Infact at that amount of money I would be happy to shaire the job. I do the summer & some one else does the winter.

Right, I've bought a broom, mop and bucket in the hope of early retirement.

In the meantime, my intial questions to RPM were:

1. In addition to providing lists of companies that provide services could you also provide details of the selection process you used to determine which companies should be given contracts ? Presumably you obtained quotes and details from several companies as this would be good business practice and meet existing international financial practice regulations (Sarbanes-Oxley, etc). Please also provide copies of those alternative bids.
 
2. When is the next meeting likely to take place ? Presumably this will need to be very soon in order that residents can approve the budget and future spend ?
 
3. Provide details of how many properties have been sold and unsold on the development. I would assume that the share of community fees for unsold properties will be met by Polaris World.
 
4. Advise the propsed community charge for each type of property.
 
5. Advise who will administer collection of fees from non-payers as I understand this is a significant problem on other developments. Please also advise time limits on reseipt of payments after which action will be taken.
 
6. Finally, a detail question that is obvious from the budget. How can a sum of 93504.31 euros be acceptable for cleaning of stairs, etc on the penthouses ? This is excessive and requires immediate investigation.

Wonder when and if I'll get a response. Can't think of anything else to ask at the moment as need more information to getter a better understanding.

Hi Kev

Like you, I have e-mailed Victoria to ask her pretty much the same questions i.e. show me the other quotes you obatined for the work etc.  Without this information is it extremely difficult to decide whether or not the figures provided in the budget are competitve. 

I would also like to know how it costs 93,000 euros to clean the stairs.

I may make this as a query to Victoria and it may be really obvious maintenance charges but as we weren't being connected to Iberdrola until around October last year I was curious what we are paying for- any prior charges are PW's surely? My first thought is are we paying everyones the electric supply!!?  I suppose we didnt think we would be paying for the installation of the main supply to the resort- but maybe they are just monthly maintenance charges?

For those of you who have not received your emails here is the text:
Point 2 is interesting as, unless I have read it wrongly, they are just going ahead with the budget and will charge us what they decide as stated in point 4.
 
Dear Owner
The reason for this email is inform you about the following matters:
1º.  We have asked to each company which are providing services at Condado de Alhama, a report about the tasks that they perform, staff, timetable, equipment, etc.
A report of that information you will receive, so you can study it detaily, but iin case that you were interested in more details, the full documentation is available at our offices in order you can check it.
2º Our Propose is that the Complex will continue getting services that until now have been given, we will implement the budget which we provided, subject to an appropriate time to change it, it change the budget to implement the results of this modification
    3º As agreed at the assembly which was held last 20 of February, we keep working on the summons for the next assembly.
 
        4º The amount of the fee will be sent to you.

 
NOTE: As committed on the assembly of reference, I attach the following documentation:

- Copy of the General Articles of Condado de Alhama Private Property Complex.
- Copy of running cost incurred in the period June to December 2008.
- Copies of the budget 2009, until further agreement.
- Alternative Budget Resort Property Management, S. L.

NOTE: There is an item at the budget called Complex Maintenance, this item is listed as total € 0.
Any cost incurred on the complex maintenance are covered by the reserve fund, due that is their purpose.
 
NOTE: The cost of the lifts and staircase cleaning PENTHOUSES only will be attributed to them, because they are elements commons which are only used by these blocks.

Hi Phil

Thanks for the info.I.ve requested update three times since Monday but nada as usual.Does it mention when they propose to start taking Community charge?Thought I read somewhere it was 10th March but Mick thought it would be late March.Going out next week and planned to top up my Spanish account then but if its 10th might have to do it now.

What i have posted is all the information they sent, with the exception of the budget spreadsheets.

As far as I am aware they haven't stated a date so far.

Have a good trip next week,we are out 1st week April and can't wait.

I spoke to Victoria today and she just said money for Jan, Feb and March would be taken this month no dates?

She could not tell me how much?

She could not tell me when the next meeting is either?

So how are they authorised to start taking the money out of your account ? I can't remember signing anything regarding payment of comminity fees, only authorisation for Polaris to handle the water & electricity connections for us. Can someone please refresh my memory and enlighten me if we have signed something to authorise this. I will have to make a pretty prompt transfer if this is the case as we NEVER pay fees for being overdrawn and don't intend to lose the 'unbeaten tag' on our first ever financial venture away from home soil.

Prior to signing my deeds i had a package of info from PW within that was a form which i signed allowing them to arrange Water and Electricity and another form which was a direct debit to allow the community to take the community charge from my bank.

All this paperwork was handed over at the notary when i signed the deeds.

Just been looking through the budget, and a few thoughts.

1) External Roads - Are we paying for the areas outside of the gated area?  If yes, do Polaris pay re the office area use, and what about all of their vehicles for building around the rest of the complex?  Total in budget covering "external areas" is over €700,000 - mostly gardening!).

2) Definately need to see some other quotes for the gardening, security and cleaning - also the administrator fees at €300,000 look high, but I think they are trying to justify that with the word docs.

3) I think the main reason why our per apartment fees are so high against the original discussions is that we have far fewer properties than planned, and we still have the infrastructure costs - missing Mirador, Golf Suites, La Isla and the villas.

When we completed we signed the water/electricity authorisation but did not sign the community charge form so I am hoping that they cannot take the funds out of our account until this is signed and definetly until all the charges are finalised and agreed.

We completed by POA and it was my understanding from our solicitors that it is a legal requirement in Spain to complete the Community paperwork BEFORE the notary will allow completion.

That said I know on other communities that there have been problems with collection of community fees.

Does anyone know if this is correct?

Same for us- I recall that there was a form in the PW pack sent out and I asked about the com fees doct because we didnt know when that money would start to be due.  Our solicitor said completion can only go ahead with that doct and water + electricity documents signed. I seem to remember her saying this was brought in  because so many people used to default on their com fees and those costs then get divided between people who have signed up properly. Obviously that then causes massive bad feeling amongst owners and residents. She went on to say the biggest problems had been with buyers who had bought quite a number of properties in order to develop their own holiday rental company who then decided not to pay the com fees and had notoriously been difficult to force back into the system.

Mind you  other developers probably do it differently and leave the whole fee situation to the community committee and thats when the default situation arises to a greater degree.

I wonder if they will be as quick to refund, if the charges and reviewed, as they seem to be to take it out before its even been agreed.

This may have been answered somewhere else and I have missed it but What do we know about Resort Propert Management S.L?

I have done a number of searches through both English and Spainsh search engines and it comes back with nothing.

Is this a company that PW have set up?

How robust an organisation are they?

It is possible that all of these were answered at the meeting presentation but as most of us where not there and have not seen the presentation can anyone enlighten me please?

I would at least like to know that the company we are giving all this money too is financially sound and that it is not going to go bust taking all our community charges with it and leaving  us all owing millions of Euros
