We have now been offered a Cancellation Contract by our 'lawyer'.
The 'lawyer' initially told us, via a phone call, that we had a Bank Guarantee and that they would forward a copy (December 2005)
We left it a few weeks before contacting them to say we hadn't received it. We were assured everything was ok, and that they would send another copy.
After several months it became clear that we did not have a Bank Guarantee, and in July 2006 we were told that the Building Licence had been declared illegal and all work on the development had stopped.

The 'lawyer' refuses to take legal action against the builder, but has now offered a Cancellation Contract accompanied by a Promissory Bill for our deposit/stage payment (approx £55,000) which they state will have a payment date of  "January or February 2008".
Has anyone else been offered a Cancellation Contract and Promissory Bill, or more importantly, has anyone claimed on the Promissory Bill?

Anyone in the same situation (problems with 'lawyers' etc, no Bank Guarantee, forced completion etc) should take the time to fill out the online petition at

There shouldn´t be any problem with promissory bills. They just need to be correctly issued and if at the date they do not come effective, you have executive action ( speedy, incontrovertible) for the execution of the amounts against the developer. Better that than nothing.

Just a thought ......

How about all those who are having problems or who have suffered problems putting the petition website as their signature with a short comment requesting members, or anyone looking in on EOS, to go look & maybe sign ? Sounds helpful & will reach many people.

It doesn't affect us, thankfully, as we purchased over two years ago certainly without the major problems we see mentioned in forums.
