Hello Davmunster, At least Perla is replying to your queries i am still waiting for her to reply about the descrepancies in the garage and master bedroom size, on top of that my lawyer isnt much use either! which brings me to another question is anyone on this board happy with their spanish lawyers performance so far? I havent met anyone who is except for a friend of mine who recommended a lawyer in Nerja but then he doesnt work on cases involving less then a 20 to 30,000 euro claim and he doesnt speak English.

Was on site today. Again clear progress on the little details like pavements, railings, lamp posts, gardens and of course even more fences. However the road wasn't changed since last visit.
 
I would expect to see work on drainage systems as this is certainly the first thing they have to cover, but nothing...

Hi RG,

I don't have any complaints with my lawyer (Mona Davidsen), however she is not Spanish, she is the danish Consul living in Marbella. I have celected her, due to the fact that she speaks Danish and Spanish (I'm sure that she also speaks English).

To those of you that live in the Fuengirola area (or are on short visit), could you please shoot one or two photos of the development of phase III, and I would appreciate if you could have the phase II block 1 and/or 2 on the photo as well.

We are going to Spain in April 9th - 13th, and I hope that all of you which have bought in Phase I, at that time have moved in to your new home. And I will ask if we can come and se how these apartments are when the are finished.

Hi Lars, I will be going out to Spain at the end of this month and will as usual photograph all phases so i should have lots of pics to upload when I get back on 4th Feb. 

I also intend to visit developers office to get more info on completion.

My laywer stated that the developer intends to sent out the formal announcement of completion in February (to avoid claims based on the three months after november clause). According to law they then have 30 or 45 days to actually sign over the appartments.
 
Would be very good news, but the problem is that my laywer is not really the type that asks tough questions so it could well be some bull to keep him in the dark. When I mentioned to him the fact that the promoter had still to apply for the license he was just surprised. But maybe he's right...

We have just returned from one week in Spain. I have uploaded quite a few photos of the progress but especially of phase 3 and surrounding areas, there are photos of the railtrack to show how they are putting in a new line. I have even included a photo of the marble floors. We spoke to Perla who said they were busy doing the internal road and she said they will be very shortly starting on the road beside the railway which is expected to take three weeks. She said they are still hoping for completion in March.

Hi Janice,
Had a look at the site today (working day so couldn't really go up). Perla is right. They are clearly working on the road from DJ to the gate, but no activity on the road along the station yet.

Nice to see some new photos. Not too promising hearing Perla say they are  HOPING to complete by the end of March. Where have we heard this rubbish before. I reckon we are looking at April/May. We can only hope for a  miracle maybe.

Just posted a few pics taken from the train of our Don Juan.

This is the bit that is taking a long time and looks like a lot of work is to be done.

When you get past the entrance road into the development it looks almost finished,I was really impressed with the progress.

I wish they would get it done I cant wait much longer.

Hi Max,

It seems like you are often on the construction site (it's nice to have our own spy down there :o).

Do you know how they progress with the building i phase 3 (e.g. numbers of floors), last picture I have seen on this site they had build the garage level as well as 2½ level for apartments - any progress. It's only because I'm very interested in seeing how much this buiding will block the view for block 1 in phase 2.

Hi All, I was in Spain last week and had a meeting with my Abagado and I also got to see Perla from the developers. Both my Abagado and Perla both advised that completion is set for March and the developers are very keen to complete as they can then terminate their mortgage payments to the bank. However, I think based on their current work pace and state of the road next to the station and also red tape gaing the habiation licence, the earliest key handover will be in May and possibly  June. This is my personal gut feeling and I could be proved wrong. Regards Andy

At the moment there are three apartment floors in DJIII but it's clear they will go higher. You cfan see for yourself on the latest pictures of Andy.
Regarding Svend and Karin's question in the other topic about the completion date, I didn't get any notice from my laywer. After looking at the remaining work to be done at the roads I fear that Andy's estimate could well be correct. March seems certainly impossible. I keep my fingers crossed that it will be april as our current rental has to be empty before may.

Hi All,
Just uploaded some photos taken last Friday when I visited site to meet with Perla - would have taken more but access and time was limited. It was encouraging to see that work on the road directly up to the development is progressing but this work does not seem to include (at the moment anyway) the access road which runs parallel to the railway line and which was very mucky that day. In fairness work on the new rail line is still going on there so I don't expect to see much improvement on this section until that work is finished. As well I am not sure who in fact is responsible for that section of the road -is it the rail authorities, our developer, the local authority or perhaps all three?  Perla confirmed that they are still running with March for completion on Phase 1 and that as soon as they have the road done they will apply for the First Habitation Licence. Of course how fast the council respond with inspection and permission is anyone's guess but it does seem to me that the developers are actively working to get finished.  Given all that remains to be done I agree with Andy that March is looking a bit optimistic!

Having spoken to the Developers, they have confirmed that the building has been completed but the pertinent First Occupancy Licence has not been granted as yet. Therefore, they expect to complete at the end of March, beginning of April next.

Sounds good Sam, but every abogado seems to get a different answer :(

However I have some good news. I had a look at the site today and they started work on the road along the railway! What I see is that they are laying lots of pebbles on the muddy base. I don't know if they plan to lay tarmac on top of it. As there is no drainage in place afaik it could be a temporary solution. Anyway the fact that they started the work is a good sign.

Work is also going on at the upward road within DJ itself. Won't be long before that's finished.

For the DJ III buyers and the people who's view is dependant on DJIII: the fifth floor is constructed. Not sure if it will stop there. At the moment only the left part of DJIII (seen from phase 2) is five storey's high.

Hi Max,

Thanks for the update. I belive that it will be a 5 store + Penthouse building, however the middle of the building will only be 3 stores. If you have a digital camera It will be nice to actually see the progress (The roads, DJ III, etc.). We hope to see some of you when we are comming for a short visit in April.
