Tax paid when selling a property in Spain

Hi all,

Just wondered if anybody reading this can help me?  My partner sold a property in Spain last October and at the time paid a tax to the local notary and was told this can be claimed back. Can anybody tell me how long it is between selling the property and being able to claim a refund of the tax paid? Thanks

Was this the 3% retention tax on property sold by non residents? It is refunded once it has been shown there are no outstanding taxes on the property such as capital gains tax, inheritance tax etc.

The solicitor who dealt with the sale should claim the retention tax back if there is any. It should be done in a few months but the tax office have been known to be very slow and can take over a year to get it. Your partner should contact the solicitor dealing with it to see how it is progressing.

If the house was sold last October, you need to check immediately whether the tax refund application has been filed. If not, you should contact a tax expert or gestor in Spain as soon as possible for advice on the next steps.

Goodness gracious, taxes again! So, the house is gone but the tax ghost lingers? Perhaps a quick scan of your records will unearth some clues! Remember, ignoring tax issues is like playing a really hard level in geometry dash– it just gets worse. My brain hurts just thinking about Spanish tax laws. Back when I sold my old car, I completely forgot to finalize some paperwork and it took months of headaches to sort out. Luckily, a friend pointed me in the right direction.

It seems like the process can take some time, especially if it's the 3% retention tax. Contacting the solicitor to check on the progress sounds like a good  fnf next step.

Hi everyone who has responded to my post!

It has now been almost 16 months since my partner sold the property in Spain.  The estate agent who handled the sale was also claiming (allegedly) back the tax charged at the point of sale. There has still been no sign of any refund.  I have contacted the agent several times to ask about the progress, the last time she answered me she told us that we had to be patient - that was 4 months ago.  Since then, any communication we make with her is just completely ignored.

Anybody any advice where we go from here please?  It's very frustrating as they told my partner that he had to keep the Spanish bank account open for the refund to be paid into - meanwhile this racks up charges upon charges for so say account maintenance.

It does sound like the 3% retention refund, and unfortunately delays of this length aren’t unheard of. That said, being ignored by the agent for months is a red flag. I’d suggest contacting the solicitor or gestor who handled the sale directly to confirm whether the refund claim was actually submitted and to request proof (modelo 211/210). If needed, a different gestor can usually take over the follow-up with the tax office and may also advise whether it’s worth closing the bank account and switching the refund to another payment method.

Thanks to all who have taken the time to respond to my post.  I have contacted the company who sold the house and who got my partner to sign the forms for claiming back the tax, they have now replied and said that they will actually contact a gestor to chase up what is happening, that was over a week ago, so watch this space. I will let you all know when, or if the refund is ever received.
