Media Update page on SARC website

Hi All,

There has recently been a lot of media activity that is of interest to purchasers, so we have therefore had a page on our website set up to load links to news website stories & also to load scanned news articles. We will be sending news items/links direct to the SARC members but will also place them on the news website page for all to see as soon as we possibly can.

Hi Tony,

Any chance you could rely on my posting re Almudena's explaination as to why we were not issued with bank guarantees as per Spanish Law and where our deposit monies went.

Hi Arlene,

If you want to ask me a direct question, I suggest that you email the SARC email account .As for your comment regarding BG's it is not for I nor any one else other than HdT to answer that question, which they did at the UK meetings. I also wonder why you feel the need to post such a question on a thread purely about setting up a page where any news items will be made available?

Not all of us were able to attend one of the meetings in the UK held by HDT. So can you please tell us what the answer was from them why we never had BG issued and where the money went, I think I like you paid my deposit in 2005.

Hi Ian,

I am not being awkward but it is not for the purchaser group to answer a question on behalf of HdT & we would not do so. If you wish I am willing to add that to the list of questions that I am taking to the next meeting. I could ask that for those who could not of did not attend the meetings that HdT provide an explanation but  neither I or anyone in SARC will or would provide one for them & nor should we.

If Almudena answered the question Re: BG's and where the deposits went at the meetings, why can you not pass that information on?

 Here here!  Surely it's merely reporting back on what was said at the meeting, not making up a reply on their behalf!

We could not attend the meetings either as we live in the far north of Scotland and there were no meetings near us.   If so many people were at the meetings can someone please tell us what was said at the meetings re BGs and where our money went.  Is it a secret. I just would like to know the basic facts.

I have to say that I am disappointed but not suprised by your post. Like many others we are caught in a mess not of our making, we took all the advice we were given but have been let down by a dishonest decitful company who broke the laws of their country with impunity,who knew how to play the system aqnd are still playing the legal system, and then let down again by the judge/administrators who appears at least sympathetic to their cause.

I am not asking for a formal statement from either SARC or for you to make a statement on behalf of Almudena/HDT though it hasn't stopped you in the past when it was to Almudena/HDT advantage.In fact Tony you have been their champion from day one and have never to my knowledge criticised them in any way. Unlike yourself I have had  many emotions regarding both Almudena/HDT but as I said in original posting I am/was willing to stand corrected depending on the reasons for the bank guarantees not being issued and the reasons why our deposit monies were not placed in a seperate client account as per SPANISH LAW.

I ask merely as one person to another as for various reasons I was unable to attend any of the meetings but since you did attend and then made the posting on an open forum that those that did attend had ask the same questions and received answers. I was under the impression that was one of this forums aims which was to share information good and bad.

As I said in my original posting asking you direct and which you failed to respond, which is why I then ask on another thread the same question.

It looks to me and this is only my opinion that the explaination that was provided by Almudena/HDT does not stand scrutiny which is why you do not answer.

When I received an email from San Jose saying that they had over 505 of the vote and it was just waiting for verification from the courts/administrators, i replied to the email asking that same question will they now be giving Bank Guarantees. 

Their answer was they were unable to announce a decision with regard to bank guarantees.

                    If you could so kindly make a formal request via the sarc email address which you can find on our website we will ask them the questions that you have we will either pass them  on to the company or ask them personally on you behalf and their responce either sent back directly to you from them or by us via email forwarding if you wish..

             We have never made a statement for the company only given their responces from our members questions we are totally independant and have to keep it that way and our opinions as to the situation throught the 2 1/2 years since we started SARC.

as for your last comment I find it strange that ask for help on this, then condem us for fighting for our properties in the next.

what has happened in the past with HdT is not the issue. what is about to happen is and we at SARC will be keeping a very close eye on the ball and trying to ensure that the members / purchasers are listened to and informed as we have done since starting

you could also try some of these options if you wish

1) email the company directly and ask

2) or the bank which you transfered your funds into as it was the recieveing bank that should have issue the BG's

3) or why your legal advisor did not advice you not to transfer untill he had the BG's for you

You wont get Tony to answer any pertinant questions. You will get plenty of hot air re HdT and the wonderful way they are trying to stay in business and con us for the next 5 years. This forum is full of questions addressed to Tony, he is selective in what ones he replies to and those are the ones he can put the HdT spin on. So don`t hold your breath waiting on the BG/Deposit answers. Cheers Joanniemac

Yea and when tony dont want to answer brainmags pops up and asks more questions. plenty of questions no answers from sarc but if i email sarc direct they will ask hdt to repond. luntatics running the asylum.

Tony, if you truly believe it is not for you to pass on any information that you have heard from Almudena then why exactly are you on this forum in the 1st place. Why don't you stick with the SARC website Q + A only. You obviously do not want to help any non SARC members. I thought this forum was to share any information with fellow creditors wether they wanted there money back or their house. I personally would shout from the rooftops any information I could get hold of, that is if Almudena would reply to my emails and actually answer my questions  I could not go to a uk meeting, i have gone back to work full time now because of our financial situation due the this mess and in the spare time i do have we have to look after my husbands mother who is very ill.

Arlene's question is a perfectly reasonable question and one that many of us want answering and we have tried to get that answer one way or another and have failed.  If you know the answer and you indeed do wish everyone "All the Best" then why are you being so defensive. Like Jo and Jez posted it is just reporting back, you are not telliing tales!! When you go with your list of questions once again. will you please ask them to reply to their emails then maybe we will all have the answers.

As for Brian you couldn't be more WRONG you say the past is not the issue with HDT are you joking. We are all in this mess because of their past illegal actions it is indeed THE ISSUE do you expect me to lose 90,000.00 euros and just forget about HDT's past actions. You are completely bonkers!!

I hope you and everyone else that wants their house gets it. I hope you enjoy your compensation that you have been promised because it is probably coming out of my pocket. (35%)

                   I have come on asked you to email the questions you want answered i can not do more than that is that not what you asked of SARC we do it voia email request so that we have a history trail of what is actually said and not messed about as can be on a forum .

as for Crafty sorrey about you lossing 35% but better than 100% I and tony are also in same position as all of us without BGs if the company had been liquidated the we would have lost all.

If the information re: BG's and 'where the deposits went', was disclosed at the meetings held by Almudena in England it is in the public domain.  So why are you and Tony making such a meal of letting people know the answers to these questions?

Are people being punished for not turning up at the meeting?  Surely not..... that would be a little infantile.

If there is anyone else out there that went to the meetings and can anser Arlene's question, please do so, it really would be nice to know the answer.

I received the information below in response to an email I sent today to Herrada del Tollo.

"About your question concerning Bank Guarantees please note that the company got a credit line when we started to sell properties in Santa Ana, but there was a big amount of properties sold in an unexpected short period of time and the credit line was used up soon and an extension of the credit line or a new one was requested. But due to the growing number of requests from many builders to get credit bank guarantee lines (while since then this had not been a common-practice) the banks started to process the opening of new lines very slowly and that prevented us to having enough time to provide many of our clients with a bank guarantee.

The company is currently negotiating the financing of the building of Santa Ana del Monte  and this includes setting up bank guarantee lines  for those who continue with their purchase. But now we need to wait for the confirmation from the Court of the final count of votes in order to move forward with the Feasibility Plan and the Financing as well."
