Hi All

Recieved  letter today from President of urban conservation entity

It describes how Ph 2 President Benjamin Escolar has refued to transfer our Entity fees  citing bad relations?

It's also asking us to pay the ammount agin or face a 20% surcharge from the Town Hall

It's signed Moria McGee

Anyone get this letter?

Anyone Clarify this

Hi

Yes we have also had this letter, what can we do about this? We pay enough without having to pay an additional 20%, Did you also have a letter about the broken lifts. Our block is not one of the ones named but I thought, this would have been covered in the community charges. We are in Roda last week of September we are going to try and make an appointment to meet up with Moira McGee, Has anyone else found anything out.

Hi Folks

We also got this letter and are getting sick to the back teeth with the problems that seem to surround our phase 2 committee members. Some of them seem such a useless bunch and obviously cannot carry out their duties efficiently. 

With regards the entity fees - how can 1 man in the name of Benjamin Escolar get away with refusing to pay a whole communities fees leaving us all with a demanding bill for an additional payment or else face surcharges from the town hall. His excuse for refusing to pay our entity fees seems ludicrous. If he has a problem with bad relationships of committee members and the number of meetings held then surely as president he should sort that out himself and not withhold paying our fees. He needs to explain and clarify his actions to all concerned if you ask me....

We also received the letter about the lifts and can confirm there is a major problem here. We have a penthouse in block 37 so the lift situation has been affecting us badly for a long time. We have spent a lot of time trying to communicate with our committee regarding the problem and it is a complete waste of time to be honest. We send lengthy e-mails to Marisol and as yet have never received a personal reply from her. What we get back is a 1 or 2 sentence response from someone called Maria that states the obvious which is worthless. Basically our committee is arguing that the problem with the lifts is not theirs but the developers therefore are refusing to pay for them to be fixed. We also believe that our very efficient president thinks that the OWNERS should have sorted the problem out themselves before now and not have left it to the community. We can also confirm the seriousness of the lift in block 37 as we know of owners who have been stuck in the lift a couple of times having to force the door open and jump from it. This is totally not acceptable hence the reason the lift has been closed. The problem is that because the committee are trying to demand payment from the developer then we may be waiting a very long time before we have a working lift again which obviously affects a lot of people having to reach the top floor. 

If anyone from phase 2 would like to PM me for further details and any suggestions as to what we can do as a community to rectify some of our problems please feel free.

Hi Everyone

I have just joined this web site which was recommended to me by Paul from Baxters Spain. I too have received this letter re Entity Fees today. I was very surpised to hear they had not been paid. I was under the impression that when the Housing Comunidad collected these monies from our accounts it was down to them to pay them on our behalf to Local Council. I do not think the President should be allowed to make this decision regarding withholding our monies for this Legal Requirment. I shall email Mr Escolar with my opinion and hopefully a lot of other residents will do the same.

The Egm in October will deal with all Things detailed in the recent 2 letters

Think it's a bit of a power struggle between some people

Don't pay anything else until we hear what's getting said in Oct

My apologies for lack of response but am currently at Roda and only have limited access to internet.

 

P12 owners will have also received a notification of an EGM on 11th October when the President wanted to inform all owners via minutes if not present of his reasons for the problems on the elected Entidad Board and his actions.

It would appear that sensible discussions cannot take place at Entidad Board level and drastic actions have ensued, even though both VPs as well as many owners will have reservations about the action undertaken by our elected President who under Spanish Law wields absolute power in the community until challenged..

It almost seems to be a case of using a sledge hammer to crack a nut but I do understnd the need to release funds paid to the Entidad in good faith in order for services to continue but perhaps we should all give the President an opportunity to explain his actions on 11th Oct and perhaps reply to the letter by aking for some understanding and tolerance in order to sort out the issue in a sensible fashion.

Re the EGM, I have not yet received notice of this meeting, I sent a private message to Stewart1 asking for information, which he kindly replied to. My neighbours in Bloque 39 have not received notification of AGM's in the past, and had I not been recommended to this website I would have known nothing about it.

Good evening 

I am the President of the UCE of Roda Golf & Beach Resort and I have received numerous emails regarding this issue to my email address presidenta@live.com and welcome any owners on Phase 2 to feel free to contact me for accurate information about this issue. 

In the interests of clarity the UCE Board is fully functioning and all members give very generously of their time on a completely voluntary basis to manage the affairs of the resort. 

I personally take great exception to the posting made earlier by Mr Chris Perree who is Vice President of Phase 2 and would invite Mr Perree ie Hugh Man to present any evidence to back the statement which he has made (highlighted below). This allegation is offensive to all of the Entity Board Members and quite possibly libellous.

"It would appear that sensible discussions cannot take place at Entidad Board level and drastic actions have ensued" 

Without any evidence or support for this allegation, the statement should be withdrawn immediately and an apology issued to the UCE Board Members who commit considerable time and effort giving up their own free time to ensure that the Resort runs efficiently.

Hi All

I think we should all take a step back & look at the bigger picture which is the well being & Running of Ph 2 at Roda

All this sniping especially on a Message Board like this will Not help the Entity issue

Hopefully common sense will prevail with both sides seeing how difficult each others Voluntary Jobs are.

We paid our Entity fees in good faith and on time and assumed that was the end of it.  I am amazed that the money has not been handed over and that one person has made that decision without any of us knowing.  It is still another month to the EGM when, it is supposed, the matter would come to light but how many owners will actually be there and how long afterwards will it be before we get the Minutes.  When would we have known that there was a problem had Moira not sent us the letter.

No offence is intended to anyone and believe it or not I am actually trying to help resolve an issue which has stemmed from problems of differences within the Entidad Board of which I am not a part.

Experience normally shows that communication and arbitration are more effective than threats.

Without taking one side or the other it is however obvious that if sensible discussions at board level were taking place perhaps this whole sorry episode would not have been necessary, were board members not elected on behalf of all owners to run all Entidad issues related to Roda?

For the record, I have already asked the President of P12 Phase 2 to reconsider his stance but I am not in a position to, or willing to challenge his right under Spanish Law to make decisions on behalf of the community as the currently elected President.

It may well be that other owners will come forward and make a challenge either prior to or at the EGM, in the meantime threats against individuals will do nothing to resolve the situation.

Brief update

After many discussions and negotiations, it looks as if Benjamin has agreed to authorise the transfer and will try to explain his reasons,actions and concerns at the EGM.

 

Common sense has indeed hopefully prevailed in the short term

 

I just hope all owners who were dragged into this will  be informed they will no longer be regarded as debtors though some I know have already paid twice through confusion and concern

I appreciate all the efforts on our behalf from all members of communities and entidad - however the entidad fees should not be within the authority of the president of a community. 

The community is merely acting as a collection point for these fees, not a controller of them, and therefor I do not understand why the president should require a legal challenge to release them. This is merely a client account for onward payment! 

There is a meeting planned for the entidad within the next couple of weeks, and i would respectfully request that there is an agenda item to change the collection method, so that these fees are paid direct to the entidad in future. 

I am informed by an entidad member that this would also be of benefit to the community, such that if an individual does not pay, the council will chase them as a debtor, rather than the community having to pay on their behalf to avoid interest charges.
