Hi the best news about the pools was no closing for the siesta as that's the time when no one is there so you can have a swim bye Irene

I don't know how many of you are aware of the severity of the problem with the soil erosion adjacent to the pool area between blocks 6 & 7 but unless resolved fairly soon there may not be a pool at all by next summer.  Some of the small trees have already disappeared down the bank and the fence is only just holding on.  The showers will be next to go. Then who knows - block 7 or 8??

I know that David and the committee are on the case but not sure how many of the residents in other blocks were aware of the problem. (see pictures posted by Davmunster)  Could get very busy next year with only one pool to use!

The pool between blocks 8 & 10 is open all year round. We currently have a problem with a leak at the pool between blocks 6 & 7 but hopefully it will also be open for the main season.

A quick update on the gates. The owner of the gate in block 5 has been told they have to remove it. The owner of the gate in block 7 is more difficult. They are rarely there, are 1 of our problem debtors and no member of the committee or GICS has managed to speak to them.

Both pools are closed so far.
 
The owner of the block 5 has no obligation to remove his gate since phase I took ownership of the communal garden next to his garden. He has not made an opening to the pool as there is a (provisional) separation to phase II. If we claim that area the fence which is currently between block 5 and  should be moved. Afterwards he is entitled to his own gate to the communal garden just like others have.

If the owner of the gate in Block 7 cannot be contacted, and owes money for unpaid community fees, can we not go ahead and have the gate removed, and add it to his bill. Why should so many of us suffer because of them. Isn't it amazing that these people can find the money to put in a gate to access the pool area, but don't want to pay the money towards the running of it..

Hi if you want to have a swim just ask the staff to open the gate simple as that for  the pool at block 8 and 10 irene

 Hi Irene,

I wouldn't think it would be appropiate I start using the maintenance staff for personal requirements. For renters this wouldn't work anyway. They were promised a pool and they complain to us if it's closed. 

Besides I assume there is an official reason the pools are closed so opening up on demand can't be the solution.

Hi max i have been told the pool is open if the staff have forgot to open them just ask them to open the gate, and  David has already told you the pool is open ?why do you always have to upset owners and make them feel as if what the hell am i going out to before they visit. They have been getting the pools  ready for the summer and the pump for the pool by block 6 will soon be fixed as you no.bye irene

 Irene, I don't try to upset anyone. The simple fact is that the pools are closed. Not because someone forget to open them, but there is a sign that they are closed for maintenance. David has posted a long time ago that he would assure pool(s) were open but the fact of the matter is that they both have been closed for months except for two weeks round Easter when one was open.  

You don't have renters so you don't care if you're not here. We however have clients who want to let out their apartment. They (and sometimes we) market these apartments as having at least one pool open. You don't realize how difficult it is to explain that in fact they are closed. We had to give one couple a partial refund because they were right in their claim that no pool was available. This hurts people in their wallets (and no in this case we didn't suffer, but the owner did).

It's not a light matter but a serious issue as one of the selling points of Don Juan is that we have at least one pool open around the year. People advertise it and then discover that potential buyers or actual renters see for themselves that it's not true.

Hi max how dare you say i don't care i am not there and i don't have renters at don Juan i care a lot about what is going on at don Juan and always will care.I had a e/mail to say the pool is open and that the pool at block 6 will be repaired soon and i believe that to be true and David has already told you they are opening the pools.Last year when you where V/president the pools where full of algae and not maintained properly and we had no license no wounder the state they where in  or don't you remember all the algae i do so if they are closed for maintenance then that is what has to be done for safety even hotels have to close there pools sometimes bye Irene

May be those  owners who are renting out their apartments with the promise that one pool will be open need to re-consider the terms of their offer - the problems with all the pools on the development is longstanding public knowldege.  Of course we all want the pools to be open for use but if there are genuine reasons, such as a faulty pump etc , then the pool cannot be opened.  I accept that it is business for some owners -  they have to make refunds if asked when they offer something they cannot fulfill, regardless of what caused the failure, and this would apply to any business.

Last summer Max closed the pool by block 8 for part of a day, and sometimes for days, where the notice said ' for  safety reasons'.  I don't remember any of the owners demanding refunds of their community fees because the pool was closed! Would those owners who let out their apartments now be asking for their community fees back due to the lack of a pool? I think not and remember it is OUR community and not the renters. Owners who rent their apartments out are no different to other owners, so why make a case as if they deserve preferential treatment?

We all have an interest in our development and it is offensive to state that non-resident owners don't care. We do care but we simply don't make a fuss of every time something is not to our personal liking/agenda.

Irene, you say 'I had a e/mail to say the pool is open''. But everone here can see that that this is not true. Like I said one was open for about two weeks. That's all.

I don't remember the algae; maybe that was before we got the license. I have always been against opening pools without a license but I was repeatedly outvoted in the committee. The risk of a huge fine has always been worrying me.

For some reason a few people want to discuss last year in every topic. I live in 2009 and seek a proper explanation to give to the people who ask me.

The main pool between blocks 8 & 10 is open and useable.

The childen's pool was closed due to some loose tiles. These were fixed but we now have a problem with the chlorine dispenser. It is probably not a major problem but it is currently out of use.

The pool between blocks 6 & 7 is closed. There is a fault with the filter which we plan to fix shortly. There is also a leak which we think is from the pipes between the pool and the pump room. We hope to have this fixed during May so all pools we will safe and open from the beginning of June.

 Sorry David,

Have a look yourself as the main pool (between bl. 8 and 10has been locked for some time. Even today it was still closed with a padlock and a sign stating that it was closed. Maybe it opens tomorrow, but that doesn't change the past. 

We would never have agreed to a discount to renters if their claim was not right.
