Since Martin 72 posting on April 4 - no one seems to challenge the fact that there is no major building activity on this site.

Does anyone have any proper information  from Huma when building will start in numbers or is there still just a single JCB there?

It is difficult to make decisions with little or no information on the site status or plans.

got back wednesday swapped over to occ

when we got there monday they were digging foundations for show houses. they also said that they were going to set up web cam.

as mentioned on other forums, the licence for oasis will not be legal unless it also includes the "licencia de convalidacion" this is the clearance from the junta for the town hall approval, without this any construction will be illegal!

The lincencia de convalidacion has been approved, stamped fby the junta from the town hall in Tabernas, all paperwork as been passed and stamped and is all legal

i think you will find the licence should be stamped by the junta in almeria and not by the tabernas town hall, has anybody received a copy of this??

I have all the paperwork and licences stamped and signed and was given to me from Huma when i transfered from the ACC. All were checked by my solicitor and agreed all licences etc were all in order, signed & stamped from all concerned

when i e-mailed huma and asked if they had the licencia de convalidation, they replied they had no idea what this document was and never heard of it, but you say you have seen a copy of it???????

Could you explain what this 'licencia de convalidacion' actually is. It would appear that not only does Huma not know what this is, some legal representatives are also clueless. When I contacted my lawyer about this ( following your post on the ACC owners forum) he didn,t seem to know what this was but did say that the first document in the OCC legal pack is the required Junta authorisation ( there are Junta rubber stamps all over it ). I've looked at this ( you can see it on the Huma OCC website ) and it doesn't have any official title on the document but could this be the document?

the licencia de convalidacion is the document from the junta that gives clearance for the plans approved by the town hall

this information regards the licencia documentation was copied from sol banks magasine which had a 2 page article on the illegal builds in almeria and also mentioned the priors, who"s villa was demolished, and it went on to explain the importance of this document.

I took the dossier of documents to my solicitor  to be checked and they confirmed all the documents give the clearence for the build & land from the Junta. It wil be interesting to see what your solicitors have to say.

I don't know if this will be of interest to anyone but I have just received an e-mail from my solicitor regarding Oasis, please read extract:

 

Please note that I applied for the land registry information, and I received a notification stating that at the Land Registry are working on the general plot as it has been already divided into individual plots, so they cannot provide any information by the moment.

'Licencia de convalidacion 'means quite simply a Licence which is validated and I understand can be for ' anything'.....valid car licence!!

My understanding is that there is no specific licence 'headed by this name' which applies to the planning approval for development

I have been advised and it has been confirmed by others that the first document  in the Huma OTCC dossier is the one which gives approval for the development by the Junta

It is headed Junta de Andalucia and signed by El Delegrado Provincial with a stamp

Now, if you think OTCC is just a big con by Huma and their banks, then no one will convince you otherwise!!

But ' get real' ACC became a mess for everyone involved and now is dead in the water and will, I suspect, remain so for some time'

Those who do not have a Bank Guarantee are fiinding it hard to get their money, so to be sensible they should at least look at OTCC or even MCC as this is the only way of securing your money in the immediate future without a long and expensive court case......if anyone knows any other way please tell me!!!

And responding Huma have a responsibilty to us, they are a bunch of crooks really does not get us anywhere

We did not have a BG and to be blunt the most important thing we wanted was to make our 40 % deposit secure after over 2 long years of being at risk

We looked and made our decision for OTCC......and very shortly we will have a guarantee for our money and in circa 15  months a Tarifa  

Most certainly you should be sure in your own mind that if you change your money is guaranteed and OTCC will be built...only a lawyer can do this for you 

Anyone who does not look and consider the options and just decides to ' wait for ACC to happen' is taking a big risk.....just my view but I do not like to run the risk any longer of  53.000 € going down the drain in Spain!

Now if you have a Bank Guarantee you have another option....we were not so lucky  

If you do not......at least be sensible and look !!

Thank you for your post.

This would seem to explain why my solicitor was confused over my enquiry regarding this 'licence'. He has consistently assured me that the permissions are in place.

GT's post is also interesting. It would appear to indicate that Land Registry are all ready preparing for the eventual registration of individual properties ( 'already divided into individual plots'). Would they be doing this if planning consent was not in place?. Certainly in the case of ACC this stage has not been reached.
