Sorry for filling this board single handedly, but I found a new piece of information regarding the 'three months after november' clause. In this interesting read (http://www.eyeonspain.com/spain-magazine/bank-guarantee-legal.aspx) it states that after february we can either choose to withdraw our money or negotiate a delay. We are anyway entitled to a 6% interest on our deposits after this period. This is all regulated by Spanish law.
 
I don't know if the author is correct, but it seems a very thorough article. Maybe we can all contact our own lawyers to check if this applies to us. Mine confirmed the interest part. Will ask him about the withdrawal clause.
 
If so there is a real incentive for the builder to finish before the end of february.

Hi Max,

 Thanks for all the great information you are giving all the residents of don juan, I looked at that web site stating that we were intitled to money back if the apartments are not complete on time, thats great and you are right it might give the developer something to think about.

Do you know anything about the fence put across the bottom floor of block 6 are they going to do this to all ground floors.

Hi Max it sounds like you are over there at the moment.

How is the under ground tunnel going to the beach , when I was there last month ther was no way you could walk through it I wonder will they ever do it?

Hi Eoin, with regards to the fence around the bottom floor of block 6 i dont know if this applies or not but i am in the bottom floor of block 3 and i have been told by the developers that apart from the terrace i will have use of a 'private garden area' which extends approximately 2m from the edge of my terrace. Maybe this is what that fence is for?

See the photo section for more info. In addition tot the pictures I'll try to describe some of the work done.
 
The good news is that DJ II seems also completely finished as far as the actual buildings are involved. They locked up all the appartments just like they did with DJ I when the appartments were finished. Except for the kitchen appliances wich they will install just before handing over the keys everything is done.
 
More and more of the internal road and sidewalks are done or at least prepared for finishing. The little hills on which the buildings reside have all nets to keep the vegetation in place and lots of them are already pretty green.
 
The garages are mostly done: doors installed, fresh numbers and lines for the individual places etc.
 
The worked hard at the drainage system. It's not ready yet, but they are clearly busy finishing it. Same goes for the electricity.
 
Overall my impression is that they really worked on the project between august and now and that they want to deliver DJ I and II at the same time.
 
The main problem: the entrance road, seems to be solved as well. There is a separate entrance to DJ III for the builders. For sure they will share the same mud road from the Av de Carvajal along the railway, but they won't have to pass our central fence. I guess the Fuengirola rules will allow that as the builder is not responsible for that part of the road. 
 
So there is no decent entrance road after our central gate at the moment, but it wouldn't take months to lay tarmac on it.
 
It looks like the main hurdles are the finishing of the drainage and the electricity. Can't judge how long this will take, but got some optimism seeing the progress between august and october.
 
Hope this in combination with the pictures gives you an impression of the state of our beloved Don Juan.

Thanks for all the info and photo's Max, things do seem to be coming along, thankfully. I am just wondering does anyone know if phase 3 have swimming pools. I am just a bit concerned as there are a lot of apartments and hopefully the pools on DJ 1 & 11  do not have to accomodate all of these. Regards Donna

Hi Donna

I've got the brochure for DJ III and there seems to be two pools together to the right of the building looked at from the front. Difficult to tell the size but it looks similar to the two main pools in DJ I.

Interestingly the ground floor gardens of DJ III also have 'fences' although these are definately shown as low hedges perhaps only a couple of feet high. I guess the developers do pretty much as they like as they go along!

After studying the brochure for DJ III I would say there is just one pool visible. The text also mentions 'the large pool'.
However I don't think they will flood our pools as DJ III is clearly separed from the DJ I and II area.

Bad news: got official confirmation that completion is postponed from dec/jan to feb/march. My source is Perla, but please don't mention this as I don't want to ruin her trust in telling me these things. If you want to discuss it with her, refer to a 'remark from your agency'.
 
The stated reason is that the internal roads are delayed due to some issues with the regulations they encountered.
 
So we'll have to wait even longer :(

Hi All,

My Solicitor (Teresa from JLC in Los Boliches) has just informed me that completion (key handover) will be next April. I am now starting to get a bit concerned as they keeo on adding 4 months on to their estimated completion dates, this has been going on now since June 2006. I believe that completion will much much later than April as no one has taken into account the Spanish red tape which I'm sure will delay things.

If we all contact our Solitcitors to persue infomation on compensation/penalties for the developer it may get them to pull their finger out a bit. Not sure what else we can do.

If anyone else has any up to date info on completion I would be pleased to hear about it.

In March 2003 I signed an agreement with Viva estates on my apartment on don juan 1,   I paid the initial deposit of approx 6000 euros. The completion time shown on this document is two years..  It is now almost four years and still no notification of exact completion date.  I have contacted Viva estates, and in a friendly manner, was informed that my solicitor is the one to contact re-completion date.  Having pointed out that I have phoned my solicitor six times and E-mailed them once with no reply forthcoming. My solicitor is in Marbella.. I have placed this small article on this site so that any person out there being treated in the same way will not feel alone.  This is definitely the last time I will deal with either of these companies, who treat their customers in such an unprofessional manner. Thanks for listening,  I feel much better now.   p.s Viva estates recommended the Marbella solicitor.

Hi just got back from visiting Don Juan and spoke to Perla at the developers office. She states that they are finishing off the roads and bits and pieces and they are waiting for the habitation license and thinks completion should be around Feb / March 2007 so as Andy says looks like we will get keys in April. The contract states completion date to be Nov 2006 with a leeway of 6 months after which we would be entitled to compensation. As far as lawyers in spain are concerned i think that they are all pants! especially the ones recommended by the agents!

I think it's a good idea to let them know that we will require compensation. My problem is that my laywer is a lazy loser (yes Bevron, you are not the only one). If someone came up with an example letter we could just copy this with slight variations. Maybe my lazy loser is at least willing to print it on his letterhead.

Regarding the leeway RG mentions: my contract (and I understood this to be standard) states three months, not six.

Spoke to Perla today and she mentioned that they have all the paperwork ready to apply for the license. They still hope that it will be issued feb/march.
 
One of the things which delayed things was the new Fuengirola directive to store all garbage separated underground. They hadn't planned for this.
She clearly hopes that they can apply to the town hall before christmas. They are a bit concerned that the city won't act in the weeks surrounding christmas.
 
To get the license they have to finish not only the internal roads, but also the dirt road alongside the railway. This, she said,  is the collective responsibility of all the builders / developers in that area. I mentioned that the other developers won't be so eager as they are still in an early phase and need the road for work traffic. She stated that if needs be, they would finish the road themselves as it's needed for the license and they are eager to get it.
 
Asked if they want to handover DJ I and II in one go, she denied it. Seems to me like a good sign (for the DJ I owners that is) as this means they try to rush things.
