We have a situation where I am pretty certain the 100% owner of the developer who we bought our house with has syphoned off our money to a different company./

He owns aparently at least two companies, and we think bank accounts he holds.

In the UK there is a system whereby you can demand sight of "schedule of assets and liabilities, including site of bank accounts under High Court decree" can we obtain such a facility in Spain.

If we can how do we start such action?

In Spain there is an special civil court process called Diligencias Preliminares which seems similar to the one you have mentioned but this is only available in some specific cases and courts are very restrictive.

I do not know the details as to the progress of the building site and other necessary details to give you an opinion, but in the event you want that information on the grounds you are mentioning, you should go to the courts and put a denuncia (which implies you say a criminal offence has been committed).
