Hi,

Does anyone know if a Heir to a Property has not claimed their Inheritance after seventeen years what happens.

I am going through court at the moment to get a joint ownership sorted out where one partner has died, and the heirs have not claimed their inheritance after seventeen years,  the court has sent a report or warrant to them in the UK but that was over two months ago, does anyone know how long they have to reply to this, as I am getting no feed back on the time from my lawyer.

What is the action he is using in Courts? I am not very sure from what you just explained.

Hi

I think he has applied for a Dissolution of Joint Property Ownership, through the courts, the courts have sent something to the Heirs in the UK but we have been waiting around two months now for them to reply or for our lawyer to hear from the courts, or to find out if they have recieved it or not.


 

I thought that there would be a time limit that they had to reply to the courts otherwise this could take years to sort out.


 

In July this year the Heirs had not claimed their Inheritance in Spain, and they have had around seventeen years to do this.


 

We were told that once they heard from the Heirs that the court would most likely put the property up for auction.
