Thanks Max for keeping us posted on the progress in Don Juan III - is it still progressing at the same speed and do you see or have you heard of any problems along the way with the completion.

I don't have any expertise with building but it looks to me as if things go even faster now. The roof was very complex and took weeks, but that's now all done. Windows and sliding doors are the next step and then the building will no longer be the eyesore it was.
Internally the floors are done, everything is tiled, the balconies are mostly finished etc. At this rate I would be very surprised if it was not finished before the August holiday.

Thanks for the photo Max it is looking almost finished, when you say the August holiday does this mean the builders take a break in August? If so is it at the beginning or end of the month? LOS are saying it depends on how long the delay is as to whether we get our deposit back or not. Am I right in thinking that when they finish they then have to apply for the FOL which I believe takes approx 3 months.

Yes the builders in Spain usually take the whole month of August off. The license of first occupancy can given after two years (as in our case), but it can also be done quite quickly. Especially as I assume there is already an agreement between town hall and developer over the major issues.
The first thing they have to do is to get a statement from the architects organization that the work is done according to the specs and with that signature they can apply for the FOL. I heard that 25 apartments are sold to a German travel organization who is eager to get them finished fast so I assume they will try to finish the work even earlier. The problem they are facing is that in August almost nobody works so if they don't have the license before it, it will be the beginning of September at its earliest.

I know several people are very concerned about the completion of phase III as they seek ways to get out of the deal due to the current economic climate. Then again there are people eager to complete as they already waiting very long. In view of this I can't say that I have good or bad news because it depends on your point of view.
What I forgot to mention in my earlier post is that it's relevant for your legal position when 'the license of completed works' is issued. There are judges who consider delays in issuing the LOF after the builder obtained the 'certificado final de obra' not the responsibility of the builder/developer.
At the current rate and after talking with some people in the know it seems quite realistic that the actual building will be finished in June (yes, this year :)) . Don't hold me responsible if my information is incorrect; I just try to be as accurate as I can.

Hi Max,
Is my understanding of what you are saying correct in that when the builders finish DJIII, if there is a delay in the issuing of the Inhabitation Licence, this delay cannot be taken into account for those who wish to get their deposits back, as it is not the developer's fault. So the delay period we are looking at is from the end of 3 months period of grace until the final completion date and not the inhabation licence being issued.

It's a bit more complex than that. If you have a real bank guarantee I would say you can get your deposit back regardless of who's fault it is. However I understood that most of the lawyers didn't properly safeguard the interests of their clients and that there are often no real bank guarantees.
In that case you have to go to court and demand your money back from the developer. It's possible that the judge rules that if the work is officially finished but the LOF not yet granted the developer is not responsible. That's why the date of the 'certificado final de obra' could be important.
Please take my words as just an informed opinion. I didn't study Spanish law and can't properly advise you. If you want proper legal counsel I can give you (by PM) the details of my own lawyer who is quite succesful in cases against developers.

Hello Patsy,
Work is still going on on high speed. By now almost the whole building has been plastered and painted. I will try to shoot some pictures tomorrow. Most of the work going on now is inside the apartments. The fundations for the swimming pools have been layed and fortified as well.
Don Juan told us earlier that the work will continue during Semana Santa (the coming week). I spoke to Alfonso (the technical architect) last week and he still expects to have everything finished by the end of may. Contrary to most Spanish people he tends to have a pessimistic view so he might not be very much off the mark ;)

Hi i have just got back from don Juan and phase 3 looks great now ,lower walls have the grey stone applied , and yesterday your pools where having the concrete put in the base at 11am yesterday.Also we went in a apt and the kitchens was not instilled yet but they where installing the fitted bedroom wardrobes in the apts and some bathrooms where done .bye irene

Hi it does look very much on the way but i can only say at Easter i was told October /November by the developer and i think they must be right but i also noticed they are working all afternoon to at the moment so hopefully it might be sooner for you all bye Irene

can any1 tell me if they have been succesful in getting their deposit back, if so could you recomend a lawyer as mine doesnt seem too interested in doing anything i ask.
