Hi Everyone,

Firstly we would like to thank all of you that came and joined us for a drink and nibbles on Christmas Eve, it was good to meet up again, lets hope that next time it will be at our place !!

We have put all of the questions raised on the prior thread to the developer and these are the answers that we have received directly from them this morning.

 All GENUINE clients situated on phases One and Two should have received a copy of the Building Licence for their property either from their own respective agents of directly from Cleyton Ges S.L. this would depend on whether they had purchsed directly from the developer of through an agent, clients can request another copy if required  !  Lawyers of clients also have copies of all of the relevant legal documents relating to the project.

  The verdict of the accusations made by certain political parties was,  No case to answer, The Environmental administration confirmed that all relevant paper work had been submitted, approved and was in order.  

InspectahomeSpain.  The reason the developer has not answered your questions is,  after speaking with you direct on the telephone it became very clear that you are not acting on behalf of any clients.  They had requested that if indeed you were acting on behalf of any particular client that the person concerned contacted them direct with any relevant questions,  no requests were received.

Model Esther properties situated on Phase 1 are completed,  and just waiting for the certificate of first occupation to be issued by the Town Hall of Hellin, this is out of the hands of the developer.

May we respectfully suggest that anyone that has a property on either Phase I or 2 and has not visited the site recently take the time to come and have a look for themselves.  All of the Show Houses are now completed and availalbe for viewing.

 

We hope that this answers a few of your questions.

Thanks Ricman for the situation update,

Its good to know the developer is still talking to somebody, is there anyone else who could verify the information - its disapointing that you seem to be the only spokespeople for the developers. Their FP website offers little information of substance.

I understood the fact the original builders licence WAS granted by the local Hellin Townhall - but in April 2007 was revoked/annuled by the more superior Regional courts of  Albacete?

I dont doubt that the copies of the original licences sent out were gained back before the Albacete hearing, but surely if the licences have since been revoked (2007) then they are not worth the paper they are written on? Have the developers appealed the annulment of the licences? It seems from the recent press releases from November this year that the courts have revoked the licence for phase 1 without ambiguity.

So what is the exact current status of the licences? Under appeal or void? Or are the press releases misinformation? 

It seems now more than ever that unbiased legal advice is the only recourse before progressing any further.

With respect ALAMRED  we are NOT on the payroll of the developer or any other body involved in the construction of Finca Parcs. We are an independant private company.

Debs C, the licenses were NOT revoked may we respectfully suggest the you contact the developer direct for further information.

The developer will speak to any client or lawyer that wishes to contact them, however according to the girls in the office very few of you choose to do so !

Maybe it would be a good idea for a few more of you to come and visit the site for yourselves.

Lions Den and Dont kill the messenger come to mind here ..................             I visited finca parcs with my partner just before xmas just to see how things were coming along we were also given a copy of questions and answers that was released by their legal guys in response to some negative reports about the venture, if any of you want a copy send me a private mail or as ricman suggest contact the builder direct.

Ricman,  I wonder why client's are choosing not to contact the developer.  I have done so on numerous occasions, throughout the five years I have been waiting for my villa. According to the information they have given me I would have been living in it many years ago, and the whole development would have been finished by now.  By the time the development is finished I will be lucky to have any retirement years left to enjoy it.  Surely when things are repeatedly not going to promised timescales the developer should be contacting their clients to explain why.  Customer service??

Alamred, I feel from your postings that you are somewhat mis-guided when it comes to your perception of our company.

If you are visiting  Spain and the site soon then I would like to meet with you and explain more about our company, Or you can call us.

In the meantime (and as all of our clients already know) here are a few details.-

Firstly yes we do have a link on the finca parcs website in the "About our partners section"  if that is what you are getting at?? This section is equivalent to a "Links Page" on any other website.

Because we set the company up solely for Las Higuericas, we do have a good working relationship with the developer, and this it would seem to some that we are part of/owned by or work for Finca Parcs. as we have repeated many times  We Don't, !!!

We set the company up two years ago and myself (Richard) and Mandy and our two girls and have been living and working in Hellin (15mins from the site if people do not know where it is) for 6 months and visit the site on a regular basis so we can keep our clients updated on the progress their houses and advise on local services that they require.

Like everyone on this forum (well almost everyone it seems) we too are waiting for our house to complete , so we have had the same worrying letters, setbacks and delays much the same as everyone else, and all we are doing is to ask the questions to the developer and the builder and pass on the information on to anyone who requests it.

The service we are providing at the moment is complementary therefore we do not have any financial gain/income at all, all we are trying to do is to provide a service to all of our future neighbours!!

If requested we will stop posting our answers, updates and photos on here and you can source them yourselves from your agents.

I and some friends have an interest in Phase 4 at Finca Parcs.  We reserved our plots via Town & Country Estate Agents in November 2006 and paid the deposits in good faith direct to the developers CAM Bank account as instructed by Cleyton GES in November/December 2006.  Just over 2 years later we still do not have our Bank Guarantees to which we are legally entitled.  Given the well documented problems with the Phase 1 building licences we felt that we needed some clarity regarding the exact situation.  We put several questions to Cleyton GES and below are the answers they provided.

1.            Do Cleyton Ges have a valid copy of the Environmental Protection Report and has it already been presented to the court with the appeal?
 
CLEYTON GES, S.L. HAS ALL THE LEGAL AND VALID COPIES FROM THE ENVIRONMENTAL DEPARTMENT. DURING THE PAST FOUR YEARS THE ENVIRONMENTAL DEPARTMENT HAS APPROVED THE PROJECT IN EACH OF THE STEPS OF THE ADMINISTRATIVE PROCEDURE,  THE LAST REPORT WAS SENT TO THE COURT BY ENVIRONMENTAL DEPARTMENT , DECLARING THAT ALL OF THE PROTECTION REQUIREMENTS HAD  BEEN CARRIED OUT BY TOWN HALL AND CLEYTON GES, S.L. Nevertheless Judge considered that there was one more remaining report . THE ENVIRONMENTAL DEPARTMENT STATES THAT IN ITS REPORT SENT TO THE COURT THAT, THE ADDITIONAL REPORT REQUESTED WAS INCLUDED IN THE ORIGINAL REPORT SENT TO TOWN HALL IMMEDIATELY BEFORE THE LICENCE IN PHASE 1 WAS RELEASED.
 
2.            How long do you expect the appeal to take and will building work continue during this time?
 
THE BUILDING WORKS ARE IN PROGRESS AND CONTINUE DURING THIS TIME. FIRST OF ALL, THE SENTENCE IS NOT DEFINITIVE. SECONDLY, BECAUSE  EVEN IN THE EVENT THE COURT OF APPEAL RATIFIES THE SENTENCE APPEALED, ENVIRONMENTAL DEPARTMENT HAVE SENT ITS REPORT TO COURT DECLARING THAT TOWN HALL AND CLEYTON GES, HAVE CARRIED OUT WITH  ALLTHE LEGAL REQUIREMENTS..
 
 
3.            Is it still possible for the Town Hall in Hellin to issue the Licences of First Occupation while the original building licences are ‘Anulada’?  Or do they now have to wait until the appeal case is heard in the Administrative Court?
 
THE TOWN HALL IN HELLIN WILL ISSUE THE FIRST OCCUPATION LICENCES. A NON DEFINITIVE SENTENCE CAN NOT CHANGE THE LEGAL STATUS OF A VALID LICENCE. THE TOWN HALL DOES NOT HAVE TO WAIT UNTIL THE APPEAL CASE IS HEARD. IN ADDITION THE TOWN HALL RELEASED A REPORT ON 26TH NOVEMBER 2008 INFORMING THE FIRST OCCUPATION LICENSES WILL BE ISSUED.
 
4.            Is it possible that the Town Hall could issue the Licences of First Occupation, the first owners move in and then the Court ‘Anulada’ or ‘Nulo’ the Licences of First Occupation?  Or is the Licence of First Occupation a licence that can NEVER be revoked or cancelled?
 
“ANULADA” HAS A VERY DIFFERENT MEANING TO NULO. “ANULADA” MEANS THAT THE LICENCE IS LEGAL AND CORRECT BUT HAS A DEFECT, in this case, according to the Judge there is one more report to be included, THIS HAS TO BE RECTIFIED. IN ADDITION, THE ENVIRONMENTAL DEPARTMENT HAS DECLARED IN FAVOR OF THE TOWN HALL AND CLEYTON GES, REMARKING EVERYTHING IS CORRECT AND IN ORDER,  IT IS ACTUALLY IMPOSSIBLE FOR THE ENVIRONMENTAL DEPARTMENT TO STATE ANYTHING DIFFERENT. HOWEVER IN THAT IMPOSSIBLE EVENT, IT IS WITHOUT DOUBT THAT TOWN HALL AND REGIONAL GOVERNMENT WOULD BE REQUIRED TO INDEMNIFY CLEYTON GES AND CLIENTS WITH LARGE COMPENSATION,  CLEYTON GES HAS ALWAYS PROCEEDED AND BEHAVED  ACCORDING TO THE LAW AND LICENCES RELEASED. IF A LICENCE HAS A DEFECT, “ANULADA” OR “NULA” THE LIABILITY IS WITH THE TOWN HALL AND REGIONAL GOVERNMENT.  
 
5.            Is there a case pending in the court to have the Phase 2 building licences ‘Anulado’?
 
 
PHASE 2 LICENSE IS NOT ANULADA,  PHASE 2 WAS NOT OBJECTED TO BY EITHER THE P.P. PARTY (PP PARTY ACTED AS PLAINTIFF IN PHASE 1 LICENSE CASE)  OR OTHER BODIES, THIS CASE WAS A POLITICAL STRATEGY  IN THE LOCAL ELECTIONS HELD IN MAY 2007. THE PP PARTY ATTACKED THE URBAN PROJECTS IN THE TOWNS GOVERNED BY PSOE PARTY AND VICE VERSA. THE LICENCE OF PHASE 1 WAS RELEASED IN MARCH 2007, BEFORE THE POLLS. THE LICENSE IN PHASE 2 WAS RELEASED IN OCTOBER. THE PP PARTY WAS NOT INTERESTED IN ATTACKING LAS HIGUERICAS AFTER THE ELECTIONS HAD PASSED.
WE HAVE TO REMEMBER THAT PP PARTY AS DID THE REST OF THE POLITICAL PARTIES IN TOWN HALL OF HELLIN, VOTED IN FAVOUR OF LAS HIGUERICAS PROJECT, AND NO NEGATIVE VOTE WAS EVER MADE BY THE POLITICIANS THROUGHOUT THE  FOUR YEAR ADMINISTRATIVE PROCEDURE,

Hello Keith110,

Refreshing to get information from another source, poor old ricman gets a bashing doesnt he?

So there is an appeal in process - pity this wasnt conveyed to clients earlier, but do we know when the appeal is being heard/dealt with? Will we be notified of the outcome, dont want to be moving in then the appeal fails and we are in trouble then.

It does all seem to be politicaly motivated over there doesnt it. Lets hope for a more succesful 2009 , happy new year to all who post on here!! Off out to enjoy myself and forget these worries.

I did try before to post this earlier but my comp plays up so much, so apologies if I end up double posting.

Only 2 points in response to Ricman the first is that any company that is a preferred partner where there is no opportunity for other partners to join in and that will gain directky as a result of tnhe success of a single supplier/builder, cannot be truly independant

I do have real clients and perhaps the reason that I have nor recieved a response is that there is no answer to the lack of a damp proof memn+brane on the properties or support steels in the borderng walls, both reasonable queries based on my isnpection

happy new year all,

have interest in ph 4. Bin watchin this develop from sidelines, but think wuith it all goin pear shaped to say that it seems when the developer is under pressure ricman pops up always in his defense, are you related to someone on the payroll?

Also good keith110 got some answers, but what about he other problems about the other phases - still no guarentees of it goung past phse 2, what about the community centre and stuff. This political party probems are tip of the iceberg, if they do keep the licences then what if the people move into ph 1,2 then no following community ammienities?

Aslo what about the recent revealing of previous unfinished projects by the developer? Whats happening there, maybe ricman can tell us about that?

 Having read now the mst recent posts I feel that it is important to make a few point regarding this development, especially after the comments made initally by Ricman earlier in this thread that the developer had told you that they believed that I was not representing a client

I have little to gain as I do not sell property, or mortgages, or do keyholding, building, supply pools and I am bit a simple surveyor

It was state that it wa his belief that I did not have I was not asked to look at the site by a buyers groups and although he was not part of the developer he advised me on a public forum that this was te reason that I has not received a response to my construction queries.

Well for the record my office is in Torrevieja and I certainly would not have wasted a whole day visiting the site and carrying out other due digilencewithout somebody paying for my time

It was also claimed that Gill in the office has advised me that to obtain answers that the potential buyers should contact them direct, again not true as per the e-mail received from the developer

Moving on I did not publish any of my findings only to say that we were generally impressed with the build quality and that there wee a few construction queries, being professional I would have preffered the developer to answer directly but as Ricman has advised me, on a public forum, that I cannot expect responses I will detail them here

The first is regarding the provisioning of a damp course and installation of a damp proof membrane at ground level in the peoperties as there I could nit see one provided. The issue that that the soil is very caly like and will retain water and runs to the edges of the walls surrounding the properties. There was already some evidence, photographed of water stains on walls and a number of properties in this area have, after a couple of years had to be tanked and a DPM installed

The second query related to the walls bordering the properties as there were so steel ties attaching the walls to the columns and evidence, photographed, of cracking of both the bricks and covering render

Finally on the external stairs the slope of the steps ran towards the properties and would not allow for water to drain

Previously on this forum another development was mentioned and allegations that the development had not been fully finished or that the COH have not been issued were denied howevever my own investigations, the pad due diligence for the investors found this to be true

Now Ricman you may not be being paid by the developer but certainly commercially it is in your interests to make sales completed and you either are independant or authorised to make statements on behalf of the developer and if I object to items that I discuss with the developer being passed onto a third party

For the record it is ILEGAL in Spain to sell a property and not provide a valid bank guarntee, to buiold propertues without valid planning consent and a buyer should not complete where there is a planning dispute or no COH but please get independant advice

Ricman, please correct me if I am wrong here, but the facts of the matter are I understand, you are related to Gill, the Cleyton Hes company secretary, so independent you are not.

I must totally agree with the previous comment by Inspector Spain regarding purchasing a property where a planning dispute is occurring. Surely, to proceed with such an outstanding issue in place is highly questionable and would not be the option advised by your solicitor.

Presumably, if all is well with the building licences, then no difficulties or further delays will result regarding the issuing of the Certificate of Habitation. Let's see what happens next?

I read the messages on the Fincaparcs forum with great interest having been exremely bitten by the predecessor of  this developer (the directors and many of the staff are the same).  There has been some reference recently by inspectahomesspain to unfinished houses built by a company called FincaExpert  in and around the Catral/ Dolores/Rafal area inland from Guardamar. There have been 30 plus houses built by this developer in 2003/2004.  NOT ONE IS LEGAL.  One complex still has NO mains water, or  mains electricity. Has no Proper roadways, and acccording to the local Town Hall does not exist!!  It does not have proper addresses and cannot use the postal services.  God knows if there are fines on the properties or not. In other words the fantastic infrastructure charged extra for in the prices of the houses amounts to zilch, and the 30 plus buyers (mostly british pensioners) have been ripped off.  A severe case of fraud - no - many severe cases of fraud..

My reason for bringing this to the attention of this Message board is that perhaps the directors may be jolted into the necessary completion of the complex (which has been paid for handsomely by the occupants.)  Perhaps they do have consciences but after 4+ years its doubtful.  I might add that a recent emergency occurred  requiring an ambulance. Becuase we have no legal address the ambulance was unable to find us. THIS COULD HAVE BEEN DISASTROUS.

This is my first posting after watching the forum for a few weeks. My wife and i visited the site at the very begining and i mean the very begining. We went to Spain through a british agent very soon after they were offered the chance to sell for Finca Parcs. We were taken to the site by a guy called Vinni. My first question to anyone involved with this forum. Is any of you in contact or know how to contact Vinni. Both my wife and i found him to be very honest and if he is still involved with Finca Parcs we would like to contact him.If he is not involved with Finca Parcs have any of you a contact no. for him. He we feel might be able to throw a lot of light on a lot of your issues. REGARDS TO ALL BRIN

No he worked for Finca Parcs because he came to the uk with the big boss of Finca Parcs and took us back to there old offices after we went to the las heguritas site so he worked for them direct not through an agent. BRIN
