Hi Linda

Glad to hear that this "ola de frio" isn't usual for October - that's what our friend Juana Maria said too.  We have actually turned on the electric radiator in our living room tonight for the first time!  It's probably worse for you, living in the campo.

If it's not advisable to post the Q & A, would you be able to send it to us in a PM - no rush!

Hi Briando, yes we have decided to go for the jugular, fed up being pissed about by the Administration process. We are hoping to kick SJ/HdT into touch and maybe prison! Want our money back ASAP so we can get on with our lives. Have you come to a decision yet? Cheers Joanniemac

Yes we have made a decision, it was made before the admin took over and its not changed.

We wanted a house in Albatera, not anywhere else.  We were prepared to wait until two seperate contracts had expired before agreeing that we pulled out and got our money back.

The builder agreed to this and sympathised with our position, i critisised them for not looking after their customers and not delivering on their promises.

I have had to endure so far, the real possibility of a financial disaster.......

So let me think....should i say yes ok then, go on, lets have another go at this house building malarky, even if its somewhere we dont want one......................not on your nelly.

IWMMB................and let me get out of here

As I have gone down the Court route thus far I will continue with it.  Would I ever trust this Company again, No. 

I Want My Money Back and will continue  with the Legal route.  Four years is enough and I have no trust or faith in them to spend any more of my money.  I will purchase 'key ready' and from a reputable builder in future.  We live and learn the hard way. This has been character building stuff but I was quite happy with who I was.  Now I want out.

I sincerely hope they read how many people will not continue with them.  Let them read how disgusted their customers really are.

i have just scrolled down this thread and read the posting by wadge about the news from his solicitor. I have read it and can see why it was burried under some derogatory postings and the poor chap suffered some abuse. All I will say is that it is worth reading the posting at the very start of this thread!

Tony can you expand what this section of the report is implicating and what is meant by dispel rumours ?

The report will be in the public domain and available for all to read. It will include the amount of money each purchaser/creditor has paid (-IVA ) and it should dispel many of the rumours.

Again from the SARC report .this is quite a statement Tony  can you expand .I am sure there are many solicitors who would like a wider explanation of your accusations .

There is concern that purchasers may be being advised to take action prematurely for little gain and this will minimise their options at an increased personal cost in fees to the solicitors.

Is this not a ridiculous statement , with wide spread unemployment throughout Spain and most of the world of course there is available labour what is your point Tony ? or is Almu just feeding you more waffle to cloud the true facts of the situation .Of course there is labour but can SJ/HdT afford to employ and pay for this labour ,another ridiculous point that tells us nothing as usual .

I find it difficult to believe that you could not get back to the first post on this thread and imply that it is not possiblr to do so! hhmmm why would you say that.

Any way just to help you out, I have copied and posted it below and as i said it is interesting. By the way thanks for all the hystroincs and daft remarks I am glad that your BG  enables you to act in the manner that you do. You definately do not like the fact that the posting below agrees with the information form the SARC reports and as mush as you might wish to howl at the moon, it will not change the fact that an other source has provided similar information.

Further to our recent e-mail we write to confirm that we have had a meeting with the Concurso Administrators and the owners of Herrada del Tollo SL (San Jose). In our meeting with them they stated the following:-

 
 
1.                  San Jose are now able to continue with the building works and they calculate that within 18 – 20 months the properties will be ready to hand over
 
2.                  They have assured us that the original price of the properties will be respected but some kind of extras will be included to compensate for the delay. We asked what kind of extras they would be willing to include but they were unable to answer us at this stage.
 
3.                  They stated that shortly they will contact all of the buyers in order to confirm this and ask if they wish to continue to purchase the properties or whether they wish to cancel the contract.
 
Some of you have already confirmed to us your wish to cancel your contract with San Jose, however, if you have not already confirmed your instructions to us we ask that you now do so. Although at this stage all of this information has only been received verbally, once the official letter has been received from San Jose we will need to take the appropriate steps according to your instructions.
 
On another note, we are aware that some firms of lawyers have started a rumour saying that they have managed to negotiate with San Jose for the quick return of their clients´ deposits. Both the owners of San Jose and the Concurso Administrators have confirmed that this is not the case and it will be absolutely impossible to return any money to anyone at least until the Concursal proceedings finalise.

Hi Tony

JA may be saying she cant find it because she dosnt know how to look for it, through the back buttons on the posting page.  Im sure if she needs any help its better to tell her how to, if you need any help JA drop me a PM.

As for the posting you have re-produced, like most stuff you home in on its out of date and has been discussed on the day.

I had several PM's with Wadge who gave me the source of the information, in confidence.  I then sent it to my solicitor for comments and verifictaion and got the answers i was seeking.  Try doing the same, its the best way to arrive at the truth.

To address some of the tings on the posting which will give an insight into the way you use information Tony.

1     Are you saying point number 1 is accurate and San Jose can continue building in any sites in administration?

2    Are you saying the original price of the properties plus a minor incentive is a god thing and will offsett the revaluation of properties for mortgagae purposes?

3    Have you any evidence of anyone being contacted directly by San Jose with an update on the state of affairs?

This posting was back in October....................Tony...are you just putting stuff on here that happens to fir with your thinking patterns?

Tony I genuinely could not find wadge's post it was so long ago and I don't think anything in it has actually happened yet just like the SARC reports .I did notice that as usual you were unable to expand on any of the points I put to you from the report .Which makes me think you only take the information  grom Almu in parrot fashion and don,t actually digest or think it through there for I will take it as it is a load of tosh.Regards JA
