An official company statement will be issued on Monday 21st September 2009,  the notification will give full details of the procedure that must be taken in order for clients to apply for a full refund of monies paid in relation to reservations of property situated on Las Higuericas Finca Parcs. This procedure will apply also to clients who are still awaiting their Bank Guarantees, these clients will receive full refund facilities.

Now see the statement i have received from my agent just now the same upto one certain point

This is the statement received last night (17th September)  from Cleyton Ges.

 

Dear Sir / Madam,
 
Re : Las Higuericas Finca Parcs
 
We wish to inform you that an official company statement will be issued to you, this statement is just awaiting the official company and legal stamps and signatures before we are able to release the statement firstly to agents,  and then to clients on Monday 21st September 2009.
 
Further information will be forwarded to you a.s.a.p.

We write to inform you that the project Las Higuericas Finca Parcs has become financially unviable during this current global crisis, therefore  it is the intention of  Cleyton Ges S.L.  to refund all payments including interest to clients that have reservations for property situated on Las Higuericas Finca Parcs.

 

In the first instance we require agents to contact their respective clients to inform them directly of the situation.  

Once all respective clients and agents have signed the cancellation of the purchase contract Cleyton Ges S.L. will issue instructions to the CAM Bank to expedite the refund through the Bank Guarantee.

For those clients that are still awaiting the issue of their respective Bank Guarantee a bank instrument will be issued with a maturity date twelve months from the date of issue, this will include the sum of 6% interest from the date of reservation until the date of maturity.

Please contact your agents for further information from Tuesday 22nd September 2009. Clients who have purchased directly with Cleyton Ges S.L. will be contacted during the next week.

I would encourage you all to get independent  legal advise for a correct cancellation process.

It seemd CAM is starting to refund out of Courts those to those buyers with Bank Guarantee. We have received a proposal today for one of our clients in the development.

Funny how they can make statements like this when our "new" lawyer says that CAM Bank have no idea where Cleyton Ges staff are!!!

This is a double edged sword very sad news for those of us that had intended to complete on our properties, but those speculators that had no intention will now get their money back. It seems that there were so many of the latter which has helped to put the final nail in the coffin for one of the most attractive sites in the region.  Lets now hope that the developer has the chance to redeem themselves and to prove the disgusting minority former bloggers wrong !!!!!!

I would be vary carefull and take Marias advice regarding cancellation as I would suggest that it is up to the developer, if ythey are not building the development, to cancel the contract, not the buyer and tye statement regarding the issue of a BG seems a little confusing

In oder to execute a BG you must have grounds thise grounds being tha the property is late or not being built not the same as if YOU issue a notice cancelling the contract

Financially in the last post the person talks about contacting the administration company does this mean that they are in administration now which agian cam alter claims but very strange that you are mailing a Hotmail address

I don´t think that the comments regarding the financial viability fo the site have anything to do with the investors, propertues have been finished for a long time with people willing a able to complete I would suggest that this may have more to do with planning and the costs of getting the required infrastructure to the site for the granting of the COH

I may be being a little suspicious here but I do understand the way, as Maria does, that the process in Spain works

Thanks for the advice both.

Does anyone know how this affects Aramis Clients.  I have emailed the hotmail but have not had a response yet.

I have signed contracts from Cleyton Ges, stating the monies that I have paid and the fact that all monies were supported by a cam bank guarantee, which I never received.

If anyone has any informtion on this it would be great.

I would suggest that you contact the Finca Parcs Refunds telephone number as soon as possible and discuss it with them.  The lady dealing with this matter is Anna.

You can then take your own decision as to whether you prefer to take independent legal advice in this matter.

Hello everyone. Just wondering if there is anyone else out there in the same boat as us.We paid the initial  deposit  and then also half of the price of a swimming pool.We have documents showing it was paid to CAM bank,to 2 different accounts, but we have no bank guarantee. Has anyone any ideas as to how we should proceed? Will it cost so much for a lawyer to sort it out that it wouldn't be worth it? Could one lawyer take on all those without bank guarantees to share costs? And which lawyer?Is there one who has already had success for clients without bank guarantees? Or surely, according to my logic, we should be able to approach the bank directly to claim it back if it's in an escrow account , but we'd probably need Cleyton Ges to cancel their contract. I'm sure we shouldn't cancel our contract, for fear of that backfiring on us.

What a nightmare.Any pearls of wisdom please?!!

As I mentioned to Mia, firstly I would contact the Finca Parcs Refunds telephone line 0034 686 767 921 and register your application for a refund.  Discuss your issue regarding the pool with them and see what they say.  The lady dealing with this issue is Anna.

Finca Parcs are keen for every client to register their request for a refund as soon as possible.

One Lawyer - yes that is possible.

Share costs - also possible

I do not think there has been any success so far for clients without BG's.

I and a group of friends do not have BG's.

Send me a Private Message if you want more info on how we are moving forward with the refunds process.

Help help help!

Are there any others out there who were clients of the wonderful Aramis Investments that don't hold a BG and have any idea what the best route is to try and get back any money?

I would be very keen to set up a group of like minded individuals to combine efforts and try and get a result. 

Please send a reply or reply privately if you are interested in getting together and discussing options?

We did manage to get through to Anna tonight, and we sent an email .She said that she is planning to send an email out to everyone soon explaining the procedure, so we'll see what that says.

Ana at Finca Parcs Refunds does not seem to have much information so we are looking forward to receiving the official communication by the end of this week so we can all understand exactly the process that must be followed in order to receive the refund that has been promised by Cleyton GES.

As many clients are being represented by Spanish Lawyers it would be useful for the official communication to be published in its original Spanish form as well as in English.

Today I have just returned from CAM Bank in Murcia where I have just received a cheque for my deposit  with interest.and I am now back in Hellin however not for too much longer!

I can only share with you all how I went about this as I have watched this forum for many years and treat some of the information posted with much intrepidation. In May of this year I contacted an independent lawyer in Murcia, Jose Galindo of B & Q Abogados Lawyers. The process has been relatively straight forward however until today at 12.00 I suppose I still had my fears with everything that has gone on. My advice to anyone and this is only my experience and that of what Jose has said is that if you do not have a Bank Guarantee it will be extremely difficult to recoup your money. CAM Bank will only pay out to those with BG and that you are able to show that Cleyton Ges are in breach of contract. As CAM are unable to make contact with Cleyton Ges and I showed Jose the latest statement released he informed me that he finds it difficult see how now CAM will pay everyone out because from speaking with CAM that is not their belief.

Our process involved sending a burofax to the builder and thier lawyer who did not reply. This was to obtain the date that the builder had applied for the building licence. Having no reply Jose contacted Hellin Town Hall to obtain this information. Our house on Phase 2 had the builing licence granted on 28Sep 2007. With this information we had to act within 14 days and I went to Murcia to give power of attorney to Jose and  to visit the Notary office to carry all this out. I provided all transactions of my payments to CAM, contract of purchase and of course the bank guarantee.

The whole process has cost me approx 2,500 euros which has been well worth it rather than lose many thousands more. I have tried to condense this process for you all and have been fully honest in my account. I am happy to an swer any questions people may have to help if I can, as we were people that moved a young family over to start a new life. I wish everyone the best in their efforts and hope you have a successful outcome.
