I am also wondering why Tricky Vick has not replied to my last PM - I think the facts spelt out in that email leave no doubt and yet you are still saying there is hope of a refund from OVP.

Can't help but think there is something strange in that.  Are you Just Dan in disguise?

Anyway, this is just a distraction to what should be a concerted group action.   I'm all for tempered action rather than gunning for people's heads, but this doesn't stop me doing everything within my power to see justice.

Yes I did make the point that any civil case would have to wait until a criminal case had taken place, however that does not mean that the ground work for a civil has not be done and taken to court. At this stage ovp solicitors would say civil case cannot proceed until the criminal case has been heard.

As regard to the content off this being libelous. Anything I have read on this is mostly true. Anyway why would anybody take this site seriously sure we are all mugs!!!

The administrators are not pulling out because of pressure on this forum, they are pulling out because there is no chance of getting any money back from the two development companies in Spain? & perhaps because they do not want to get their hands dirty as well.

One question which I would like to ask Tricky Vick is that if Ocean View have not done anything wrong then why don't they send out  clear documention explaining where our monies have gone, what is the issue with the land ownership, has the developer ever applied for a building licence?

Why are you bothering to place anything on this Forum if you are convinced that you are going to get your money back? Seems like a big waste of time?

In my discussions with the Fraud Squad sometime ago they intimated that the norm for people like "these" is for them to recommend solicitors to recover the money, or transfer to another development etc

I was told  by Stafford  fraud, it would take about 12 months to collate details, as there are so many involved. I wrote to the legal complaints office about the UK solicitors OVP put us on to. The answer I got from them is that  they won't accept my case, as I didn't report it in 12 months!!!!!!.  The fact we have a very clear case of wrong doing, seems less important than their time limit for complaint.  Just another toothless 'ol' boys' club?

Just Contacted Staffs Police Fraud Section:

Very friendly... Only need dates of payments and name and place of the development for now. If you haven't already then please do give them a call. Its not just EBCC but many others also. Its worth reporting so that if payments are not fourth coming then they will be considerably further down the line than just waiting for now until payments possibly do not appear or dry up.

PLEASE DO REPORT IT:  I WANT JUSTICE TO BE DONE : ONE WAY OR ANOTHER!

No of course I don't believe it. But what can we do other than wait? That is the only advice I get?? It seems to me that if they say they will repay the money they have done nothing wrong? All we can do is to wait for the next date they provide. Could go on for ever??? What do you suggest other than register with the police?

I just don't know, if you speak to them you just seem to get the 'too bad' sort of attitude 'thats life' but it isn't they should have been in control of what they were doing instead of living the high life they have probably all been doing and probably all will do if they don't go down for what they have done.  Don't think the administrator even thinks he is getting anywhere so I guess we will just have to hang on like you are doing and keep thinking what could the next step be in order to get something back.

In any case when it comes to OVP we are unable to help you. The reason is that purchasers paid OVP the full stage payments of their off-plan properties when this is never done like this.

The way it's done normally is that a purchaser pays the Spanish lawyer who you've appointed to act on your behalf in the conveyance and he in turn transfers the funds over to the developer as per the PPC. If something goes wrong then he can always litigate because he has prove of the interim payments made to the developer.

The way how OVP organised it bars you from litigating because they at no time are able to provide bank statements proving the funds were actually sent over to the developer as we've experienced numerous times. In fact they charged 7% VAT upfront which is never done claiming this is how things were normally done in Spain, far from it. It seems this was really their commission not the VAT. So now many Spanish developers are claiming to be paid the 7% VAT as well which purchasers in good faith had already paid -or so they were misled to think by OVP-.

In any case, we cannot litigate without a purchaser supplying us with prove of having actually paid the developer as the whole law suit hinges on these stage payments. OVP at no time are providing prove of having sent over the funds to the developers except the initial security deposit which strikes the property off the market.

Ocean View Properties International Ltd. was not regulated by the FSA because it did not carry on any FSA regulated business. It has therefore never been the direct subject of inquiry by the FSA.

There are firms connected with Ocean View Properties that were at one time authorized by the FSA. The FSA has cancelled their authorisations and is carrying on an investigation into those firms. It would not be appropriate to comment further at this time.

I express my sympathy to anyone who has lost money in this case, and would urge them to contact their local police force, to pass on any relevant information or evidence, if they have not already done so.
