 We have been told the same that we need to wait for legal interest and fees to be settled. We have also had money widtheld incase the developer counter sues us in Marbella. Has anyone else been told this?

Millwall, did you get all your money returned in one go?

Hi

I have been told that the Courts are calculating my claim which will include depsoit, interest and legal fees and would be paid last week or this week.

No mention of any monies beng withheld.

The recent post on money being withheld and potential of counter action are a concern ? on what grounds is the counterclaim ? my entry date was 10 Jan 2010 in my contract and from the pictures on the VR website there were still Tower Cranes sailing overhead on the last pictures dated as 17 July, so i still think they exceeded the 6 month grace period. Can anyone confirm if any of the Flaminio/FV apartments are occupied ?

I have been informed that my case has been accepted by the courts and we are in the period where the Insurance Company can appeal - although i've been advised in the last few cases they did not appeal - so i was hoping for a speedy conclusion and had my spirits lifted by the positive news about money returned on these posts.

With regards to actually getting the money back, is this process straightforward ? as i see read comments about required Spanish bank accounts and the like ?

Hi

If you are with Lexland like us I can confirm that the money transfer is really straightforward. You just supply them the bank account IBAN and Swift details (UK or Spanish) and they will send the money electronically. It takes 24 hours to appear in your chosen account. Lexland will offer to open a Spanish bank account for you if you wish but will charge. We did this ourselves from the UK - it took a while but we did it as we still hope to buy in Spain.

I too do not fully understand why we have the wait for our legal fees and interest when others have had this. Our completion date was December 2009 so we are well beyond even 6 months grace period. There are cranes still on site at Valle Romano so I cannot for the life of me see the Town Hall granting 1st habitation licenses. They still have landscaping, swimming pools and furniture packs to sort!

We have now been told we will not get the rest of our funds until after August which is very frustrating as we have viewing trips booked for the first week in September.

Thanks for the prompt response Musicman, are the fees and interest being held as the portion in case of this counter-action perhaps? We are advised that a sum could be withheld with our agreement given this possibility - although i cant foresee on what grounds this action would be based; and would they pursue everyone who pulled out ?

Like you - i'm still keen to find somewhere and yes VR looks top class but at what we paid i think i could get something very nice in Marbella now ???, its a shame it didnt turn out as planned, but the facilities we were 'promised' by FV will not materialise for a number of years due to the recession, and whilst i was thinking long term initially, i was still think what we we all heard about in the sales pitch is a long long way off.

Just looking forward to putting this behind me and being satisfied with a few holidays and then maybe start looking again, but i think it will need to be 'built' next time - not brochures, videos, drawings and models......

No, we have had fees held incase of counter claim as well as awaiting our legal fees and interest to be paid. To be fair, we were told by Lexland that the legal fees would be a separate case but would just be delayed. This is what we expected. Apart from the counter-sue money everything has gone as Lexland stated it would. They are not the cheapest solicitors but they do seem good at this type of business. I am just frustrated to hear that Millwall has had all his money paid in one go and would like Lexland to explain this?

We too were bitterly disappointed with our venture at VR. We were there in May and it looks really, really smart. That said we paid at the height of the boom and with the impression that we were paying more for facilities like the Spa, Hotel, Beach Club and Sports Complex. How they think anyone would not pull out in our situation is so naive. 

I hope we can one day find a place of our own but like you we will work on that with some more holidays there!

Sorry about earlier post

Has anybody who has used Lexland,told them that they dont approve of them holding on to

our money for an extra 2 months. they never told us that the developers may counter sue, unless

they know something and are not telling us. And as for the legal and interest costs, the courts asked Lexland

weeks ago what they would be. So why the delay?

 Has anyone had all their money back from the legal action against VR? We have had our deposit back but are still waiting for costs and interest payments - for over 6 months now...

We're in the same position as you. Deposit and some interest returned in August. I know of one other person who occasionally posts here who is in the same boat. Still getting an email from Lexland every few weeks saying they are waiting for a decision from the courts as regards the fees and further interest. I find it strange that no-one seems to know how the courts determine how much interest is payable. Even Lexland do't seem to know. .

 If I remeber correctly the lawyer wanted aound 37 thousand euros to pursue this to the courts.

Is this how much you are out of pocket or is it much less than this ?

I'm one of the clients receiving emails from Lexland saying that the costs and interests still have not been awarded. The reason cited being a "court backlog".

It seems strange that is taking so long and   I am concerned. In fact my other Spanish lawyer says the same.

Jennifer and/or Dimas do read this forum, so perhaps they can explain why it is taking so long?

No, Lexland did not charge anywhere near the amount you quoted for their services - it was around €9,000. We are also owed interest by the insurer on our deposit. This is what we are still waiting for. I just wondered if anyone had been paid everything back.

On another note, I cannot believe why VR never offered any of us a discount to stay with the purchase. They are now selling the units for as little as €140,000. Crazy.

 Has anyone heard from Lexland on our costs and interest payments? JG indicated we would have at least some news before the end of July. Even though I have sent 3 emails throughout August I have had no reply at all.

We are over there in a few weeks and plan to call in at Lexland

Can anyone help?

i'm yet another person waiting for my legal fees and interest. I have gone hrough Lexland and receive the reglar updates (which I appreciate).

I'm encouraged by the updates that Lexland provide  and by their professionalism.

However  at the same time I am perplexed as to why it's taking so long for the courts...and now I am actually getting concerned.

I am also in need of the monies.

 

Hopefully Lexland will provide another update on this site as the negativity could affect them.

I'm one of those who has been receiving emails from Lexland for about a year about back log at courts etc.  have just heard there will be a court hearing soon to resolve matter of outstanding legal interest and legal costs.  It's been a hell of a long wait but fingers crossed ...

I got an email from Lexland in early August to say that a hearing had taken place and that they felt it had "gone in our favour". The courts were closed for August so there is still no official notification of the result. I got another update this week to say they are still waiting to hear back from the court. It goes on....
