Hi,

first of all may I say how sorry we are to hear of the problems facing people who were further along the buying process than we were. We wish you all the very best of luck in getting the solution you want - whether it be your house or a refund.

We only got as far as placing our reservation deposit but when we received the contract from San Jose, alarm bells rang as our own due diligence showed that  it was illegal under Spanish Law (something our Spanish Solicitor - PSI - didn't even pick up!). We tried to get it changed but to no avail, so we pulled out of the deal and ended our dealings with PSI. We also found, again from our checking, that the claims made by Ambasun regarding the licences were incorrect (we wouldn't have even paid the deposit had they not claimed that all licences were in place).

Since that time we've spent hours on the phone with Ambasun and sent many emails but they have, quite frankly, been a complete waste of time. Talk about take your money & run!

Anyway, we have now got our letter regarding the administration & know we need to register our claim. However, as the claim is for just 3k euro we see no point in spending a further 2-3k euro on legal fees to try to recover it. We would, however, still like to register the claim.

Can anyone help us with the text of a letter we could use to send to register our claim? I believe it needs to be in Spanish, hence the need to ask for help.

Hi Steve and Susan,

we have used a local spanish tutor who we found on the internet who read the letter for us and then drafted a reply. we gave her £50.00 and sent the letter off.

i am sure if you look on the internet in your area there are a lot of spanish teachers around.

Steven & Susan,

The fact that you received a letter indicates that you are already on the creditors list.  The only problem you have is knowing how much they have you down for. 

It may be that you don't need to register, but I'm sure there are people here who can confirm what you should do.

We have a translated copy of the text - send us a PM with your email and we can send it over. We are trying to establish whether we have to use a solicitor to communicate with the administrators or if we can send in relevant paperwork - presume just original of contract? Like you we don't want to spend more money to recover nothing. Does anyone know?

Hi, we also had to provide proof  of payments made to SJ for Deposits, whether that be by Bank Transfer or a clearing bank etc.  They want the originals.

Just a reminder to all those who used an agent,  you must make sure you have the evidence of the Agent paying San Jose, not just you paying the Agent.  This is essential in your claim of credit.  If you haven't got this you need to act quickly.  I personally would put a final date as August 1st as everything will shut down after this.

Also make sure your initial 3000 is included also.  Many are missing this.

Thanks for the offer of a translation of the letter we received MJB - have sent you a pm as requested.

I had really hoped that someone would be able to help us and share the spanish text of a letter to register the claim. I appreciate that many of you have much more invested in this and are paying for solicitors to pursue you claims and I don't want anyone to think we're trying to 'piggy-back' at anyones expense. Its just that the amount we wish to claim is almost the same as it would cost in legal fees so there is no point in paying for a solicitor. We're quite happy to just register the claim and let the process take its course. If we get anything back we see it as a bonus but don't hold out much hope and expect people who have more invested will take priority.

We just thought that, because in the past the people on this message board had seemed to be friendly & helpful, it was worth asking. We understand that everyone is probably more interested in their own situation so I guess we'll just have to try to put something together ourselves & send it in.

If anyone can help though, it would be really appreciated

I am Simon and have secured R4 410.
I have just found and read some of the messages and it seems we are all in the same boat.
There are probably people on this board who are out in Spain so do any of these people actually know any other developments that San Jose are actively building in the area right now that I could psooibly swap to?

Simon,

I would think that your only choice of developments from San Jose right now would be the Playa Golf development in Campoamor (near Cabo Roig) - I know they have finished  properties in Playa Golfs I, II and III still available. I think quite a few of the guys who had put down deposits for the Santa Ana site have now transferred to Playa Golf.  
If you can get the OK to transfer from the Administrator then you should be in a good position to negotiate a good price for one of the available properties with San Jose.  Check out the postings on the other Santa Ana and the Playa Golf  threads - you'll see some info there from people who have or are about to transfer across.

If i had a letter transcribed you could have it with pleasure, the only problem is having paid a solicitor to send a letter, it was them that sent it.  In other words most of us wont have a letter to share so we simply couldnt send you one.

Draft one up and send it to a local Spanish speaking person for translation, shouldnt be too hard i wouldnt think.

Also with transferring from plot to plot in San Jose....they have two companies in administration so you need to look at which site is which company.  Also at this time they would not be able to supply a fresh contract for any property, there is no guarantee of build times etc.  It is also a requirement (for what its worth) that the deposit money remains in the specific account for the development concerned..................

I cant see how a transfer can be made but if you hear of one, please let us know.....it would be a positive event.

Or a bank guarantee being paid out......that would also be a real event too.
