Surprise, surprise

I have just had an email from my keyholder who was preparing my apartment for friends to stay.

She said the terrace was covered in dog hair, dog excrement and the place stank of urine.  I am constantly in touch with the adminstrator but yet the problem continues.  Noone should be expected to live like this, especially in a "luxury" resort. 

If this sort of behaviour is allowed to continue, how long will it be until the whole resort deteriorates.

not really one for forums but thought i would add my experiance having just returned from roda .

there was a considerable amount of dog fouling around the walkways on phase 2 never really noticed this before not  very good for people looking around with a view to buying ( if there are any ) .

was very suprised to see a teenager using roda golf buggies to transport other teenagers to and from the clubhouse late at night using the public footpath , was even more suprised when i saw them in the clubhouse and they were with a party of a calidona employee on site , i was under the impression calidona were trying to create  5 * resort not having the public walkways turned into buggy tracks for teenage kicks !!

just my opinion maybe im getting grumpy in my old age .

I was at the beach club with my wife and two kids yesterday for my wife's birthday. I was seriously disappioned by it compared to last year. Why?

Ther entire pool area was tatty looking- the floor of the pool at the entrance was badly scuffed; there was a disgusting brown tide mark around the pool itself; the loungers were grubby looking; there were (broken) brollies and other promotional materials pushing a drinks brand; there were empty tin cans and litter on the beach itself.

The worst thing was that the bar menu has been withdrawn so the kids have a choce between an expensive haute cuisine lunch or filled rolls from the bar. We opted for the haute cuisine, given the occasion, which meant the day cost us £200 for 4.

I asked the sister of the manager why they had withdrawn the De Vere bar lunch menu. She gave me a very helpful shrug of the shoulders, Perhaps she could not hear me properly over the deafening dance music playing over the speakers.

I will not be back until De Vere are back in charge.

Further to my last post below and on the plus side at Roda , the Calidona staff at the Pro Shop continue to be as professional and helpful as always; the golf course which i have played twice is looking fabulous; and, generally speaking, the resort increasingly looks to be in a different class from all its nearby competitors on Murcia, some of which look very sad and neglected.

I would like to inform you all of the current situation at Roda.  This had nothing to do with Roda/Calidona.  The problem appears to be the administrator.

As you will have seen from my previous postings,  we have a problem with the tenant above us.  We have reported since April (at least once a week) to the administrator.  For the those of you who are not aware, I will give a brief summary.  The tenant goes out at 2230 approx and leaves the dog to bark on the balcony until at least 0530.  The dog is never walked, therefore urinates and so forth on the balcony which runs onto my terrace.  The stench is awful and it is totally unacceptable for me or my keyholder to have to clean up this mess.  Everyday we have to hose and bleach down at least two times.

We were at Roda for almost 3 weeks and on out 3rd day there, we were having lunch on our terrace when the dog urinated on my daughters head!  My husband went upstairs and knocked on the door and had it slammed in his face.  I proceeded to hose down the terrace and the dripping off the balcony whilst my child was very upset.  The tenant then proceeded to hose my children and me down.  I ran to get my Spanish neighbour and my husband returned and shouted to the tenant (in English) to stop which he wouldn't.    2 minutes later he appeared around the corner and raced onto our terrace and assaulted my husband.  By this stage my children and I were hysterical.  I tried to pull this guy off my husband whilst my neighbour grabbed the children.  He split my husbands eye and bruised all around his nose.  When a crowd gathered he ran off.  Another neighbour called for security and the police.  Subseqently my husband spent the next 6 hours at A & E (private clinic was closed), and another 1 hour at the police station making a complaint.  I also had bruised legs when I was pushed to the ground trying to defend my husband.

My neighbour called the President who came very quickly and was totally shocked.  I told him that Marisol (administrator) was warned something like  this would happen.  We went to her office the next day and her colleagues were shocked to see my husbands injuries.  We asked them to ask Marisol to telephone us but to this day she has never returned the call.  I thought it would have been nice if she had rung to show her concern.  She has told the President that nothing can be done about the situation - it is not a community issue?!  Why then has she been advising me since April on what is being done?

I don't want to bore you further but I want to leave you with these facts.

This is a long term rental property.  The owner has not paid his community fees.  The tenant continues to use swimming pools, along with his friends who do not live in Roda.  The company who own the property own lots of properties on Roda but again community fees are outstanding.  We now are challenging the community adminstrator to help with our case.  Do you really think it is fair that this tenant is allowed to continue this unsocial behaviour?  I am now scared to be alone in my own property or visit the underground garage.  My children are affected by this situation as they have never seen violence like this before.

I would like to hear other peoples thoughts on this matter and would appreciate any PM's

Kroda I am really sorry that you have suffered at the hands of such an anti social individual but disputes between neighbours in Spain are very common but there are a couple of things that I do not understand

It seems a good case that this person asaulted you and there are lots of witness statements and I would like to know if the individual was denounced because based on the facts the next step should have been his arrest for questioning by the Guarda Civil

Did you make the statement to the Guarda Civil, did they give you a copy of the complaint form against the person and advise you of the next stage

I know because of similar problems on my community that the administrator will try not to be involved but they should take the report and advise the owner and in our case the person was removed but we had to denounce the owner of the property and this took almiost a year to resolve

Do you have any contcat details of the owner of the property, do they know what´s happening and the danger of them being prosecuted, changes are if they have not paid any community fees then they won´t be too worried

I know that this is a strange idea but chances are, given the description of the way that the dog is being looked after that the dog is not being looked after. The Spanish hate animal cruelity so it may be worth talking to people like APAH on what can be done for reporting this to the authorities for checking

As far as the community fees are concerned very little can be done apart form using the legal process, you cannot stop them using facilities and only take them to Court as a debtor once the AGM has approved the action, a long process

I hope this helps a little bit but as with most disputes in Spain you must use the legal systems available to get results and it takes time and patience

Thank you to all who have sent us messages of support on this matter.

Our next step is to call an EGM, the administrator is reluctant to do this (no shocks there).  We are paying a lot of money for community fees and will not tolerate anti social behaviour.

I am truly shocked to hear what your family went through. I am afraid I cannot offer much apart from my condolences. I sincerely hope you get the tenant thrown out and hopefully prosecuted.

There must be a law for this unacceptable anti social behaviour.

I am sorry to hear your plight I hope the Spanish police act.

You should name and shame the aprtment and the company who rent it to this person.

If  the rental company relise that this person is costing them business they may act.

Unbelievable!  I would have thought Roda could give some help as this affects all of us who have not yet completed.  Unless the problems with dogs are sorted prospective clients of Calidona will be put off purchase.

Your problem is awful. That man should be in jail. All who are not paying their community fees should have their locks changed by the community until monies outstanding are paid. 

Yes. Good idea.  NAME AND SHAME THE COMPANY WHO OWN THIS APARTMENT.  And any others who do not pay fees.

There should be a ruling - no dogs left alone outside (or inside if they are a nuisance).  All dogs on leads.  All dirt picked up and put in appropriate bins. 

Hope something can be done.

kroda , an appalling situation that should never have arisen .

i posted sometime ago about the effects of cheap rentals and poor quality tennants having a detrimental effect on the resort and the possability of peoples property value being affected by this sort of thing , i would suggest its in the interest of all concerned to try to keep standards up on the resort , a very difficult thig when so many units were sold to investors who at the moment and for the forseable future are just glad of any tennant without to much recourse to  quality  .

last time i was in roda there were two spanish famalies around the pool approx 9 people hadent seen them before just presumed they were residents , when i left to go to the airport early evening they just happened to be packing there cars and i followed them out of the resort up the motorway wher they turned off to santiargo rabeara ( appolagies for spelling ) they did not appear to be residents or visiting anybody as i had not seen the cars there previously , i assume they were locals who had just popped in to use the pool for the afternoon !! is this wide spread or just an isolated incident ? 

still nice to know we are doing our bit for the local community !!

I am not surprised about the people you mention, using the pool.  It is happening on a very frequent basis.

Why not?  If the community allow this to happen, what is there to stop these people.  Its just nice to know that we are keeping the facilities up to standard for these day trippers!! 

Nothing shocks me anymore - this resort continues to go downhill!!

with ref to pool users can we ask these people to leave ?? I guess no one wants to be put in a position where they can get assulted !! I really think the comunity should be sorting these issues

the problem is you have no idea who they are it was only coincidence that i left the site at the same time and travelled in the same direction (not a stalker honest ) these people probebely feel that with apartments being used for holiday lets etc that they will not be challenged .

i appreciate that the golf course and clubhouse  are open to the general public but is there a need for the public to have access to the whole site ? afterall it was sold as a secure gated community which it clearly is not , i noticed another comment regarding a teenager driving round late at night on a golf buggy ( didnt know you played golf in the dark ) all of these issues inc dog fouling etc are in danger of dragging the resort down and hampering sales and will clearly not help the image of the resort .

When we were out in June we did notice a large family of Spaniards appear at the pool who had not been seen before, nor again....I was going to approach them however noted that they did have a Roda key lying next to their belongings so I guess they were residents,  perhaps in a different block looking for a change of pool for the day.  It did get me thinking however that as the keys are quite distinctive surely these could be used as evidence of residency to try to police pool users, in absence of any other type of ID......surely the security patrols could take a lead here given they are absolutely useless standing at the entrances watching cars going past.

I noted phase 1 had lots of signs too for 'private pool' - whilst I recognise that this would by no means stop people I dare say it would act as a deterrent for some.  This is definitely something for the next AGMs for all phases so we can try to keep our resort as private as possible.

My family and I know what you have been going through over the last few months, you have all our sympathies. This matter is the worst Roda has ever seen but I am afraid that it will no be the last such episode.
 
Some comments on previous postings:
 
- Some expect Roda / Calidona to do something and help out in this and similar matters. In my humble opinion, this just won´t happen. For Roda / Calidona there´s only one direction: theirs, and only one thing that matters: them.
 
- Kroda made the right point: countless apartments with rentals at 395€ can only bring a certain type of neighbour to Roda. Here´s the evidence.
 
- Kroda says too: Roda continues going downhill. Well, it certainly looks more like Roda is actually on freefall.
 
As an owner and full time resident since this place opened it certainly hurts to have to say all this, but it is time owners get together and call for an EGM to deal with these subjects as a matter of urgency and alter the estatutes and by-laws if necessary. Waiting for the next AGM is much too long.
 
There´s no doubt other complexes and resorts will have similar if not worse problems. I honestly don´t care about that, like many others I am just so disappointed and frustrated at the course Roda is taking because of these cheap rentals.

Now, if you want another real taste of slipping standards, just pop around block 13, ground floor A where some long term tenants entertain the neighbourhood on a daily basis, early morning till late at night, with a repertoire of yelling, shouting, screaming, rude language, blasphemy and other delicatessen of the like. This has been reported to the Community on at least two occasions. The tenants get a word, stay quiet for a few days and it all starts again. It is just a nightmare.
 
Will owners who are aware of this particular problem contact or pm me to try and make a stand and place a strong, coordinated, formal complaint with the Administrators and the Community please?

Hi

Although we still only have a hole on 4b we will be out in August .  If there is a meeting there then I will come. Witholding completion monies until these problems are sorted may help. I have no wish to pay for being weed on or stepping in whatever. These issues need sorting before any more of us complete and hand our money over.

Calidona HAVE responsibilities towards purchasers whether they like it or not. They should join the communities and get these problems sorted.

I feel Caledonia are probably doing the best they can! I have an apartment on phase 2 . Last week i walked from the childrens play park along the path to the entrance of our apartment .Where recently errected is a sign asking dog owners to clean up there dog mess, on that short journey i counted 22 dog/or cat messes, even one right under the sign post.!I was pretty disgusted that someone watched or ignored this happen.  I dont know what else Caledonia can do, Some People dont wont even pay community fees so fines for allowing dogs to foul is probably not a winning  idea. I think we all have a responsibility to challenge people who allow their animals to foul the resort( if we see them). I know i have in the past ,(with not much success i hasten to add). I know lots of people with dogs are responsible  so hopefully these owners who are walking their dogs might be more likely to see the culprits and point out the error of their ways, We as adults have to take some responsibility ,along with Caledonia and the B------s who cause the problem in the first place!!!!

Dog fouling is bad, and it is equally English and Spanish and other nationalities who are guilty for this. However, they all have one thing in common: they are renting and in Roda that equals to: all the rights/no obligations.

Just as bad is dog owners who leave their pets alone in the terrace to bark and weep all day. Near where I live at least three dog owners have been reported for this in the last few months, namely in block 2, 12 and 16 (all  renting, of course).

Now, knowing what´s happened to Kroda, who in their right mind is going to challenge these people? I would advice calling security instead for the fear of some of these brain dead renters asaulting you because good manners and good education are worth nothing to them.

I fully respect what you say, however going to security doesn't work.

I spent most of my holiday in April, visiting security to report these matters but they did nothing.  When I returned in June, I did the same thing, again they did nothing.  I can understand that the tenant goes out so they have no way of speaking to him but I did suggest that they speak to him when he returned.

I have abided by the community bye laws but it seems the administrator isn't doing anything about those who flaunt their disobedience.

I would appreciate as many people as possible contacting the administrator and voicing their concerns.  As regards to the tenant, we have instructed a solicitor to conduct proceedings against him, however this is at our own cost, again I think this is wrong.
