Negative or positive I have the same right you have to voice my thoughts. I will calm down when the money stolen from me is returned. Tony you can not truly know the outcome of how this will turn out. You may be right, but you may be wrong and each of us has the right to do as we wish.

We didn't expect it all but now we will get no BG, no house and no refund. It doesn't take much intelligence to work it out.

Hi All,

              the main thing here is that if they were liquidated then we were stuffed with nowhere to go. But now there is a plan that the courts have agreed to and they will still be under the scrutiny of the courts until they have repaid the said moneies and completed the project. while 5 years seems a long time to wait you still have the option of going for the banks via Maria or your own solicitors and now have the time if you wish to. As for taking action against HdT there would be no chance of that unless they fail on the time scales in the proposal so don't waste your money there. But the banks thats another matter if enough of you get together and negotiate a fair price from a solicitor who knows

How condescending your posting is yes lets not blame those thieves at HDT dont let's take any of their monies lets take the money from the banks. While the banks must take some responsability the main thieves appear to be getting off scot free carrying on with their fancy lifestyles drawing salaries from our stolen money.

I could scream and have done with frustration at how this company behaves and with impunity, the laws are there to protect us supposedly but as usual HDT/Almudena always seems one step ahead.

Well it aint all over yet and as my ole gran used to say what goes round comes round,  I just hope I live long enough to see it.

I dont want you to have your house cause it'snow going to be  at my expense if as you say the build goes ahead. Your right 5 years is a long time and anything can happen.

Let us not blame the Hdt thieves let us do more business with them. There is absolutely no way they will still be operating in 5 years as their plan is not feasible. If the company had no money to refund deposits how can they possibly find the money to pay for the licences and build houses?

Unfortunatley brianmags and tony incase you didnt realise there were people that voted NO to the proposal that means they did not agree with it and dont want to wait 5 years for 65% of their money back, so next step is to fight the theiving scum in court for our money. If they have money to build then they can give us our money back which the stole from us with out giving us a BG which is illegal YES illegal.

They are liars and theives and i wont let them carry on conning more people, SARC you should be ashamed !

totaly agree with you views and others.  I recieved an e-mail from Hdt saying they have recieved enough votes to continue with the build, still waiting a few weeks for the final count and the courts,suprise suprise, dont hold your breath.

I replied that i am not a creditor, investor, or share holder in their company.  I paid a deposit in good faith for them to build me a house.  The contract stated it would be built in 2 years or my deposit with interest would be repaid.  As it is well over 2 years and they are in breach of contract I want my deposit back. This should be no problem if they are going to deliver this time they can afford to sell on all the unwanted plots by the NO voters and give us a refund.

I also mentioned that without a refund I would be joining with the other No voters to take legal action against solicitors who did not secure BG, Banks who did not issue them, And the company who did not arrange BGs or cancel them against the law.

If anyone who has voted NO have recieved the same e-mail please reply as I did to it.  Some of us do not want to roll over and lie down.

Anyone from yes crowd (tony etc) you can have my plot for the same price I paid,  I am not asking for a profit, 3 years on it yours for just over 200,000euros.  this is a sleal when built in 5 years you will make a killing.  Drop me a line if interested.

Hi all,

Just wanted to state my support to all the no voters and any action that we should take when the votes are officially counted.

I voted NO and i am not going to be dragged along with the YES vote for another 5 year ride. I will be doing whatever it takes to get my money back, so i'm open to any suggestions on what we should do next.

The whole vote was a con to start with.

Not having to decide if you want your house or money back before voting gave them the best chance of securing the vote in their favour.

Now the banks will want to know who is prepared to sign a new contract, this is where it could all go wrong.

Voting yes & wanting your money back ruins all their calculations.

so I am also interested in how many having voted yes, want their money back & so should SARC.

Have sent a reply to HdT`s email, stating I`m not interested in their proposal and that as they are in breach of contract by 3 years I am entitled to a full refund and interest. Have advised them I will be joining a class action to retrieve my deposit and interest.

What is worrying for those who have voted yes, was the last sentence of the email saying we will inform you over the next few weeks of our Next Plan of Action! God help us all.

I`m with you for a class action, like Claire says I ain`t going down without a fight! Cheers Joanniemac

It is good to see the silent majority now coming out. I hope we can act as a collective and take the same action.

I have the same email and will respond as other have. Once the vote is checked I guess we should all communicate to ensure we all take the same actions. Has anyone got a good solicitor worth talking to? Should we go as one action ?

You might be interested to know that I have my Lawyer (a UK and Spanish based one) in Warwick County Court next week for a directions hearing before a full hearing is listed.

If anyone else is taking the same action against their lawyer for not providing a B.G please p.m me and perhaps we could share info and if anyone would like to act as a genuine witness to all the goings on with B.G's or just attend to support me at my full hearing that would be very helpfull indeed.

Hi All,

Willsb has a better chance of a positive result to legal action than any action against HdT.  The whole point of adminstration is to enable a company to restructure its debt & then have a  LEGAL binding agreement that resolves the debt issue.   I tend to agree with Willsb that the solicitors should be liable for their failure to protect their clients interests & I wish him all of the luck in his forthcoming case.

Hi all, its good to know we are all thinking on same lines and not giving up. The e-mail from HDT that some of you have got, I have never had anything from them (letters or e-mail) all my info came from my solicitor and on here. If anyone could p/m me with their e-mail i will also send HDT my thoughts on their proposal.

Hi All

We would just like to say we will be taking some kind of action against the banks via our current spanish lawyer or Maria and Costaluzlawyers. We think we would be wasting our time going after Hdt/SJ as they will just go into administration again. We would be all better off going after the banks in my opinion.

Incidentally, we have never received any emails from Hdt/SJ so we're not expecting one now, otherwise they would get the same response as everyone else.

Hi All,

Just received a reply from Hdt about my last e-mail.  Some of you who replied to them may also have recieved the same letter.

They say the are SORRY I am not happy with the outcome of the vote, but they have given us the best options they could.  A 100% refund is not finacially possible, and a repayment schedule will be agreed if they come out of administration.  They also suggest the quickest way to get my money back is by selling on my contract.

I replied i didn't care about the vote either way, I want my money back.  There is a down turn in the market and no confidence in them so they could buy back my contract (with no interest) and sell on my plot and Malva for 200 000 euros now i would be happy and move on with my life. 

I said they were in breach of contract no house after 2 years I have no confidence in them, and am not prepared to wait any longer. I told them that I am informed that THEY cancelled my BG wich is illegal, and on those two counts I am prepared to take legal action unless I get a refund.

I hope any one receiving the same message from them will reply the same way.  We will stay in touch and i will keep you all updated.

I have also received a lot of PM's from other like minded people who would be interested in a class action so we will wait for the results and see.
