With regard to Bank Guarantees in theory Gal is right but it will not happen at present. Listening to others on the forums BG's have not been issued for a considerable time.
I was told by San Jose (Tomas) in Feb 2007 that the Bank Guarantee (BG) will be forwarded once the full deposit was paid - I am still waiting.
On the issue of Bank Guarantees San Jose (SJ) have continuously lied. They take no heed of the spanish legal requirement.
In brief, my interaction with SJ over BG's is as follows:
Feb 2007 – SJ – The BG will be sent in a few weeks.
Mar 2007 – SJ – It will be with you in 3-4 weekw.
May 2007 – Agent - San Jose have confirmed that your bank guarantee is now being processed and will be forwarded to you shortly.
May 2007 – SJ - They (BG) will be issued shortly
Jun 2007 – Agent – SJ state (BG) will be available on or before September 07
Sep 2007 – Solicitors - San Jose informed us that they are due to be receiving the final construction permit by the end of October 07.
26 Sep 07 – Javier (SJ) - I'm trying in obtaining precise details in order to give you further information (on BG issue) - still waiting...
With regard to the last item above referring to a PM by you, maybe an oversight but you did not respond.
In view that San Jose have failed to issue bank guarantees to me despite continual promises to do so, and that there is no likelihood of them being issued in the next few months I asked that all monies be returned to me excepting the securing deposit of Euro 3000 until such time as the guarantees are issued.
Unsurprisingly, despite several requests SJ have not responded in any form what so ever...
I would not accept a solicitors word that a BG is in place - especially if you purchased in July 07.
