS,HOTELS etc) so is the SYNDICATE going to provide FUNDING for this? Then I further suggest that it will be in ALL our interests to have a WEEKEND MEET in a LOCATION (e.g.MIDLANDS) I know there are people from all over the UK so this is only a suggestion for a SEMINAR of sorts to sort out properly WHO,WHEN etc is going to be responsible for the ACTIONS we all decide to take and costs involved etc.Do we have any members who work in the LEGAL PROFFESION? I personally would be prepared to help in any way that I possible can.I think things can be achieved if its done in a constructive and proper manner and people all stick together rather than all running around like HEADLESS  CHICKENS and getting nowhere.I await replies with interest

i think you are on the right track with what you are saying, jpd is in a very good position to be one of our spokesmen he allready as a place out there so no hotel bills he knows the place well and he as allready spoke to the lawyers and i trust him

i think you are right about waiting till the end of july to see if urbasa do sort anything out like they promissed   ( cross fingers )

upto now there is 12 of us i thought it would have been  a lot more with the people that go on this forum but some more may come in with us if urbasa dont do anything by the end of july

i also know of two more people that may come in with us that have bought but they dont come on eyeonspain so that could be 14 of us

 if there is only 14 of us i think that £150 each should sort the lawyer out and the flight over there and we mint get some change but dont really know jpd will be able to tell you the cost closer to the time it may be a little less depending on how many more join us

i have just come of the phone with the solicitor in spain

i have just come of the phone with the solicitor in spain and he thinks it is better we wait he said that if we take urbasa to court it will cost us 10% of the apartment price which is about 9000 euro's

he did say it is up to us because if urbasa do go bankcrupt  he doesnt want to be held responsible and it will be a long drawn out matter but if he had an apartment there he would wait

i was also talking about urbasa's finances and he said that they did have a big plot of land worth a lot of money that was up for sale but he didnt know if they have sold it yet ( urbasa also said this but they said they have sold it ) so we know a little of this story is true

i asked him if it is worth him going to the town hall to find anything out but he said they wont know anything so i guess we are stuck again lets wait to hear from him then i need to ring urbasa in about 10 days time to see what they say

he is getting in contact with urbasa in the next few days and he will email me what they say i will let you all know

Hi Phil, yes we know if we do take Urbasa to court it will cost a lot of money, but slow down, John is only talking about an investigation into whether its worth or indeed if we need to take them to court. If the investigation finds them in so much debt, they couldn't pay us all back any money paid., or get our apts finished , then and only then do we  need to decide if ,or who ,wants to go the whole way and take them to court. With Bankruptcy, I think you have to let them know in good time that you are owed money, or you are last in the queue, so to speak.

Johns at work tried ringing him, but he must be up a ladder busy and dont want him dropping a pane of glass on himself!!

Hi Trish you are right we are only looking into an investigation at the moment,and when I spoke to John we both said the same as Harvey we have to be organised and sort app and seeing people before someone goes out, Ido agree with Phil if John is agreeable for him to be spokesperson,also with Harvey about all meeting in the Midlands. My money is here waiting whatever you decide,I will Back you all the way,I think we all want to Know one way or the other. For God's sake don't let him fall down the ladder we need him. Regards Gabe

Hi everyone i have been talking to my spanish solicitor today

when i looked in the contract it says you will get all your money back plus 3.5% per year

what a load of rubbish

according to the solicitor you will only get back from urbasa what they have received from you plus the 3.5 % per year

so if you have paid the estate agent £20,000 deposit and they paid urbasa £16,000 taking £4000 out for them you will get back the £16,000 plus 3.5% per year

this means you will need to either take your estate agent to court as well or ask them for it back and hope

Sorry to be the barer of more bad news if you are cancelling

Sorry for delay: Had update after last message.

We spoke to Palmera P (Monday) about Amarion III they have told us that they are no longer intrested in the development and advisid us to deal with the builder, we then advised them that we hold a document from them that states that they garentee all our moneys in the event of builder defaulting (the phone went very quite).

This we fault  was always our get out of jail card, they then informed us that that document was isued by the English branch of palmera property and no longer has any substance since the company have closed there English offices.

We then asked about the builders contract that is in spanish so it should have substance she replied that there was a good chance that this also is not worth the paper its on, we asked if another builder takes over the build are we still the legal owner of our flat she had no answers, we then asked to speak to the legal person at Palmera and the reply we was given was that they dont like to speak to clients.

She then had the front to try to sell us another property? lets think.

We did phone builder and got a answer phone left our number and they did call back ( this was after last message)  spoke to a plesent lady whoe sounded very positive that the build was going to complete and that they are not in financial problems, even mentioned they have offices in london and that the contract ends in October.

This did carm me down even thoe we have heard it all before, but my real problem is Palmera if I had to choose it would be them that  I would wish to drag threw the courts they have not done nothing to help or inform us and now tell us that this build has given them a hedache, but dont think they have lost any money.

We was then told that our NIE paper work was still in a box and may take some time to be found if at all,

 can any one advise what we should do about getting more paper work, hope before build is completed. 

Not all bad news as originaly fault.

Ref NIE numbers.

If you need an original NIE document and you have the number. When you come over to Spain, go to your local NIE issuing location armed with your original document number and they will issue you an original NIE document in the same number at no extra cost.

I was thinking about our NIE numbers as we still haven't done ours yet.  Was going to go to Manchester or London to get it done.

On the NIE application form you have to put on a Spanish address for the NIE to go to. Most people normally put on their agent's address but if Palmera are not going to help with this, what other address can we use?
