Yes, we are on the ground floor in Block 7.  Less than 1 minute from our front door to the nearest bar/cafe and restaurant.

A very curious feature had arison  with my apartment I too requested  room sizes  from arenal and received the dimentions for every room including the little hall ,and I am sure they are all bang on ,however when I added up all the room sizes including the hall which gives the total size of the apartment it came out at just under 70sqm now this is very strange because I on many

occasions checked with the agent who sold the flats and with arenal them selves at two diffenant property shows they all

confirmed to me that the apartment is 84.4sqm and in addition to this the balcony (terrace) is an additional 12sqm  so I

would like to know if anybody  would like to check out their measurements in the same way as I have done and see what

they come up with I am convenced they were conning me if I am right  a refund of 2.500euro is due for every meter under the

stated size would be due.

I was told by the sales staff at Arenal that the area quoted is the gross total of it's footprint measured to the outside of the walls. This has since been confirmed as normal practice by several developers and agents that I have spoken to.

Look on the bright side, the apartments are more eco-friendly due to the lower volume to heat / cool.

What you are telling me is that it is aceptable and normal practice to be lied to ,to

be coned to be lead down the garden path for years, and then to be told its ok.

I dont think so I honestly think you are one of the ones who are an employee

of the developer or you are one of the agents you should not be replying on

this site this really is the costa del con it is totally unfair to everybody.

jmtwsm is correct.  This is standard practice across Europe.  We are in the process of buying in Bulgaria.  It is the sme there.

I think it should be respected that the majority of people that post on this forum are doing so in an attempt to give or receive information, at what is for everybody a difficult and stressful time.  No-one has accused you Guss, of 'overly negative posts' or of being 'an employee of the developer or an agent' who is scaremongering and attempting to put everyone off buying their apartment so that they will have more to sell at an increased profit!! - so perhaps you would kindly not tar us with that particular brush just because we are (or trying to) remain positive.

I appreciate that you feel let down and are disappointed with the outcome, but I can assure you that I for one am NOT an employee or agent and have had a deposit on a first floor apartment in Block 16 since April 04.

So Cancan.  You are a relative newcomer.  We put our deposit down at Brighton racecourse on 3rd October 2003.  Funny thing was, we went to a property show there not knowing it was only Costa del Sol.  Oh well.

Yup, guess I am then!  Since we were told at that time that the apartments would probably be available in Spring 2006 I feel as though it's being going on for ever!

can I say folks dont forget  I am on your side in this ,and anything I say is a genuine concern

for those who have purchased and I am just making everybody aware that in the contract the

developer is allowed to be off the mark by 5% over or under if he goes outside of this margin

he is deemed to be in breach of the contract in our case he is almost 20% under the stated size

this works very much in the developers favour if he is allowed to get away with it ,so tell me why

would any buyer make excuses for the developer I would like to know this should, nt we be making the solicitors

aware of this fact so that he can confront them about this serious breach and claim back a huge chunk of

the money ,and it will not take years to process but simply a few months and the developer will have

to pay the costs, please do this instead of makine excuses like it happens in Bulgaria or all over europe

thats just rubbish folks lets start facing reality  and do what any genuine buyer would do

Guss my dear fellow,  are you trying to be offensive or does it just come naturally?   I am just a normal middle-age working chap from Somerset who lives in the real world !         Delays are most annoying but they pale into insignificance compared to the legality problems suffered by many on the CDS.           There is no mention of M2 in my contract, but I was given a 1:75 scale floorplan that was accurate.  I have visited my apartment and I am happy that I am getting what I have paid for.     I suggest you look at a Barratts or Persimmon development before getting on your high horse over this one.

at least you cant say that you havent been warned  and bye the way the contract states 5% not sqm

there was never any offence intended when I made my  points in this mornings thread sorry about  that

 but the fact still remainds the apartments are still  way under the stated size and nobody seems to care.

The plans that we have been given are drawn to a scale of 1.75.  However they are just a guideline, if you want the accurate dimensions you have to obtain the architects working drawings (can’t see that these will be easily obtainable).  It is these drawings that the builders work to.  It all depends when the build takes place, whether you have more space or less, due what problems the builders encounter.  It may not seem fair but it does happen even in this country. Obviously, if the dimensions are grossly out then you may have a case to argue in court.
I f you have been given dimensions on a 1.75 basis it is difficult to actually measure them out accurately.  You only need to be 0.01 out and you have lost space or gained it. This is why many chose not to buy off plan, as you cannot see the finished product until you are committed to the contract. We have due to the incompetence of the developer/builder been given the opportunity if we wish to see our apartments finished and if we are not happy with them we can now cash in and obtain our deposits back.
I think if anyone is unsure of the product they have bought, just catch a plane down to Spain, have a look and decide if it is for you. It would seem that it is easy to obtain the initial deposit back and although the money has been tied up for 2/3 years, it has not been a good investment, just put it down to life’s little experiences.
I believe we are all genuine purchasers on this site and we all have our own agenda’s. It is sad when some of us decide to leave the fold, we have all been talking on here now for sometime and we have built a kind of friendship. Who knows what the future holds we can continue to purchase or we can cancel, what is right and what is wrong? Who knows, only time will tell.

always nice to hear comments from a moderate it can be quite calming thank you

however I must tell you that I just cant let them away with this not over my dead

body will I allow  a spanish  developer treat me like this and there are several

others who have sent private notes to me who want to go the same road maybe its my

Irishness that doesnt allow me to thak this lying down .no more talk its time for action.

I shall be looking into the situation properly when I am there in September.  I must admit that September shall be make or break time.  We have an appointment booked with Solicitor and have every intention of viewing the infamous apartment.  We shall have the opportunity  to make our own judgement on the way forward.

We have always thought that the apartment is on the small side, but OK for our needs.  Thank you for bringing this information to our attention Guss.

HI there to everyone on the Arenal Duquesa Forum,

We have bought on Arenal Golf in Benalmadena. Reading the Duquesa posts is like reading those for Arenal Golf. It seems both developments are experiencing the same non communication from Gerens and from Quermes who they have appointed to deal with enquiries. On our development three phases have been released. Phase 4 due for release in Jan 07 only has 3 completed blocks (ready since October 06) which have not yet been released. There has been no building work since 27.02.07. We are told building will begin again on 3rd September. We are living in a rental on one of the earlier phases and are determined to sit it out although many purchasers have or are in the process of pulling out.

The non communication which results in chinese whispers is really frustrating and we have to keep reminding ourselves if Caja Sur had not bought Arenal out the owner would have gone bankrupt leaving us  in a bigger mess than we are now. We've forgotten what our belongings look like since they've been in storage since the end of November!

Lets hope things start to improve on both developmenrts soon.
