Hi , I have put £70000 into buying a property in the Gardens of Manilva complex , but i no longer want to continue with the purchase due to the collapse of Ocean view. Could anyone point me in the right direction as regards trying to claim back the money i have invested. if anyone can give me even a little bit  of info i would be so grateful.

Hi Andy,

If you haven't already appointed a lawyer, ask to speak to their clients first - there are several acting for OVP/MC clients - and choose one whose clients are happy!  You are VERY late in trying to persue your lost deposit but bear in mind that every case is different.  There are people, for example, who do have contracts signed by MC, contrary to the blog posting below.

We started legal action almost two years ago and have our first hearing this week so expect this to take a loooong time.

Hi All,

Just been to GoM on Sunday 22nd November 2009 and uploaded a few photos for your information, it would not let me upload all six so not sure why....??

As you can see the photos have not changed from those posted by Lavaclip on 1st August 2009.

I can also confirm that NO ONE has moved in to the apartments and villas, and the whole site looks like a ghost town. I cannot say if any of the Villa's have been completed but there are no signs of people moving in. With repsect to the apartments all the blocks apart from the very top one, I think is block 3, have all got major structural issues due to subsidence. Because we could not get close due to the perimeter fence up none of the apartments appeared anywhere near finish, who has been doing the snagging Hola Life, I don't think so. So the FOL has not been granted on the apartments.

There is no site security and no sigins of OVP (no suprise) or Manliva Costa (Developer) but only Gomyu, the builder. 

The swimming pools of the bottom villa's are full of pond life (no not OVP) and the commercial centre is just waste land. I have taken nearly 83MB of photos and might upload over the next few days.....

Has anyone used Brethertons, as they have 60 Clients, any feed back Guys???

One question that I cannot get an answer on is who owns these properties has we have put 30% deposit down and legally even though we have not completed no contracts have been terminated yet?

Putting a deposit on an off plan property is just showing your "intention to purchase". There is no ownership until completion has taken place.

Hi Andy,

Have a look at the estepona beach thread for a bit more info on lawyers, as there can be very useful posts made there, also sometimes there can be very strange posts from people who are dilluded into think their comments actually help, such as Tish below, dunno quite what that post is supposed to prove? anyway, all the best in your efforts Andy, as yes if you have signed a contract for a property which has not been built, or built poorly, then yes quite clearly there are numerous legal avenues to follow. None of them particularly quick unfortunately, but I reckon we will get there in the end.

Hi All...

 
Hope all have had a merry Christmas and I wish you all a prosperous new year...
 
I purchased a Villa at GOM and placed a deposit of over 250,000 Euros with OVP, Ocean View Properties via Conveyancing uk / Conveyancing Spain...
None other than Lesley Alberici.
 
My purchase followed a number of visits to Spain and to various property presentations with staff from OVP, Ocean View Properties.
 
To do this I took equity out of my home and placed my deposit thru a solicitor...
What could possibly go wrong...
 
Well... So much for the UK / Spanish Legal system...
 
Last night I find out that a very close member of my family passed away suddenly in Ireland...
After a great deal of effort by some very good people I was passed the tragic news...
Now the reality...
 
I have not eaten a hot meal in 12 days...I have not slept indoors in 14 days...
I have lost my partner, my friends, my job, my home and the only thing I have not yet lost is my life.
I have now lost a member of my family and not only can I not afford to go to funeral but I am unable to pay the cost of a call to sympathize with my family...
 
So…
 
I would like to take this opportunity to tank the following Staff of OVP, Ocean View Properties for destroying me, my family, my home and if something doesn’t soon change … My Life…
