Please see below which was received from our Spanish Solicitor.

Has anyone heard about this?


Dear client,

We hope that you are well.

We are writing to you to inform you of new legal developments that might affect you.

On April 5th 2013, the Spanish Government approved Royal Decree 235/13, a new law which complements the current European legislation regarding energy efficiency for properties built before 2008. This new law comes into effect on June 1st 2013. You might be aware that already all electrical appliances have an energy performance sticker, ranged from A to G. Now, all buildings will need to have something similar. The certificate can only be issued by qualified architects/technical engineers.

According to this new law, properties must have an Energy Performance Certificate that measures how efficiently the building deals with the different types of energy: solar, thermal, etc. It will also show several guidelines to increase this efficiency. At the moment we are not aware of any fines/penalties that might be accrued if you do not obtain this certificate. However, without this certificate you will not be able to sell or rent your Spanish property.

Our advice is that you get this certificate for your Spanish property. Then you should keep it with all the documentation related to your property so that you can produce it if you need to.

Our advice is that you get this certificate for your Spanish property. Then you should keep it with all the documentation related to your property so that you can produce it if you need to.

 

These last two lines are only relevant if you are going to sell or rent out your property, and as they are supposed to last for only ten years you could in effect wear the license out........Only repeating what has been said on here many times.

As eggcup said there is another thread about this. The certificatesare only needed if you want to sell your property or rent it long term. In the case of rentals, if you already have a long term tenant in place then you do not need the EPC until your exisiting tenant leaves and you advertise for a new one.  The certificate does last for 10 years and would only need re-doing if you make major changes to your property.  The royal decree passing this law was issued on the 5th April and came into effect the day after. It basically means that if you have a property for rent you need to have at least applied for your energy performance certificate by the 1st June 2013.
