Legal tip 1197. Happy conversation with a happy client

Just gof off from a phone conversation with a client deciding about going against the Bank. It was a very learning experience. It taught me that some clients need a voice on the phone, not just emails.

She is preparing a list of questions ( she was very neat, precise and reasonable on the questions she made) so I can use them for my clients care commitment with her--- not all clients need the same--- and for the benefit of other customers.

Law Firm clients care: we are keeping the passion up and doing new efforts of imagination and service. It is a very enriching experience. People are always, need to always be FIRST.

Legal tip 1195. Law 57/68 Lawyers negligencies

I agree with your comments on lawyers liabilities. It is a non explored field so far in regards to these disasters. They represented clients and did not ensure that these buyers had  the corresponding individual certificates of Guarantees.

Unless they can prove they requested it, using all the necessary due diligence; if (1) the action against the developer cannot be enforced and (2) there is no possibility of action against the Bank (using Law 57/68), an action against former conveyancing lawyers/ their professional indemnity insurance need to be explored.

Deadlines for these actions are of 1 year after previous measures prove to be fruitless. 

All related damages can be added here ( interests, moral damages...)

Legal tip 1192.Clients deciding on Actions against Banks

It is good that some of our old clients for contract cancellation are deciding now to go ahead with actions against Banks.

We won cases against developers for these clients and, when trying to enforce those Court Decissions, these developers went bankrupted: financial crisis´ impact. 

Bad news? No... GOOD NEWS, actually.

The fact that they cancelled their contract in early days is now the gate for them to be able to act against the Bank. Supreme Court recently put a stop on late cancellations as the Magistrates  understand that if buyers did not cancel after the breach several years ago, an action now is questionable.  

These clients are now provisioning with a bit more of funds so we can conclude the work we started. These were actually the clients we had in mind when we created and developed our service of Actions against Bank out of Law 57/68.

It is not being easy at all but we are getting there...

Legal tip 1190. Why against Banks and not against Lawyers first?

Today´s question and answer in yesterday´s blogpost
 
Six years ago my husband asked our new lawyer to sue the lawyer who got us into the position of not having a bank guarantee on our off-plan purchase.
If it is so easy to sue these people as you seem to describe in the above statement, why are we involved in a costly series of expensive court cases to prove his negligence? The fact that he did not ensure we had the legally required bank guarantee is proof enough he was negligent?

Post above is about lawyers liabilities due to lack of license. Professional liabilities of different actors has been progressively stated legally as the post describes. You are asking me on a different matther though and I answer below.

In regards of actions against Lawyers for lacking of law 57/68 guarantee. The fact that law 57/68 makes banks liable of this lack makes the need of a case against developers/banks to be performed first
If you sue lawyers before banks, they can certainly oppose this legal obligation of Banks declared in Law 57/68 and nor, repeatedly interpreted and confirmed by nationwide judiciary.
 
IN early times, before developers were not bankrupted, a case just against them was enough. Now, and with the strength of increasing case law on Bank Liabilities when there is no guarantee issued, refund action ( involving a contract cancellation) against both entities: developer and Bank is the safest and rightest procedure.

If this is not possible, then, a professional indemnity action against lawyers and/or agents--depending on facts-- is the route.

I bet for a professional liability joint action to be brought against all related actors involved: lawyer, notary, property valuator, bank, estate agent and their corresponding professional insurances... as we do in Spain when there are building deffects on a built property
