We employed Costaluz ( Maria and the team ) and we have just got our money back from the developer,

This posting is to say thanks for all the Eye on Spain advise and  thanks to Costaluz and Maria, I would recomend everyone who has a dispute in Spain to get on to Costaluz,

We had a great sense of relief from day one of instructing Maria and colleagues, I knew that we were doing all we could and we were in the hands of a trustworthy person....at long last.!!!

Timeline:

July 2007- Deposit paid for an off plan apartment (never again!!)

July 2008 - Property due to be completed

Feb 2009-Advise from Maria on Eye on Spain- Costaluz hired to cancel and seek return of deposit

July 2010- Notice to appear in Spanish Court...Yikes...!!!

Feb 2011-Court hearing and lots of help from Costaluz Lawyer who done all the talking and won the case !

April 2011- Developers appealled !!!

Nov- 2011- Developer lost their appeal

Feb 2012- Deposit returned in full. Now we must wait for legal costs and interest etc...fingers still crossed.

Keep the faith Guys and get Maria and Costaluz on your side,

Good luck and  Cheers Steve

Steve, many congratulations, well done!  Was the property not built or was there some other problem?  Also did you have a bank guarantee as it does appear to be so much easier to get money refunded if you happen to have one?

I'm so pleased for you, you must be delighted.

And now... it is the perfect time to reinvest it in Spain, in a much more sane market.

Kindest and congrats!

Maria

I'm sorry but I don't call this sane Maria, but congratulations on your successes nevertheless. The vulnerabilities remain so long as retrospective action is taken against innocent purchasers.

Where is the compensation structure for those used as scapegoats in the internal disputes? Sadly corruption and action of this nature where individual rights are abused in this way is a cancer that continues to ruin the good works of others in Spain.

It makes me despair. What of those who cannot afford the continual fight for justice?
