Changes to Townhouse Location by Developer

We have just been notified by our developer that our south facing townhouse overlooking communal pool has had to be reversed and now faces North and not over-looking the pool!!

We bought off plan a few years ago and location was of paramount importance.  We do not want a North Facing townhouse!!

Just wondering if anyone has any advice as to where we stand, can we pull - out and recover the deposits paid?

Hi fairview. When we were given our contract we were given a plan of the phase with our villa shown as facing the pool, which is what we expected & were actually given. Did you get a plan ? I believe you should have. 

I see no reason why, under the circumstances you've just told us all, that you shouldn't pull out of your purchase. It is incredible what some would have us accept.

Instruct your lawyer to do just that, pull out & recover your monies. 

You can always ask Maria de Castro about this if your lawyer has anything to do with your agent & won't respond favourably. Maria ia a lawyer who posts help on EOS. 

Keep us all informed & we will get this "sorted".

Yes we were given  a plan and was definitely South - Facing with terrace overlooking a communal pool.  They have completely reversed the town - house due to lack of space around the pool.  We would never have purchased in the first place if it was a north facing house with its back to the pool!  We will keep you informed thanks for your reply.

Hi Fairview,
Morerosado is dead on,it is breach of contract,you should be able to get a full refund of all monies paid,if you have the plan with the elevation which should be in your purchase contract then the developer will not have a leg to stand on.
Get your lawyer to start communication with the builder immmediately.

We have been informed that if the developer refuses to give our deposit back the next step would be to go to court.  Does anyone know the costs and time scales involved with this?
