Hi all

Although I am no lawyer, I can not see that by signing the promotion, we are legally committed to paying the final instalment within 3 months of when ever Calidona want it ( come what may)  as this is not what was stated. It just states that to qualify for the promotion you must pay the final instalment within the specified time, if you like it's a subcontract to get the promotion and not part of the main contract. I have signed for the promotion but certainly will not be paying within the specified time unless I am satisfied everything is in order such as the habitation licence (and a promise that the habitation licences will be coming shortly, will not be enough).

Hi Kev

I hear what you are saying kev regarding not paying within the specified time if you the relevent licences are in place, but by signing and returning the promotion document you are agreeing to the conditions set out and this according to my lawyer is what she is concerned about, like you said we are not lawyers and therfore do not know what implications may arise from signing and returning such a document.

I agree with you when reading the document all seems above board, but my lawyer reads it differently and can see possible problems further down the line, so therfore i am going to go with her advice.

I contacted my Personal Client Agent at Calidonia today to clear up a couple of points regarding this Acceptance document.  I have just had her response in which she confirms that this document is totally separate to our PPC.  If you do not complete within the given period the only penalty is loosing the euros.  It is, as she says, a genuine goodwill gesture.  I have asked her permission to post her full reply and when I receive it I will post it here.

Thank you for your email.
 
I appreciate that you have contacted me regarding your doubt so I have the change to explain what the exact situation is with relation to the acceptance of the forms of our promotion “loyalty 2008”.
 
Fist of all I would like to emphasize that the 3.000€ is a goodwill gesture from us in order to thank you for your loyalty and confidence that you are showing in our project. Please note that there is nothing behind.
 
One of the conditions is indeed, that you will have to sign your deed within 3 month from the date that we will ask you to sign. This (commercial) condition is in order to obtain 3.000€ (or 2.000€ if the forms would have been sent back in July 08). In conclusion: if you have sent back the forms and you don’t sign your deed within 3 month from the date that you will be required, you won’t obtain the 3.000€ (or 2.000€).
 
Remember that these conditions are independent from your purchase contract (legal conditions). Obviously, by having signed your purchase contract you have the obligation to complete, like you will be able to read in your contract under clause 16 NONCOMPLIANCE ON THE PART OF THE PURCHASER.
On the other hand we have also obligations in order to fulfil the contract. The clause 15 EXECUTION OF PUBLIC DEED explains for example that will we notify you when we have obtained the Housing Unit occupation licence and on this moment we will require you to sign.
 
Conclusion: By having signed a purchase contract with us you are obliged to sign your deed. Now this can be with or without 3.000€ . Obtaining 3.000€ with the signature depends thus on if you accept the forms or not. If somebody is thinking that there is something tricky behind is just not interpreting correctly our goodwill gesture and hasn’t read properly his/her contract.

Hi All,
Just back from hols., (not Spain I'm afraid) I was just wondering what the general opinion on returning the Acceptance document is? I haven't returned mine and am just curious to see if I am alone in this?

I have contacted corvera as still have not recieved our building license and pablo has said we will recieve them as they are granted - i see that others on phase 2 have recieved theirs , but I thought all apartments on phase 2 had been granted building licenses  so i am not sure why only a few apartment owners have received theirs?

Have others on Phase 2 not recieved theirs too?

(our apartment is a menta which I thought was already going up)

Now I am confused!

We have also bought a phase 2 Menta apartment  but have received nothing directly from Corvera. I queried this by e-mail and received this response


Dear Gram.!
We have been gonted licenses for phases I and II and one currently building
properties in these phases. All phase I & II properties ( your property is
in phase II) are expected to be finished in May 2009

If you read through the broken English it seems that licenses have been granted for our phase 2 properties

My son is visiting Corvera in two weeks time and will be finding out for me exactly what the position is with licenses and who qualified for letters and promotional cards and who didn't. Like you I think that I can see our apartment being built on the website!!

I will update in a couple of weeks

Hi,
We recently enquired about the building licence for our villa and received the following reply from Pablo at Corvera:

"...the licence which was issued last April only covers the Tilo & Laurel apartments. We expect to obtain the building licence for the villas on phases 1 & 2 soon as we extimate to complete them in Many 2009 same as the apartments."

Difi's email would appear to clear up the mystery (I think). Despite previous emails stating or implying that all phase 1 & 11 apartments were covered by the building licence (or was I reading these wrong?), it would now appear  from Pablo's email that it is only the Tilo and Laurel apartments that are covered.  From what I have read from the previous replies, those with apartments that are not Tilo & Laurel have not received confirmation of the licence and promotional cards, I assume for this very reason.  For those with Menta and Magnolia apartments the wait for the licence goes on. Again it would seem that despite the criticism of poor communication the company persists in being unclear, come on Calidona just say it as it is.

Received letter from Corvera today stating following:

1. Building licence for our Magnolia villa (phase II) has indeed been received and dated 24/7/08 (we knew this already via our Solicitor);

2. They state that property will be handed over no later than 18 months from licence date (as per the Contract), i.e. end Jan 2010, but that they intend to complete before Dec 2009 (estimate completion date);

3. They state that they intend, if requested from myself, that the bank guarentee be extended to be same date as 18 months completion date.  Or, we can let the existing guarentee expire and renew when it expires (Oct 2008).  I have selected the former, but have to send the original guarentees back to them for renewal.

4. Client card offer (referred to in this post as the Promotional card), offering the 3000 euro offer already discussed in this post, to which I have responded with acceptance.

Just to say received a letter yesterday from Calidonia enclosing a temporary discount card and confirming that we will be entitled to 3K euros in accordance with their promotional letter (i.e. completion within 3 months of Calidonia requesting it).
