Hi All,

Spoke to my solicitor today. No news on completing. Maybe they are holding out till Christmas, just so they can throw us a surprise party to compensate us all for the extra costs we have had to pay out.

Hi all

Just got back from Spain after a two week holiday. Of course I went to the developer and saw Perla . Perla told me they were expecting news from the town hall in four days ,this was on the 6th of August. We instructed our lawyer to speak with them and she was told the middle of September is a realistic date. It looks like I will have to go back next month then as all my furniture is at my parents house in mijas and giving power of attorney to my lawyer wont get that lot moved so its more expence.

The good news is that the new road is great and the place looks fantastic. You can go straight from the new road up to Mijas and all the way to Marbella if you like , I did and its a nice afternoon out. I will post a few pics when I unpack the camera.

Hi Andy

Did you go to see your apartment again with Perla. Was all the white goods put in, and was the apartment dirty. Did you get a chance to measure up for curtains and blinds, or were you booted out after 2 minutes. As for her news in four days due on the 10th of August, I presume the new message was "We are hoping to get the licence next week. "  Where have we heard that before. As long as we complete before next March now, for skiing, I''m not going to bother phoning my solicitor anymore. She has been very helpful, but she says its not easy getting any information from the developer. Andy, if we are coming from the Airport on the A-7 motorway, is there any sign post for the exit onto Don Juan, and also for coming from the Marbella direction into Don Juan

1) Does anyone know if we have to have building insurance in place for the day of the completion. I would have thought so. I think I recall my solicitor saying she would set it up with the bank that the mortgage is from for the first year.

2) Does anyone know if there may be a building insurance block policy for all of the apartments, paid through our community fees. Apparantly the first year, the developer nominates who will run the community. True or false.

3) Do the banks need to see life cover is in place on completion.

I never got to see the apartment as Perla said we get to see it once before we get the keys for snagging and measuring etc. To be honest I never tried to hard or put to much preasure on as in the past it has fallen on deaf ears. I was told that all the white goods are in and this is why the security has been so good there lately.

As for finding the road to Don Juan I just followed the instructions that were on here , It is easy to find but im not to sure if it was signed or not. When you get to the garage you will see a porta cabin advertising a new development  that leads on to the new road. Here are the directions to save you searching.

coming from Malaga direction take the 217 (direction Mijas /Benalmadina). Take the A368 for a few hundred meters until you see a petrol station on the left. Take the road to the left (the main road will turn to the right).

At the first roundabout take the second exit , you will cross the A7 and come at a second roundabout where you go straight on. go round the road blocks and you will see Don Juan from there.

If you come from Fuengirola , take the A7 in the direction of Malaga. Leave it at the benalmadina exit 217. On the roundabout at the petrol station go almost round and take the Algecires exit. You go beneath the A7 and arrive at the A368 mentioned in the Malaga description. Follow the instructions above from there.

I will say that the whole place looked really good with the exception of the lack of palm trees.

Hi Westport,

My understanding is that you need individual insurance cover on your apartment, both buildings & contents- the community block insurance only covers communal areas, public liability etc.
Life cover is required by the bank and must usually be in place prior to drawdown of any loan funds.  As a proposal form has to be completed and accepted by the life company (health problems can cause delays or require medical reports)  and the premium paid before cover will come into effect it is important to arrange this in good time to avoid last minute hitches with the mortgage.  The same goes for the buildings insurance.

With regard to the community, yes the developer nominates who runs the community at the start, this can be changed by vote at the annual meeting thereafter but certain rules and procedures have to be followed to keep it legal.

Hi Gericom, With regards to the life cover required by bank, is this for the mortgage taken with the developers bank? as I have a mortgage arranged elsewhere and they have not mentioned anything about requiring life cover.

Hi all just recieved email from my lawyer. I am glad to inform you that the inhabitation permit at Don Jaun first phase will be granted within the next few days ,therefore, we will be in a posotion to complete shortley. I therefore require is a transfer of funds and to organize power of attorney. I broke this down from the full email. Also a breakdown of all charges was sent so hopefully we shall all be in soon .

Hi RG,

In reply to your question there was a time when banks insisted on mortgage holders taking out the life cover through the Bank's insurers, however in Ireland now you can supply an other insurer's policy provided it is acceptable as to amount of cover, lives insured, term  & provider etc.
I am not sure what the practice in Spain is but I expect that the developer's bank will be providing the life cover also - the only way to find out for sure is to contact whatever bank is providing the mortgage and checking with them.  If you have a mortgage "Letter of sanction in principle" from the lender it may be specified on it. 

Smiley is a big contributor on the general forums and is a mortgage broker based around Marbella  so you could contact him through Eye on Spain for good information on this topic also.

Well,  at last we have done it we completed today and have keys to the apartment. Already mop and bucket in use. the pools are not in use and are still needing cleaning. We are using builders water but there is no electricity yet, we were told by our lawyer this would been sorted on Saturday we will just have to wait and see. We did have to pay valia tax 500euros, Community set up fees 300euros and mortgage cancellation fees 750euros or they would NOT sign the Title deeds. We hope to have that refunded later. The apartment was very good although thick with dust everywhere and it is going to take a lot of hard work to get on top of that. It is a bit awkward without electric to clean properly, no hot water and dark in bathrooms. ( if I were you I would get Max to do it for you otherwise you are going to have to hold off delivery of furniture) Luckily there are four of us and we have spent a lot of time today but will need a few days yet.  We have´nt been given garage blipper keys only door key and we wont get them until the electricity is sorted. We are delighted to be in though and are looking forward to getting everything set up. We hope that you all get completion soon and look forward to meeting everyone soon

As far as I know only Perla moved in (with a box of candles). Based on the contacts we have (not only people active on the forum, but also by e-mail) I would say completions didn't start before monday. As these notary sessions take up two hours each at least there won't be many people with the key to their apartment.
We'll get some keys over the coming days as designated keyholders, but not a lot. Most will come in over the weeks. With 188 apartments it could a while to get them all done!
We'll visit Janmet tomorrow in their new apartment. but I guess we'll have to do without coffee :)

My name is jo and me and my family have an apartment in block 4 with the round balcony. we are completing on Friday and have been told we will have electricity within 10 days? Does anyone know if the developer is responsible for cleaning the pools or will this have to wait and be done by the community. Janmet can you tell me how dirty the apartments are as the last apartment my parents purchased was spotless on completion, this was by a different developer though. I will be staying at the apartment from the 19th of Sept for two weeks, lets hope we have power. we have purchased the apartment as a family affair but wiil rent out to family and friends.

Hi Janmet, Congratulations on your new aquisition. With regards to the pools, have the handrails been installed? did you or your lawyers ask the developers the situation with regards to getting them up and running i.e. do they intend to do this in the very near future or do they expect us the new owners to sort this out afterwards? I have to say I do find it bizarre that they expect us to complete with the pools in the state that they are in!

Hi Jo,
Missed your earlier post so welcome aboard.
Regarding the communal swimming pools, they are explicitly excluded from our First occupancy license as they still need approval from the Andalucian Health department. So I guess they won't clean or finish them before they have the license.

Hi Max, Thanks for the info on then pools but if the developers need to obtain approval for the pools surely they need to have these cleaned up & running with the handrails installed before the health department will issue a license?

Hi RG,
It's a good question, but I don't know the answer. I try to learn and study as much as possible about the Spanish laws and organizations, but there are still lot of blind spots.
What I do know is that there is a very recent and severe law regulating communal swimming pools so I'm pretty sure water quality and handrails will be provided for.

Sorry Mozza completely forgot the smiley face.

Apparently we were the first to complete so our solicitor has told us. Anyway it must be true because it feels like we are the only ones there. Definitely have´nt spotted anyone else moving in. There are workman about dont know what they are doing.

Jo, with regards to cleaning,  we have still a lot to do the floor have been washed numerous times but the dust is hard to shift. There are paint and grout to remove. I dont know if I am just a fusspot but I need to do a lot more yet before I will feel happy.
