Tenants who won't leave

I have just been told by the letting agent that my tenants will not leave mid May when their contract terminates.  Instead they say they will leave in October when the property they want becomes available.  I have already paid for flights to go out there for two weeks from May to June and have arranged many appointments to refurbish the apartment.  Please does anyone know how I can get these tenants to move out?

Hello Sals

Part of the purpose of having a letting agent is for them to deal with and resolve these sort of problems. Your letting agent ‘if competent’ should be fully aware of the laws and legal situation regarding this issue. However if your letting agent is your friend Maud who lives two doors down and is only the key holder and cleaner, my advice would be to seek legal advice from a qualified Spanish lawyer.

Perhaps check your property insurance policy which I assume is a commercial policy for renting the property and should include legal assistance for this situation.

Thank you for your message, it's really useful.  Yes, I have a letting agent and they are going to discuss the legal issues with me tomorrow.  I will check the insurance policy also.  Thank you very much.
