I think it is wrong also and I don't accept that Calidona are doing everything possible. If it is the management who run the communities and their responsibility on none payment of community fees and dog fouling I have an idea.

 Why does everyone not pay their fees but keep them in a seperate bank account to show that you will pay when they do something about the dogs and the owners who are not paying community charges.

They will surely have to do something if all monies dry up.

We are going out for three weeks this Saturday on one of the free promotional breaks offerred to Phase4 buyers. I will keep a full diary of all the problems we encounter and post it on EOS once we get back. We'll also keep in their faces whilst were there about anything thats not as we evisaged. Hey ho.

Hi we returned from Roda on Sunday we had a great time, we met some nice people around the pool ,on the beach in the club house. The weather was fab, the barking from the dog next door was loud, no change there, Washing lines multiplying. One thing that we were pleased about is the pool areas are being kept cleaner I am sure this is because we now have a chap that goes from pool area to pool area making sure nobody leaves any rubbish, which is great. One thing that does worry me is the long term lets. Owners are renting out there apartments on long term lets with low rents, which means that  the standars will go down . Then will DeVere want to put a five star hotel on a resort that is not to a five star standard.

Kroda,

I am a bit confused here. Has the criminal returned to his apartment? If so, surely he should be arrested - there were plenty of witnesses. Surely GBH is a crime in Spain.

Are the police simply not bothered?

With reference to the tenant. Yes he is still living above!  No he wasn't arrested.  Apparently? according to our legal advice,

nothing will happen until the case goes to the court and the judge will decide.  Meantime we have to wait as the owner of the apartment is quite happy for a thug to live in his property.  Judging by the standards it will cost a fortune for the apartment to be brought up to standard as the outside is a mess.  Serves him right, if he has no standards about the type of tenant he allows to rent!

Ace, you made me laugh, we have thought of all those options!!

excellent posts except you are relying on calidona actually doing something , if past performance is anything to go by CALIDONA WILL DO ABSALUTLY NOTHNG EXCEPT TAKE YOU MONEY IN EXCHANGE FOR SUB STANDARD FACALATIES .

Support can be given by sending an email to the administrator to ask them to explore legal methods to get unsociable behaviour outlawed on Roda as there is currently no other way round this at present.   Urge them to remind landlords to remind their tenants of the regulations contained in the bye laws and use them whenever necessary.

Hopefully landlords and tenants will eventually get the message.

Great idea  about fees guys but Calidona are are not the people who sort this out.

It has to be the community as we are now the  new owners of Roda.

If we start keeping our fees back the only people who will suffer are the owners. ,us.

Gardens,pools ,security,lifts and rubbish collection are all are being paid for on an ongoing basis I assume and if we stop access to funds we really will have a problem on our hands.

We were in Roda recently and I am sure some people feel standards are slipping but we and a lot of others we met felt things are just getting better and better,.

 

If we start to hold back our fees we will be on a slippery slope and we will have only ourselves to blame.

No renters,dirty pools, streets and dead gardens no security etc.

From what I could gather from the people we talked to in Roda and the area  Roda is considered  one of the better resorts in the area.

 

We do not need an own goal in this economic climate.  Think it through carefully.

Very astute and well put phase3b, it is indeed us as owners that run all the communities and there are bye laws in place which should prevent unreasonable behaviour. The Administrator works on our behalf and as such can be influenced by our decisions made at AGMs but will also respond to requests in between, but will be governed by legal process and the laws that are in place.

Calidona have NO influence on landlords or tenants, though their own sales and rentals could be affected if standards slip too far.

Most of us pay our maintenance fees on time in order to keep the community looking good and working well, unfortunately there will always be bad debtors but legal processes were put in place at the last AGMs to ensure recovery through the courts is ongoing.

The more of us that air our views re unreasonable behaviour directly to the Administrator the more the message will sink in.

Unfortunately there are no quick fixes.

 

Good to hear from your recent visit that it is not all doom and gloom at Roda.

Perhaps the best way around this is to try and get De Vere more involved in marketing.

Sorry to butt-in guys (as I'm on Corvera) but obviously this sort of thing could affect our development in the future.

Not having been part of a community yet and got to know how it works.

a) How is the administrator appointed and by whom?

b) Surely they are answerable to the community and as such can be brought to task by the community?

Please forgive my ignorance on these matters.

We've just returned from 2 fabulous weeks at Roda & are very pleased with Roda as a whole.  The club house, beach club & resort in general are great, but I totally sympathise with unsociable behaviour.  Our problem with our neighbour seems incidental now!

The spanish owner of the villa next door to us likes to swim & shower in the nude in full view of the golf course!  What annoys me more than anything is that he waited for his daughter & grand children to leave the villa before stripping off in front of myself & my partner.  What he does when no-one is about is his concern but I find it offensive & frankly concerning.  Before my daughter joined us in the 2nd week we were getting to the point where we didn't want to go out onto the patio.

In fairness once he stripped off when my 15 yr old daughter & her friend arrived my partner gestured to him to put his trunks back on & we didn't see him strip off after that.

 I can't imagine what the golfers will think when they notice him flashing at them!

Hi All,

Has anyone been told that Marisol is going to call for an EGM in August? We got a reply from them yesterday stating this; hope it comes off. Surely a vote of no confidence must be lodged if they do nothing!!!!

 Kim, Linda is going to forward you the email (got told off last time I put one on EOS) to see if it corresponds with anything you have received. Hope Mark is better now, and the children are getting over what they saw that animal do to their dad.

I have been following this thread with interest as my apartment is not too far away on Phase 1. It is a very distressing situation for the family involved and a horrible experience for all the witnesses especially the two young children.

I have followed the thread on this on another forum also and there seems to be a strong body of opinion that there is nothing which can be done regarding anti social behaviour once the By Laws have been enforced and an order delivered by the Guardia Civil as the matter is then placed in the hands of the legal system. If this is accurate information why then do we need to have an EGM if it is only to voice our support of the family which most of us have already done by sending an email to the administrators? 

Most importantly can the family involved ie Kroda's family, make themselves available for the EGM in August, as they were already here on holidays this may prove difficult for them with regard to work committments? Without their attendance there is little point in an EGM as it would give little credence to the sense of outrage if they were not there. At last year's AGM there was a proposal to move the AGM to summer but this was outvoted as the cost of flights in the summer for UK and Irish owners is prohibitive and a lot of owners have renters in their properties at this time. Given that there would only need to be a two week notice period for an EGM  I wonder if it would be well attended. 

In my opinion there is little point in having an EGM if there are very few people there as the cost of the mailshot alone to the UK is bound to be in the region of 500 or 600 euro which is paid for by our community fees and this money could be better spent on exploring if there is something which would be done to actually deter this type of renter being allowed on Roda .

This in no way detracts from my very strong support for the family involved but I wonder if an EGM is the best way forward as if it is called for the middle of or around 20th of August how many people could attend with fares astronomical and at such short notice. I have already sent an email to the administrators asking them to use their legal expertise to explore avenues of making life very difficult for renters or agents who rent to undesirables as this would improve life on Roda for all of us owners.

the first thing to say is that krodas and family deserve everyones support and backup as who knows it maybe one of us next .

the problem of undesirable renters and agents acting for them however imo is a different issue and is more to do with a chronic over supply of units for rent ( thus driving rents down) spains particular economic problems and the demographics of the local area . a lot of phase 1 - 2 were sold to investers who have seen capital values fall and are forcast to keep on falling unti  2012 , they cannot sell in this market  are struggaling to get holiday lets as spains tourism industry suffers in the cuttent downturn as such they are happy to take whatever they can get and will deal with other issues at a later date .

having spent a lot of time in the local area i fail to see where the highly paid transient jobs are that would support the level of rental required to make investing on roda ( or any other resort ) an attractive proposition the area imo is not a well healed area and as such i would assume less desirable people would jump at the chance of living on roda what else is available of a similar standard ?

it would appear that it is a viscious circle , relativly low demand for holiday lets  - over supply of units - capital values in freefall - relativly low paid locals for long term lets - and what appears to be no recourse for undesirable tennents .

can the appropriate residents associations enforce any action against tennents ? as for the other issues time and lots of it may or may not rectify the situation . i guess we will just have to wait and see .

While we still only have 'a hole in the ground' we will be at Roda, renting in August. If we can be of any assistance we will be happy give it.  What has happened to Kroda is totally unacceptable.  I still think Calidona should offer some help even if it cannot be direct.

We have up to now loved Roda and the area but we don't feel like completing if things like this are happening.  Calidona may pursue us but I think it is becoming clearer that we may have a case.  Or do we ????

Who employs the security?
