Has anyone who transferred to OTCC started legal action or other ways of recovering their deposits and if so is there any positive or encouraging outcome? I recall in one of the earlier threads for this development a couple had engaged a solicitor to act for them but they did not update the forum as to how it progressed. The big worry is always that you pay the solicitor 5 - 7 K to sucesfully sue Huma but never get the refund from them.

One thing in all this is that Spanish properties now appear to be that cheap that you can now buy at 40% less than ACC prices so would not be any worse off by buying and writing off the ACC deposit.

Hi Truff

We started an action against Huma in November 2009. To start proceedings it cost 1500 euro. This was to produce a letter to Huma saying we wanted to cancel the contract and have our money back. Huma nor the original Solicitor responeded. As it was around the time that OCC ceased building, I didnt think it worth continuing on as it would have cost at least another 6k to take them to court, and wanted to wait until confirmation of a restart before parting with any more money. As it turns out, building never restarted.

I had a phone call yesterday from a Jose Garcia from Huma, offering me an alternative apartment, He also stated that Huma have no money, and cannot offer anyone a refund. ( We declined his offer)

I shall wait a little longer, but will probably persue the banks for non issue of BGs, as I never had one for ACC or OCC. Like you say, we have now bought elsewhere, very cheaply, in a far superior location almost on the beach close to Gibraltar.

Transferred to OCCT  and nothing forthcoming for 18 months. Paid Solicitors €2500 and have been to court - found in our favour ( six months ago.) However HUMA Indalo are now appealing. We await result from that.

We have not been offerred another property.

I still have hope that in the future we will get some deposit back...........No BG though.

I don't want the property now - it's too expensive.

We had the same person call us  and offer some breeze block shed in Alicante (sorry - no offence to anyone living in Alicante).

I'm sure (given the Spanish record) that it would all have been totally legalised with all licences !!!

He was sent off  - let's say -  with more than a flee in his ear.....

They really need to get their act together over there don;t they............................

Hi all,

First post but been following for years as I to am caught up in this mess also!

With regard to the offer to move to a built property in Alicante, apart from the obvious that we are still paying over the odds, what other reasons are you guys declining for. My thinking is if the OCC development was actually ready today, we would still be paying over the odds as I don't see how you cannot complete on the property, as you are not going to get a refund as they have no money, so therefore in my mind, bankrupt! I can see over the next year or so this being official, and despite the guys who have won in court, if there is not money to return, and like me you only have a bank guarantee from Almanzora which is usless, you loose the lot.

I have been offered something at 74k Euros which they claim to be worth £115k Euros. I think 90k Euros valuation is nearer, but at least its a discount rather than loose the lot, and definately in a better location than Thanernas.

Apart from that fact no one wants anything to do with this bunch of crooks, I believe we would be buying from the bank, not the builder therefore not giving them any money, but the hard bit to swallow is letting them off the hook with the money they already have.

I really cant decide what to do as I worry mostly about the location of Thabernas and loosing all the money. I would welcome to hear reasons people are deciding against this to help me make a decision.

Hi all, has anyone had any success or dealing with Michael Davies spanish solicitor, he has contacted us in regards to retrieving our 60k from Huma, we transferred to OTCC from ACC in 2008. We have not taken Huma to court as yet, don't know what to do for the best, does anyone know of a good spanish solicitor who has suceeded in getting payments back with BG's for 2/3rds, as far as we know we didn't get a BG for our third payment.

we use m davies, he has handled our case, if you have no bank gaurantees you will win the case agianst Huma (THEY WONT EVEN DEFEND) the court will tell you that Huma are in breach, then nothing will happen, the court wont force Huma to pay, you will have to pay a lawer to find an asset Huma have with no loans against it ( god knows were) then get the asset into your name and put it up for auction,  if you do this and Huma think the asset is worth more than they owe you, they may payout, this gamble will cost you another 5000\7000e with no gaurantee!!!  remember every one of us have won our cases, none have had money returned, this is a third world legal system.

First we had Huma Med, then we got Huma Ind, and I seem to remember someone saying they are still selling but under yet another trading name. Does anyone out there know this to be fact or fiction, because if it is fact then we should all do our upmost to contact newspapers, radio, television both in England and in Spain. We should hound these people from every form of media, if anyone knows the email address of the Huma directors then let us have it. Lets face it, we are never going o get our money back, so why don't we make their lives hell, lets attack them from all angles, every hour of evry day. Lets make them regret the day they conned the Brits. If anyone has any information then let us have it, please
