I am currently buying a property in Spain but the development is more than 12 months behind.  I, therefore, have a decision to make due to the market conditions.
1) Do I continue - completion is approx 3 months away (green areas 12 months) or....
2) Pull out now and get my money back due to breach of contract??

What would you do???

Hi Wendy

I'd do some research and see what I could buy with my money for something that was ready now. If I would be financially wiser to take the breach of contract route I would do that and take advantage of the cheaper prices. However, you really must look at the small print and make absolutely certain that you wouldn't lose your money if you pulled out. Get a lawyer to check it too!!

Irene

Be careful with the breach of contract route as it could take years. My brother is going through this at the moment and his lawyers told him it might take three more years. This is after waiting five years for the complex to be built.

Be carefull with pulling back, you will always lose money.
Maybe it´s just the deposit, but depending the contract it can be much more.
If you need any advice, please feel free to contact us.

abc solicitors i don't see why you always have to lose money if you pull out. if there's still some justice left, those of us who have been victims of rogue developers should be able not only to get our deposits back, but some sort of compesantion too!
