I've had a few messages with questions so I should clarify:

We took legal action in Spain and our lawyer has managed to use the general bank guarantee to secure our refund - meaning we were not relying on Manilva Costa to pay us back.  We have been paid directly by the bank.  Currently this is only applicable to the apartments on Phase 1.

If you want to speak to our lawyer about your own situation he is happy to answer any questions and assess your case with no charge.  Just send me a message if you want his telephone number - I'm not sure I can post his details here as it might be against the forum rules.

Hi All,

Its been a while since I posted here but I know some poeple still visit these boards looking for news.  Today I have heard from my lawyer that my deposit has been refunded to me to the tune of E111,000 (plus around E15,000 interest which is to follow).

It hasn't been easy getting here - we started legal action about 2 years ago when I posted on here telling people the action I was going to take.  Around 15 other buyers on GOM joined the action and we are expecting all of them to have the same outcome.  We already have myself and another person with refunds.  Our lawyer is excellent and has done a fabulous job under very difficult circumstances to secure our money.

Its not cheap to take legal action so I know its out of reach for some people and for that I feel really sorry.  However if you do want to try and persue your money back from Gardens of Manilva we have proved it is possible.  This may open an avenue for others so if you feel its something you would like to do, send me a PM and I'll let you have all of the details.

Don't be mislead by lawyers claiming you have a strong case.  We do all have a strong case but the difference between winning a judgement and getting your money back is worlds apart.

Hi Andy,

If you haven't already appointed a lawyer, ask to speak to their clients first - there are several acting for OVP/MC clients - and choose one whose clients are happy!  You are VERY late in trying to persue your lost deposit but bear in mind that every case is different.  There are people, for example, who do have contracts signed by MC, contrary to the blog posting below.

We started legal action almost two years ago and have our first hearing this week so expect this to take a loooong time.
