Hi all,

just want to protect myself and say that this is what my father heard !!! from Raoul ! from Jet Plus......  I cannot vouch for the truth of the statement   !!  My father is 75 and very concerned for us. I hope that the info is incorrect!!!  

I am at my wits end with O ** situation sorry i should have added the *** before !! 

It is ruining our life!

very concerned about this, I have also purchsed and am thinking it's gone very quiet and now hearing this is very upsetting - does anyone else have any news?
I'm going out on hols in 2 weeks so I'll be going to have a look.
I did phone ocean view on Friday to arrange to visit the site and was told it was ilegal!! and they would not be able to arrange a visit - it seems that someone else has been up there for a visit if it's clear there is only one bathroom!!!
anyone else got any news?

Hi Elle, 

I've checked with Companies House and OVP haven't liquidated so I would suspect this is just a rumour - which by the way won't have the slightest affect on anyone on GOM development as our contract is with the developer.

As far as visiting the site goes, I'm almost sure the show flat is now open on the site.  You can get quite close to the apartments but might not be able to go into your own.  Its not illegal to access the site, its probably just they can't get permission on helath and safety grounds as there is still construciton work going on.

I know the contract is with the developer but I keep hearing from different sources that O** still hold the deposits...I hope I am wrong.

Do you feel happy with the general bank guarantee??

I,m REALLY sorry if i have worried anybody, it just freaked me when i got that news.

In hindsight I should have thought about it first!!

Is there anyone else using lawyers to get their deposit back I would really appreciate a pm if there is

Thanks for the update!
Since the post I made yesterday I've made some enquiries. It seems that OVP may have merged with another company which may be what started the rumour. However, OVP is the travel/holiday company and not the actual developer responsible for the build so shouldn't ne any impact.
I've spoken to a friend of mine who has an apartment at Manilva Beach and whilst he hasn't a lot of good things tosay about OVP, he is happy with the apartment , pleased with his purchase and loves the area.

I also got the furniture brochure and prices yesterday which seem very expensive at 16,000 Euro (and that includes a discount)......I'm told furniture packs are available from elsewhere and start at Euro 9,000 so I'll be investigating that whilst I'm out there next week.

I'll post an update when I get back.

Bank Guarantees for Spanish Off Plan Developments

Know Your Rights!

The Aval Bancario (Bank Guarantee) or Insurance Contract were both established by a 1968 Law to protect buyers in off plan developments.

Article. 1. - The developer must guarantee the return of the deposited amounts plus 6% of annual interest, through an insurance contract or by bank guarantee, in circumstances where the construction doesn’t start or doesn’t finish in the agreed time.

They also need to open a special bank account for your amounts (different from the general one of the developer) and have it expressly written in the contract.

Article. 2. - In those contracts where the parties agree on anticipated amounts the developer must expressly state:

a) That the developer will give back to the buyer all the advanced amounts plus the 6%, in circumstances where the construction fails to start or end within the agreed deadline, or the certificate of habitation is not granted.

b) Reference to the bank guarantee or insurance contract, this must indicate the name of the Bank or the Insurance Company.

c) Specification of the Bank or financial institution and the account number where the buyer’s money is deposited.

At the signing of the contract, the developer will give the buyer the document that contains the guarantee (the Aval or the Insurance Contract) and the document must have a reference to the amount that is anticipated.

Article 3. – If the deadlines for starting or finishing the development are not met, the buyer can choose between cancelling the contract with the return of advanced amounts plus 6% annual rate, or to concede a time extension, which will be stated in an additional clause in the contract, specifying the new deadline with the date for finishing the construction and completion.

The insurance contract or the bank guarantee together with the document that fully proves that the work has not been started or that the completion deadline has not been met nor complied with, will have executive power as it is stated in the Title XV of Book II of Civil Procedure Law, to demand from the insurance company or the bank, the amounts that the buyer is entitled to, without prejudice of any other given rights also applicable.

I have it from a good source very close to OVP that the deposits have not been passed to the anyone and that OV are still holding onto the money (in this country) and also that the bank guatantees do not exist. Does anyone know more about this?

To the many of you who have sent me a private messsage, thank you... I'm sorry for delay in reply but just got back from Spain

In reply.... cant divulge who gave me this info as the person is married to an employee of OVP. Cant answer the questions cus I dont know the answers but the person concerned seems to be very sure that they (OVP) are sitting on all the deposit monies and they plead poverty when tackled and asked for deposits back. One course of action that seems to work is for solicitor to threaten to freeze bank account. You should all have their bank account details.

We have all been ripped off, there's no doubt in my mind after having just been put to Spain

Hi - just thought I'd post a reply having just been out to Spain in a panic.
I went up to see Gardens of Manilva and whilst it's not ready yet, pool, gym and lanscaping not yet done, the apartments are actually looking nice.....I was actually quite pleased.
Decoraters are in, kitchen fittings are all there - went out and stood on the balcony and could see the sea.

Property market has been hit out there but they are apparently not granting any more new licences to build any more properties ftb - so whilst it looks a bit like a building site in places, once current builds are finished, it should settle down a bit.
I think the area is right and if you can afford to sit on your property in the current climate then you shouldn't feel 'ripped off', (unless of couse you're trying to get your money back).

I think in the current climate, with property prices in the doldrums/declining and the Euro now completely battered in relation to the pound, it's easy to panic, especially if you're new to  this - like I am.
It also rather depends on why you bought the property in the first place - if it was to make a quick buck then ........................

Whilst I wouldn't recommend OVP and I do think they are now offering special discounts which turn out to be very expensive (such as the recent furniture offer!!!), I'm sticking with the apartment which I think will be very nice, I just won't be dealing with OVP at all who are currently being very evasive and unhelpful.

But did you have the right number of bathrooms ? 
What have you bought ? We  had decided on a 2 bed 2 bath thats actually a 2 bed 1 bath !
Do you think that the facilities will ever actually be built ?

I've bought a first floor 2 bed/2 bath.
The bathrooms were as they are on the floor plans on  the Ocean view site, although the small shower room as you come through the front door only had toilet & sink installed, it looked like there was room for a shower and given the bathroom also didn't have the shower fittings in over the bath, I'm just thinking that they are yet to be installed - it's not hard to fit a shower. I will be asking Hola Life to check this and also the lawyer but I'm tninking it will be there when we get to complete september/october.
It doesn't look like there will be small spa pools between the apartments, but I'm fine with that. I think it's unlikely they would get much use, would need regular cleaning and actually, trees and plants are going in which I think will make it look very nice.

I was talking to some property management people down in Manilva and they say that the Pool etc are generally the last  things to go in. I could see where they have dug out for the pool which was actually being used as a car park for the builders whilst I was there......apparently it only takes a couple of weeks to put a pool in. The basics for the tarmac road have gone in over the  last week.........I expect the gym & shop to be built in the next phase, no reason to think any different.

The apartment we have been asked to transfer to from the disaster that is EBCC only has the one bath and I'm not as optimistic about the facilities but I guess only time will tell and I'm with you - will not be dealing with OVP on any matter. As soon as is humanly possible will be cutting all ties !

HI,

I've been told by my solicitor that trying to get your deposit back can take years as the developers and Ocean View just say that they aren't able to pay it back. I've also been told that there's no comeback on the late completion date (unless you want to go to court and have all those expenses) as most developers will argue that that problems they have had are ligitimate, ie major changes of mayor's etc.

Does anyone have any otehr info on this side of things?

Actually, I've just found out the they were recommended by Ocean View. The contract is so loaded in their favour that there is nothing to protect you from late completion. Becasue of this late completion it;s looking almost impossible to try and get a mortgage now.

Do not use GV&A. They are very expensive for everything. Ask around for a quote before settling.

Also I furnished an apartment in Spain for €15,000 with the highest standard of furniture, not flat pack, 36" Sony Bravia, CD/DVD etc. Shop about on the internet and have a look at what's on offer. Way better than OVP's offering and way cheaper, they make at least €5,000 on each apartment.

Do not sign a rental agreement with OVP Travel, you will not get your money. IF you need any help with rental, furnishing, solicitors PM me.
