There seems to be a sense of urgency to finish Phase 3. Some people were even working on Sunday. Kitchens are fitted but although we saw what looked like the appliances being delivered last week they are not yet fitted. I expect they are trying to get the licence before the Town Council goes on holiday for August. The main pool has been built with 1 side hanging over the edge. I am posting a photo.

Hi Dave,

Thanks for the update and the photos.  I agree with you that they are probably trying to get the licence before the summer break.  Please conitnue to keep us all up to date on the progress and any news or rumours you may hear, as we do feel very cut off from the situation over here in the UK.

Very grateful to everyone who has been posting info on DJ III.

Bank Guarantee

Expiration dates of Bank Guarantees. Please read article 4 below.

The Aval Bancario (Bank Guarantee) or Insurance Contract were both established by a 1968 Law to protect buyers in off plan developments.

Art. 1. - The developer must guarantee the devolution of the deposited amounts plus 6% of annual interests rates, through an insurance contract or by bank guarantee, for the cases when the construction doesn't start or doesn't finish in the agreed time.They also need to open a special bank account for your amounts (different from the general one of the developer) and have it expressly written in the contract.

Art. 2.- In those contracts where the parties agree on anticipated mounts the developer must expressly state:

a) That the developer will give back to the buyer all the advanced mounts plus the 6%, in cases where the construction fails to tart or end within the agreed deadline, or the certificate of habitability is not granted.

b) Reference to the bank guarantee or insurance contract, indicating the name of the Bank or the Insurance Company.

c) Specification of the Bank or financial institution and the account number where the buyer's money is deposited.

At the signing of the contract, the developer will give the buyer the document that contains the guarantee (the Aval or the Insurance contract) and the document must have a reference to the amount that is anticipated.

Art. 3. - If the deadlines for starting or finishing are not met, the buyer can choose between cancelling the contract with the devolution of advanced amounts plus legal annual interests, or to concede a time extension, which will be stated in an additional clause in the contract, specifying the new deadline with the date for finishing the construction and completion.

The insurance contract or the bank guarantee together with the document that fully proves that the work has not been started or that the completion deadline has not been met nor complied, will have executive power as it is stated in the Title XV of Book II of Civil Procedure Law, to demand from the insurance company or the bank, the amounts that the buyer is entitled to, without prejudice of any other given rights also applicable.

Art. 4. Once the Habitation Licenseis issued and the developerproves the delivery of the house to the buyer, the Guarantees granted by Insurance company or guarantoorwill be cancelled.

The First Additional Provision of the General Building Act ( 1999) states:

The receipt of amounts of money on account when building is done by promoters or managers will be covered by an insurance that will compensate the breaching of the contract in an analogous way as what is stated in Law 57/1968 , of the 27th in July, about the receipt of advanced amounts when building and selling houses.That Law, and its complemantary provisions, will be enforced when building houses, with the following modifications:

a. The expressed Law will be enforced for the promotion of every kind of houses, even those made under the regime of community of owners or cooperative association.

b. The guarantee which is stated in the aforementioned Law 57/1968 will be extended to any amount handed in cash or by any effects, which payment will be paid by standing order in the special account which is stated in the refered Law.

c. The guaranteed devolution will include the advanced amounts plus the legal interests of money which are in force till devolution is made.

d. Fines for breaching what is stated in the first paragraph of of the provision number 6 of the mentioned Law, will be imposed by the Autonomous Communities, the fine amount will be , for every contravention, of up to the 25% of the amounts which devolution must be secured or according to whatever is stated in the own regulations of the Autonomous Communities.

Hi Everone,

Once again I am asking if there has been any more activity on DJIII since Dave's last posting on 9 June.  There seems to be a rumour that the certificate of end of works has been issued at the end of May, however from Dave's last posting work was still going in early June.   Any info would be much appreciated.

 Hi Patsy,

It's clear that they are finalizing the apartments. The kitchen appliances are being installed: something no developer does if he doesn't expect to complete soon. All little details like a path to the pool, working emergency lights in the building, labeling the apartments etc. have been done the last weeks.

A tell tale sign that the works are almost finished is that the road at the back which was severely damaged by all construction work got a new layer of tarmac last week. 

The only thing still missing is the garden area around the pool and some greenery at the front of the building. I'm not sure though if that is needed for the certificate of end of works. I have seen inspectors with clipboards walking around so it could well be that the license has been applied for. 

(remember though that after all these things DJI and DJII still had to wait a long time for their habitation license. According to Don Juan senior himself all the problems with the townhall are solved so he expects it to go smooth this time, but you can never be sure)

Hi Max,

Thanks for that.  We wait with baited breath to see if and when the inhabitacion licence is granted.  You say the road at the back which was severely damaged has had new tarmac laid.  Is this the road I often read about on the DJ forums which some taxi drivers refuse to use or, if they do ,they charge extra for -  or are you talking about another road?

Does any one have any upto date information on Don Juan III , I put a deposite down on this and I am informed that this has been paid to the developer even though the habitation licence has not been granted, I dont know what to do, whether to sue or not is there anyone in a similar situation who can give me some idea.

The 1st few residents have arrived in phase 3. The developer has opened a show apartment and is offering long and short term rentals as well as lease contracts with option to purchase. A sign of how poor the market is at the moment.

Can anyone tell me why there are so many vehicles parked on the access road are they all owners. Is the access to the N340 a viable route to the development it seems to be dangerous.

From the photos submitted, the cars parked by the road by the railway would appear to belong to day trippers who use the beaches along the paseo maritimo.  It is quite dangerous along Calle Ladera where there were cars parked in every conceivable space - so be prepared to reverse uphill if you are unlucky and meet someone drving up the  road. Some cheeky owners even park in spaces belonging to the development!

On the positive side, there are fewer cars parked along this road outside the summer season.

 Jenx, you are right the cars parked do belong to day trippers (mostly) who go to the beach this usually happens only during the months of July and August, this road is again fairly quite now. Personally I do not see what the fuss is about I use this road every day and it hasn't bothered me yes sometimes you have to reverse back but's its not that bad and on the other hand the road along the railway does not belong to us so other people have as much right as we do to use it as is also the case with road that goes up to DJ from the railway road which is a public road and hence public parking.

Yes you can get access from the top by the El Higueron restaurant and that is fine I certainly wouldn't classify it as dangerous.

I agree, if you have road tax, you you have the right to park on any public road, but there is a difference between a road and a pavement. On the hill on the far side of the station leading down to the coast road, the cars are parked on the pavement all of the way down. If you pushing a small child in a buggy, you have to walk in the road putting yourself and your child in danger, especially at the bends at the top and bottom. Not that those that park on the pavement give a toss anyway, as long as they don't have to walk too far too the beach, what would they care. Maybe if the local police started slapping a few tickets on the cars parked on the pavement, things might change, but I doubt if that would ever happen.
