i have today received an e-mail from my lawyer stating they have sent several beuro faxes, tlf. calls to huma regards the legality of certain aspects of o.c.c. but huma have not answered a single one, they even go as far as to tell me they have had no requests from my lawyer, faxes, tlf. calls included, this i know is a downright lie!!!!!  i personally feel this is another acc scenario and am not willing to go down that route again, so those of you thinking of signing, think again, and make sure you have a good lawyer!!

Note what you say ....but quite a few lawyers are quite happy...and if you get a translation of the permit  PDF Huma give you...I think you will find that it is not as bad as you think it is!!!!

With ACC everyone ended up in the s..t! so it does stretch one's imagination that the Huma owners and their banks have set up OTCC as another 'con'

for me as a no BG on ACC it is a pragmatic and nice way out....as it turns out I like the location........but not everyone is the same......a personal decision for everyone

What is your situation?

Do you have an ACC BG?
Have you paid the 40% deposit

If you have a ACC BG...then good luck.....quite a few with a  ACC BG   have changed to OTCC...why?

Well, first they quite like the location 'el campo' and medium to long term at 2005 prices they have to be a good buy

Lets just look a touch in to the future........late 2009 a Tarifa at 116/119.000 €..............2012 development completed.....EU economy now moving again......do you think that in 2012 that you will be able to buy a 2 bed 1 bath semi anywhere in EU for 116/119.00 €......even at todays rate of 1.26 it is £62,063

So, slag OTCC if you want, but lets hear what your position is!!!

i am not slagging otcc, i am just saying that huma are not sending the certificate that says the development is classified as urban, you may have a vested interest being an agent, i am just an ordinary purchaser that has been bitten before, so when my lawyer requests these all important documents and huma ignore his request, then obviously i become suspicious and feel i should pass this info to other would be purchasers, they of course can act on this as they see fit, but you being an agent naturally go against this information, enough people have been ripped off in the past without you jumping on the bandwagon looking to make a profit at other peoples expense.
anyway. i am expecting an e-mail from huma on monday after certain issues have been put foreward to the director, anybody interested in a copy of the e-mail just pm me.

First .......... I am a buyer like all the others who did not have a BG and had money [ 40% deposit] at risk at ACC

Changing to OTCC had nothing to do with being an agent......but perhaps my long experience in property influenced my decision that it was the best way to protect my 53.000 €

Not ideal....ACC being built would perhaps have been that.....but that was not an option after the Feb decsion this year

Everyone must make their decision.....but where money is concerned I like to be pragmatic!

We received our contract last week and it has been sent to our Solicitors to check over.  

We are in a different position from alot of people with full guarantees for all money sent for ACC however have decided to change to OCC with the option of changing back if any word comes on ACC before completion.

Ours Solicitors have advised us NOT TO SIGN the contract as the contract gives HUMA the right to cancel the Bank Guarantee and provide us with a new one as soon as possible.  Our Solicitor wants to see new guarantee before handing over existing. Our Solicitor still has to look into contract however we were advised this immediately the contract was received by them.

Beware & make sure your Solictors checks everything before signing.

After the Feb decision Huma sent letters to it's clients offering alternatives. If they were a decent company one of those choices should have been a full refund with interest. I for one will never do business with Huma again at any price.

I asked back in April if anyone had BG for OTCC and no one replied to say they had.

Surely people like Rowlandsbb the agent will have them by now ?

After all, HUMA said they would issue them !!!!

forget about rowlandsbb, listen to your lawyers, after all it seems that every independent lawyer is giving the same advise, DO NOT SIGN!!!  so rowlandsbb, keep your proffesional advice to yourself and let the prospective buyers take advice from their legal representatives, after all, this is what they are paying their hard earned money for!!!

Sound advice from jethro which ALL prospective buyers should take notice of.

Please do so as having this nightmare with you day in day out is not nice.

Independent lawyers are the way forward.......Not agents on a free to post website.

huma today have received a letter from almeria town hall promising the land will be classified urban, my lawyer will hopefully receive a copy tomorrow so i am awaiting his reply, huma have also sent me up to date photos of the site with the different manzanas marked off and some good pictures of the show houses, looks quite smart, i will post the reply from the lawyer when he receives a copy of the letter from almeria.

Sorry, I dont quite accept a letter from the Town Hall promising the land will be made urban. Either they write and say it is being considered and the result of this consideration will be on whatever date

Or...They have considered it and the result is that it will be classed as urban with effect from whatever date.

Or ...They have considered it and it will not be classed as urban.

 Are HUMA building on land which is not classed as urban ?

We had the same thing over a year ago from Huma in a glossy brochure with a letter from Cuevas del almanzora town hall saying ACC land was classed as urban. 

We all know whats happened since

difference being in this case they are the same political party, so maybe, just maybe it will be legal, lets wait and see, in the meantime their will be some terrific bargains to be had as the economy worsens in spain.

today my lawyer has received proof of payment to the town hall for the amount of 28.687.25 euros.
copy of the search of the plot to build 32 houses with a mortgage in favour of bancaja for the sum of 319.200 euros
huma are requesting a big mortgage to finance the construction of tabernas, and my lawyer has requested information regards said loan.
he has also received a copy of the insurance policy to cover deposits paid for purchasers on oasis for a total amount of 1.400.000 euros plus 156.234.95 euros for interests.

my lawyer has also told pedro velera that once i sign the contract a guarantee for the amount piad in almanzora will be issued.

he is now awaiting draft for both reserve and purchase contract

Just A Question.

If Huma have requested a mortgage to build on OTCC surely the bank owns the land.

You purchase a house possibly one of the 32 and then Huma go bust ...as there are not enough buyers what happens then?

Do YOU actualy own your house or does the BANK. What happens to the remainder especially if they go bust and there is no electric,water, drainage.

YES there are bargains to be had in Spain so WHY buy here...You have a bg so walk away.

i have not signed anything yet ran, i am just following the progress of the development but looking and waiting for prices to come down further, which i am sure they will, but at the same time how many properties on the market are actually legal, including resales???

have today received e-mail from plazas abogados, everything is now fully legal with oasis, but we have decided to execute our bank guarantee as we do not trust huma to fulfill their promise regards amenities, plus how long will it take to complete the site with the state of the construction industry now! there will be a lot of bargains to be had in spain in the near future so we will explore and attempt to purchase in an area of our choice, another deciding factor was that huma would not offer any compensation for the time and money we have wasted with acc.  good luck to all that are continuing, i know that there are many that have no choice!!
