I have just heard on the radio that the High Court in Seville has passed demolition orders on 334 homes in Marbella. Does anyone have any idea where these are??

This is a part of the problems surrounding Operation Malaya. diariosur has been keeping people appraised of the happenings. I am not sure just where these properties are but they have apparantly been built without the authority of the junta de andalucia, having local (corrupt) authority only. The buyers have, for the most part, been unaware of their illegality but are being held responsible by the junta and the courts. The junta have earmarked some €60m to cover demolition but will be looking to recover this from the owners. It all seems very unfair.

Check the Marbella papers, they have all been covering this because it is massive.

There will probably be an appeal, just as in the case of the centro comercial in Roquetas. The appeal in Roquetas was successfull but this cannot be taken to mean that others will be.

This problem is likely to have an effect over all of Spain, not just Marbella. The web of corruption is still being uncovered but many formerly influential people are in prison and no doubt more to come.

We all need to check that full junta approval has been obtained and not taken as read that it will be obtained.

I am buying an offplan in Almerimar and am watching very carefully .

Hi Noel and Wilma it most definitely is a problem throughout Spain although at the moment the worst case of what has been happening is in Marbella but we are only aware of it because this is the most developed market and the other costas have merely imitated what has happened here. I believe that Almeria, Murcia, Valencia in fact the whole coast is going to get a wake up call. It has to be remembered that if one is careful then there should not be a huge risk but so many people who buy here are keen to be sold to and believe everything they are told by the one person they should tread cautiously around - the person selling them the property. I am not saying dont trust estate agents as some of them are extremely good and very honest people. Just dont rush in too quickly before doing some research and MAKE SURE YOU GET EVERYTHING IN WRITING! So many people say to me "but the estate agent/developer/lawyer told us this....." ask them to put it in writing and make sure you keep it on file. Ask the questions has it got all its premissions to build if they say "yes" then ask for them to confirm it. After all it is probably only the same as one would do in the UK - why not do it here?

Sorry something I did not address is that as yet it has not been decided who will owe what to whom. There are some left wing radicals who want to burn everyone at the stake! However socialist moderates and the conservatives seem to be taking a more common sense approach. There are a number of suggestions being thrown around as to reparations but the burden of responsibility in the most part is likely to fall on those that have committed the crime. Dont forget the Junta seized 2.5 billion in assets from Roca and his cronies. There is possibly more that has gone overseas. The developers themselves will also be contributing in money and land to replace the land that has been in effect stolen. I think it more unlikely that the burden of debt will fall on the buyers themselves but the jury is still out.
