La sentencia sobre la macrourbanización abrió un agrio debate en Hellín

La segunda sesión plenaria del año del Ayuntamiento hellinero se alargó tres horas y media.

El tema de mayor duración (una hora y quince minutos), fue la sentencia del TSJ, sobre la resolución del complejo Las Higuericas.

El alcalde ordenó al secretario que diera cuenta del contenido de la resolución, que da la razón -dijo- al Ayuntamiento y que declara sujetas a la legalidad las obras de urbanización y las licencias de las primeras 105 viviendas. La sentencia -insistió el alcalde-, declara la legalidad absoluta del proyecto.


El concejal socialista Ramón García acusó al Partido Popular de la situación económica del Ayuntamiento a consecuencia de este proyecto, por cuya paralización ha dejado de ingresar -indicó- 12 millones de Euros. García acusó a los populares de causar el fracaso de esta macrourbanización, y de haber metido Hellín en el mapa nacional de la corrupción con «burdas mentiras y patrañas».


Acusó igualmente a los populares de judicializar la vida política con denuncias que finalmente pierden. El alcalde reiteró que los tribunales han dado la razón a personas comprometidas con Hellín y han dejado claras las cosas. Rosa Pilar Sáez, del PP, aseguró que se había pasado de «dar cuenta» a insultar a su partido, haciéndolo «con un discurso que se ha traído escrito, por un hecho que denunciamos para proteger el medio ambiente de nuestro municipio».


El portavoz
del PP Antonio Callejas acusó al alcalde y a Ramón García de decir verdades a medias sobre la sentencia, y recordó que la vía penal no la abrió el PP, sino un grupo ecologista.


Callejas indicó que hace más de cinco años de planteó la posible ilegalidad de la urbanización que se pretendía hacer: «la denuncia que pusimos la hicimos por los intereses de Hellín y lo volveríamos a hacer; abrimos la vía contencioso administrativa, no la penal
como usted ha querido hacer ver».


El concejal
del PP matizaba que «la obra no la paró ni el juzgado ni los concejales del PP. La paró el 19 de febrero del 2009 una empresa insolvente que está en busca y captura. La están buscando los trabajadores, los contratistas, Dragados, el banco».

«No es la empresa -añadió- un modelo empresarial; paró por insolvencia manifiesta y porque ha quebrado el modelo de urbanismo salvaje que en este Ayuntamiento se ha potenciado». Preguntaba si el PP también tiene la culpa de que haya fracaso el proyecto de las Dehesillas que también debe al Ayuntamiento nueve millones de Euros.

 

El concejal de IU Francisco Javier Morcillo, sobre el punto dijo que en otras ocasiones en los puntos de dar cuenta no se permitió debatir. Tras indicar que respeta la sentencia, aclaró que «se tienen que aclarar algunas cosas, como que se diga por que el Ayuntamiento ha perdido 12 millones de Euros. La promotora Cleyton Ges -añadió- paró las obras porque dijo que la urbanización no era viable por la situación de crisis en estos momentos».


Muchas deudas

Añadió Morcillo que la promotora tenía un alto riesgo, y un capital social de solo tres mil Euros: «nos preocupaba y nos preocupa que en estos momentos está en paradero desconocido; y los pintores, carpinteros, albañiles y otras muchas empresas que le trabajaron están sin cobrar, porque fueron despedidos antes de paralizar las obras».

 

Se preguntó «que opina la promotora de la sentencia, porque la empresa nunca dio la cara y tiene grandes deudas con los trabajadores. Es importante -apostillaba el concejal de IU- saber si es verdad que al Ayuntamiento le debe 12 millones para que se pueda ejecutar».

Tras el largo debate, se trataron otros asuntos, como adjudicación de parcelas en el Polígono La Fuente, solicitud de prórroga por cinco meses de la urbanización Tenerías, o condiciones para adjudicar un quiosco en calle Juan Ramón Jiménez.

 

 

 


Las Higuericas still bubbling

The opposition reiterates that the work was not stopped due to any court decision, but due to the ruinous management of a company "who is wanted for arrest and capture"

The sentence on the macrourbanización has opened a bitter debate in Hellin.
 

The second plenary session of the year the Hellin City Council lasted three and half hours.
 

The reason of a longer duration (one hour and fifteen minutes) was the ruling of the Supreme Court, on the resolution of Las Higuericas.
 

The mayor ordered the clerk to give regard to the content of the resolution, which states, "he said at City Hall and declared under the law are urbanization and licensing of the first 105 homes. The sentence, "said the mayor, declared the absolute legality of the project.
 

Councilman Ramon Garcia accused the Socialist People's Party of causing the economic situation of the City Council as a result of this project, whose suspension has cost 12 million Euros.
Garcia accused the popular party of the failure of the macrourbanización, and having put on the Hellin on the national map of corruption with "gross lies and fabrications".

He also accused the popular justice the political life of allegations that eventually lost. The mayor reiterated that the courts have proved right people engaged in Hellin and have made things clear. Rosa Pilar Saez, of the PP said that he had spent time "giving account" to insult his party, making it "with a speech that brought writing, a fact denounced for protecting the environment of our town.

PP spokesman accused the mayor Antonio Callejas and Ramon Garcia of saying half-truths about the sentence, and recalled that the criminal proceedings were not started by the PP, but by an environmental group.
 

Callejas said for more than five years they raised the possible illegality of urbanization that was intended to do: "We made the complaint for the interests of Hellin and would do it again, through the administrative and not criminal like you wanted to see."

The PP councillor said that the project was not stopped by the court or the council of the PP. It was stopped on February 19, 2009 due to an insolvent company who is being searched for and is wanted for capture. The company is being searched for by workers, contractors, Dragados and the bank".
 

"It is not a company," but a business model, which has been stopped for manifest insolvency and has broken the model because of rampant urbanization in this municipality. It was also asked whether the PP is to blame for the failure of the Dehesilla draft which has cost the City Council nine million Euros.
 

IU Councilman Francisco Javier Morcillo, on the point said that at other times to report items not allowed to discuss. Noting that respects the ruling, said that "you have to clarify some things, like to be told that the City has lost 12 million Euros.  He added that the promoter, Cleyton GES stopped work because they said that urbanization was not feasible in the current economic climate".

Many debts
Morcillo added that the promoter was a high risk company, and had a capital of only 3,000 Euros.  We are concerned that at this time Cleyton GES is unaccounted for, and the painters, carpenters, masons and many other companies have worked without pay, even though they were dismissed prior to paralyzing of the project.

He wondered "who believes the promoter, Cleyton GES, because the company has never shown its face and has large debts to workers. It is important, the IU Councilman said, whether it is true that the Town Hall is owed 12 million Euros, so that it can execute the debt.

Otro apartado del boletín de IU recuerda la situación en la que se encuentra el complejo urbanístico Las Higuericas, diciendo que «veníamos denunciando la barbaridad que suponía el proyecto, así como las consecuencias medioambientales por el daño imposible de reparar que causaba sobre un lugar de singular interés ecológico».

Añaden que «desde que la empresa Cleyton Ges llegara a Hellín repartiendo dinero a distintas asociaciones en un claro acto de compra de voluntades, ha contando con el apoyo incondicional de las administraciones, tanto regional como municipal, hasta el punto de aprobar el proyecto sin el estudio de impacto medioambiental como es preceptivo en una zona de la Red Natura 2000».

Morcillo recordó que la promotora Cleyton Ges anunció a los compradores que abandona definitivamente el proyecto por considerarlo financieramente inviable.

Another section of the IU newsletter mentions the situation of the housing development Las Higuericas, it says that "they condemn the barbarity in which the project was involved and the environmental consequences which have caused damage which is impossible to repair in a place of unique
ecological interest”

They add that "during the time the promoter Cleyton GES was in Hellin it was distributing money to various associations in a clear act of buying votes as it had to count on the unconditional support of the administrations, both regional and municipal, to the point of approving the project without the environmental impact assessment which is mandatory in an area of the Natura 2000 network.

Morcillo recalled that the promoter Cleyton GES announced to buyers that it had abandoned the project as financially unviable.

Hello Keith,

Thankyou for keeping the site well informed.

Its interesting to note that the staff of Cleyton Ges are listed as missing, im sure they are not really missing.

I hope your campaign is going well, have you had any recent feedback from the 'missing' staff or AHG himself?

I agree with the statement in one of the report's regarding: 'promoter was a high risk company and had a capital of only 3,000 Euros'

As some people are aware, there were previous companies called Fincaexpert & promociones Astante that had quite a connection with Cleyton Ges, infact most of the staff and director's were the same.

The following is just to summarise our situation regarding involvement's with 'high risk companies' as stated in the press article. We do share a common 'problem' - the same 'missing' people:

I belong to a community that was mentioned on this forum some time ago, it was called Finca Azafran - it's now known as Finca los Mazones. It was built/promoted prior to Fincaparcs by mostly  the same group of people you are involved with. In 2008 we found out the true extent of the problem regarding our homes and the estate in general. The following are some problems we have to tackle in regard's to legalising our homes here - at this point I will say we have legal representation that can confirm the state of the problem:

1. Built without planning permissions.

2. No building licences.

3. Built on citrus irrigation rustic land.

4. Not on the town plan PGOU.

5. The developer never re-registered the land from the previous land owner.

6. Land not sub-divided into individual plots, we own a part of the general site as a percentage.

7. Innacurate title deeds/escritura's.

8. Currently not on the Catastral register individualy and cannot get an individual SUMA registration.

9. Electric supply 'irregular' - 1 main Iberdrola meter shared between 20 homes.

10. Outstanding €40k dept owed to electric contractor who want's us to pay  the developer's bill's.

11. No mains water - on deposit tanks reliant on the 'irregular' electric supply to pump.

12. Cess-pitt's were in place instead of septic tanks, €4-5k cost's to renew in accordance with EU regulations.

13. Road unfinished, no tarmac, paths, streetlighting etc.

14. Site single lane access not the legal minimum road width.

15. Unfinished communal 'green' area's.

16. No previous architect's plans available for the site.

17. No habitation certificate's.

That's what we know about so far. No 5 above caused some recent problems, the developer never re-registered the land (this indicates to us that he probably never had any intention of doing the build legally from the start) and the farmer was believed to be paying the land taxes for quite some time, until he gave up on trying to communicate or get reimbursed from the builder's company in question - the electric supply permit was in his name also - although the residents have always paid the bill's, so he decided to inform Iberdrola to cut the supply to the site, presumably he didnt want to be connected to an illegal urbanisation anymore. We have since paid to have it re-connected.

Also we are led to believe there is some back bill's to clear on the land tax that the builder's company should have paid - or transferred into our names.

Now, to be clear about this, we had all paid our deposits and were all co-erced into moving in under false pretence's - we were told we were only waiting for the habitation certificate which was waiting for the company to finish the infrastructure.....sound's similar doesnt it?!!  (We were fooled, we were not fools - we did not buy illegal homes, we were sold illegal homes).

So, what is the way forward for us here?

Well, we are at the mercy of the Town hall - we hope they 'regularise' the site and houses in the next PGOU - whenever that may be.

Costs estimated to be around €20-30k per house to complete the infrastructure. Obviously this all wasnt mentioned at the point of sale!!!!!!!!!!!!! no.....what was mentioned was that the houses were legal, above board and would be completed to a 'showcase' standard....hmmmmm....

Anyway, we will progress, probably very slowly...over many years. Some may never see that day but we will press on regardless.

We hope the F.P.A.G are succesfull in getting their deposit's returned - succesfull in 'finding' the 'missing'

If there is any mileage in 'group' exchange's of information then we would be pleased to assist where possible.

Justice will prevail.

I wish to confirm that all written below by pjd regarding the unfinished building site known as Finca Los Mazones is true and correct.

Apart from the illegal houses on that delelopment, there are many many more dotted around this area, mainly at Catral.  They are all illegal , unfinished and going to cost many thousands of euros each property to reach the standard required

What has this to do with Fincaparcs? We were duped by the same crowd as you were. Shame on Finca Expert and their staff.  Shame on Spain for doing nothing to protect us and allowing this to happen and stealing many peoples life savings, and for ending our dreams.

We tried to warn you many times  but were accused then of hijacking your forum.  How do you feel now????

In addition to my last post I would like to add that the builder/developer Finca Expert sl charged at least 28,000 euros over the advertised selling price, explaining that this was for the fantastic infrastructure that we were going to enjoy, such as a large ornamental lake (a disused reservoir filled with weeds and builders rubble), a club house for residents with tennis court etc. (rebuilt and sold), a large communal pool (encompassed in another plot and sold).etc etc!!!!.  This was to be the promoters "dream" development (our nightmare, in fact).  28,000 euros per house equals 560.000 euros conned from us on a bloody tissue of lies.  Sleep well at night, do you, Mr builder?

Thanks for the support and encouragement for our efforts at
the FINCA PARCS ACTION GROUP.

Sam, in your posting you say:

I imagine that this comment and question was directed to some of those people who posted on this forum in 2007, 2008 and 2009, who buried their heads in the sand and would not listen to the warnings posted by yourself, Pete and others who had experienced at first hand the true horrors of the 'Finca' scandal.  During that time Cleyton GES SL / Finca Parcs were desperate to stop clients linking the activities of Finca Expert SL, Promociones Astante SL, Classical Invest 2002 SL and Cleyton GES SL.  Very unfairly, in my opinion, your postings during that period were removed by Eye on Spain, almost certainly at the request of Cleyton GES SL.

As Pete knows I did listen to your warnings and began to act on them.  Cleyton GES SL / Finca Parcs proudly boasted on their website about their land portfolio of 2,400 dwellings, however each time I asked to be shown some of their previous work my request fell on deaf ears.  Today it is clear why they were unable or should that read unwilling, to show their previous work.

It is now clear beyond any reasonable doubt that despite their denials, Finca Expert SL and Cleyton GES SL are absolutely linked.  Many of the same individuals have been Administrators of both companies.   In fact is was Finca Expert SL who back in 2003/4 published advertising material giving details of their new project 'Las Higuericas' - 'on the route of Hannibal' - see below.  Furthermore there are a number of Finca Parcs purchasers who only ended up purchasing on Finca Parcs because they had originally reserved with Finca Expert SL at Sax or San Isidro.  When their plot at Sax or San Isidro did not get built, they did not have their deposits returned, nor could they execute a Bank Guarantee - because again there were not any issued (despite CAM Bank guarantees being promised in the sales literature) - but instead their deposits were transferred to plots at Finca Parcs, with the promise of Bank Guarantees.  However, we know from members in the FINCA PARCS ACTION GROUP that not all those purchasers got Bank Guarantees at Finca Parcs, despite being promised them.

I have been to Finca Azafran / Finca Los Mazones and also to other developments constructed by Finca Expert SL to see for myself the exact situation.  I know that Pete is leading the action at Finca Azafran and has done a huge amount of work on behalf of all the residents there and I hope they are all supporting him in his endeavours.  The list in Petes posting below of 17 major problems at Finca Azafran as identified by his legal team is shocking.  Item 10 is interesting because as I mentioned above, Cleyton GES SL were adamant that they had no connection with Finca Expert SL.  However, the €40k debt to the electrical contractor is for work at Finca Azafran which is without doubt a Finca Expert SL development, so it is very strange that the contractor invoiced this work to Cleyton GES SL...........a company who for years we were told had no connection to Finca Expert SL.

I imagine the dream you were all sold at Finca Azafran / Finca Los Mazones went something like this:

The above statements were taken from sales literature produced by Finca Expert SL.  The company who for years they tried to make us believe had no connection to Cleyton GES SL....................

Over the past 8 years Finca Expert SL and Cleyton GES SL have been responsible for lots of irregularities, broken promises and certainly illegal activity with regards to the lack of Bank Guarantees at Finca Parcs.  We have been very patient over the past 3 years and none of us wanted to be forced into this position of having to take civil and criminal action against all those involved.  But what choice do we have?  For the last few months we have supported the Finca Parcs Refunds Process by submitting our data as requested with the promise that our deposits would be refunded in full with legal interest.  The Finca Parcs Refunds Process was launched on 21 September 2009 and as of today, 5 months later, we still do not have any tangible evidence to suggest that any of the promises will be fulfilled.

Thanks for your reply, very interesting points made within, firstly your comment:

May I add that we were also under pressure within our community from one particular female who 'spammed' most of the posting's with the intention of their removal, so not just down to EoS....one day she will have the guts to tell me why.

Yes, the €40+ thousand euro's invoiced for the outstanding electric work to provide a safe supply (that had already been paid for) was invoiced to Cleyton GES, from a local electrical firm. No doubt then about the link between Los Mazones and Fincaparcs as far as companies go. The parasite electrician wants us to pay that bill and has threatened us (aided by Daran  - who threatened putting a woman and her children in darkness  - there is utter conclusive proof available from the recipients of the threat).

All the while over the last 6 year's the staff at Cleyton GES hid our unfinished illegal development from the clients of Fincaparcs, feeding us with mis-truth's and delay tactic's, aided and abetted by so called friends & neighbours - shame on you all.
