Nice to see that the Corvera Owners Private Forum is now only open to the people that are taking action against Calidona and trying to get their money back through the Legal Action Group and never intend to become an owner.

Genuine Owners or would be owners will no longer be able to get access to said forum.

I'm sure however you will join me in wishing them well in their plight.

Thank goodness for EyeOnSpain.

Dare I ask why there is a Corvera Legal Action Group?

Presuming they are sueing someone for something but what is it?

 Hi,

Steve (Lifestyler) - yup, you are right; thank god for Eye on Spain. It became obvious that the interests of those taking legal action and those completing were not mutual. A poll was taken among legal group members and the decision made to go our separate ways. A sorry state of affairs but necessary. As MarcoPolo states you can always set up your own forum.

Big C - the Corvera Legal Action group is composed of approximately 110 'properties' who are taking legal action against Corvera. I say 'properties' as, since most properties have more than one depositor, the number of actual clients are greater than 110. We are represented by a group solicitor who specialises in Contract Law. The reasons for legal action are many and Calidonia is aware of the reasons. Please note that there are also others taking action, including clients represented by Maria de Castro.

Baffled why so many people are obviously so unhappy with their own development that they are taking legal action against the developer.

At such an early stage of the development surely there can't be that many issues.

I have been to the development recently and must admit I was surprisingly impressed by what I saw. Unless there is a build quality issue I just wondered what the legal action is for?

The developer is still building at what looks like a fairly rapid rate and the course looked like it was coming on, spacious blocks of dwellings, nice gardens etc.

If its not generally discussed then fine but as I say, I just wondered why

Obviously there is a difference between what you report and what other owners report and feel. Perhaps the differences of opinion are to some extent caused by commercial conflicts of interests ;)

Regardless of the reasons why, I can assure you that for a development that is  2 years late for Phase 1 owners - the issues are not at an early stage.

Hi BigC, Hi Ash (glad you're still in contact).

What you have to understand BigC is that the majority of those taking legal action against Calidona are people who bought on Corvera as an investment i.e. purely financial reasons, not lifestyle reasons. It  is understandable that those who paid their deposits as early as 2005 (expecting no more than a 2 year build window) are facing loosing money on their investments. Some of this is obviously down to the world recession but had their properties been delivered on time with the advertised facilities on site, i.e. golf course, hotel, equestrian centre, sports facilities, shops etc. then they feel they may not have lost so much, if at all. Hence they feel the need to recoup their deposits from the developer as there was no time restricted penalty clause within the contracts, as there usually is with an pure investment deal .

As I've said before and has been re-iterrated by Ash, we wish them all the best.

Hi Steve,

I will be around for some time.

Please let me point out that there are investors in our group. However, there are a number of lifestylers like me. After a 2 yr delay the lifestyle I signed up for does not exist. As you point out there are no golf courses (PGA or otherwise), De Vere Hotel, equestrian centre etc etc. We also have others with more difficult problems such as the buyer with a very limited life expectancy who is still being forced to complete etc. etc.

I have never encountered a purely investment led contract with a penalty clause. Perhaps given how favourable the contract is towards Calidonia already, they did not feel it necessary to put the clause you mention within it.

Not commented on the situation regarding the legal case I am a little confused about this action and the statment that went out to users regarding the reasons, which I believe were that mis-information or details of the legal case were posted , by a member, on the subscription users owners forum

You  ust have moderiation on the forum so if this was the case then why wasn´t this able to be dealt with allowing the forum to continue for the benefit of all members

There is an absolute need for a closed user forum as there are certainly things that owners will want to discuss in private owber to owner and of course to keep people like me, a supplier out, but there are still a couple of things I dont eunderstand regarding this action and yes, before you say it, I know that I am not an owner

This is called the CORVERAOWNERS forum with the domain name not the Corvera we do now not want to buy forum and Ash I know you said that the people that were taking legak action voted but what percentage was this of the total users of the forum

Perhaps it would be reasonable to release the domain name to somebody that wants to create a new owners forum with the a mission to do what I belivev was the original intention of this forum the frank and fair excahnge of information between owners at Corvera

I know that I have in the past been, for business reasons, beed accused of being bias to the developer but anybodyt that has used my service knows that this is not true and all I report on is what´s happening on the site and so far of the 45 properties checked only 2 people have not completed

I wonder what other people think

Hi,

With hindsight perhaps it was a mistake to give it the name we did. This has become more obvious as time has gone by. Whatever the initial intentions of the forum - they are no longer relevant to anyone completing.

As has been pointed out by others, another forum could be set up by those completing. Sorry, but I do not have the time or incllination to have the domain name changed. The new instructions at entry into the website make it very clear that our forum is now for legal group members only.

I still think that the EOS website is a godsend for anyone completing - it also allows people to communicate through PM's as required.

Ash I still believe that it woudl be an excellent good will gesture on your behalf, given the changes that you have made, to find a way to release the domain name to somebdy that is willing to build a site for the original intentions I am certain that they would be willing to pay to assit with this

For example owners swapping rentals or looking for places to sty when they are completing

EOS is gret but there are still things that people want to discuss only as owners as proven on the close site for Polaris and UGR where they don´t wnat the developers to have access

Also I know that you may not want toanswer this with numbers but what percentage of the forum members are part of the 110+ legal group as this would give a good idea on the interest form owners

Unfortunately, any goodwill I had left departed some time ago dealing with this fiasco. I have no wish to play forum ping pong with these issues, but in response to your suggestions:

No and  No to the questions in your post.

Maybe Calidonia can help - I am sure they have the funds and manpower to assist. Even the issue of domain name changes is not that great - another name such as CorveraCompletersForum can be used to get your message across. Our domain has some presence on the net - just do a Google search. I will not put this into jeapordy.

Hi Roy,

As you have said, you are not a Corvera owner, so why become involved in this debate?  I know your expertise and advice in the snagging and completion process are very much in demand and appreciated.  So wouldn't it be best to steer clear of the issues being discussed here?  I would hate you to antagonise people who might otherwise have used your services....

Really simple in that people that know me well know that what I am interested in are things that will benefit the buyers and owners, many of which have little experience in owning or renting in Spain and there are some real benefits in have a closed owners forum, some of which I have mentioned

I have always made no secret of the fact, trying to give a balanced view, that it is going to be really tough to get rental income on this site so anything that help sis good news, for the example the swapping of rentals, on a closed site, saving having to pay any fees to rental agnets thus saving people money

Being a simple soul I think that it is a big shame when so much work had gone into creating the forum, getting members and I know from feedback people benefitting from the information when now what has ti happen is to started again with creating a new forum 

It really is as simple as that and I am sure will not perhaps antagonise anybody, apart from the people that are not completing, but as you also perhaps know I have also advised people on what to do if their financial situatiion changes

People that use me do it on the basis on the service delivered and advice and knowledge and I would hope that this won´t change and perhaps somebody reading this can talk to Ash about starting a new owners forum, I would but just don´t have the time or technical knowledge plus it should be operated by an owner

 You also need to amend the Members Privacy statement, currently it says

Membership to this forum is by invitation only. All members are screened to make sure they are bona fide owners at Corvera Golf and Country Club.

Calm down everybody, as an completed owner my initial reaction over the weekend was not repeatable but have waited before posting.  Ash has said the name of the forum is not ideal now and would certainly agree with that and I am sure given the time again a different name would be chosen.  With the tag explaining the forum at least it is clear but it has become eveident that it was getting harder to hold conversations with so many opposite views inplace.  Although I may not agree with all the arguments for the legal action Ash has taken a great deal of time and effort over the forum from its conception about 18 months ago, so why give Ash a hard time.

A forum for completed owners would be ideal that is probably agreed but I for one do not have the technical know how.  What I would ask from those taking legal action is that if they see a bit of good news posted on the EOS website they respect those that have written it.

Ash you are not going to win over this so bite your tongue and read the responses but don't bite.

Even though the forum has gone a route I wouldn't have taken thanks for the effort Ash.

Just a couple of corrections:

The legal action group was started by someone called Lisa - records still exist on EOS. 

The forum would not be possible without someone called Asa. 

You are not giving me a hard time - I can keep this up for quite some time. 

 

When the time comes, I will remind you of your statement " Ash you are not going to win over this ..." You are welcome to do the same.

I don't bite - just state the facts as I see it. Sorry if it upsets anyones delicate sensitivities.
