Hi we have bought on the naranjos phase and as yet have no solicitor.  We have paid our first 25% and we are due to pay our second instalment in June, Does anyone one recomend we get a solicitor? and if so when is the best time to get on.  We have heard some people say they had one and some saying they didnt bother so dont really no which way to go.

Would you buy a property in the UK without a solicitor ??

Not using a solicitor is a risk - if everything goes according to plan then you may save yourself abit of money but if things don't then who knows what could happen - and what it could cost you. Are you prepared to take this risk ? 

Personally, I think the best time to appoint a solicitor is before any money is handed over (the same as in the UK).

THey seem to have a few Polaris clients and have arranged NIEs etc on visit provided contact with very good English

I am in a bit of a dilemma regarding the solicitor issue.

At present we have paid our 25% & 15% instalmentswith only the completion payment to go.

We haven't used a solicitor yet but thought that getting hold of the NIE number would make it a necessity to do so.

Then, hey presto, the documentation comes through from PW to get the NIE number.

I absolutely agree that you wouldn't buy so much as a garden shed in the UK without a legal representative...................but what is the benefit of one going to be for me now???

I would be gutted to shell out even more money for a solicitor (especially considering the current constipation curing exchange rate!) when it may not be necessary.

At what point will I need a solicitor................if at all???

I would be keen to hear from either people in the same boat or people who have completed already on other PW properties.

Our thoughts on this are that we wouldnt buy in the UK without legal support and so wouldn't elsewhere. I know people do go through the process without a Solicitor but we have had one since day 1 and they sorted a few issues for us and applied for our NIE straught away- which we've had for some time now. Polaris will still charge to arrange the NIE- they will put it on the Utilities bill

If there are any problems they will resolve them. For example we have heard that purchasers taking a builders mortgage over have been charged the 1% cancellation fee which should be paid by the builder but is often charged to the purchaser. This can only become evident when attending the Notary's office to make the final payments and sign for the property- obvioulsy a situation like that can be resolved by a Solicitor, but is much more difficult for a non Spanish speaking purchaser about to/wanting to take ownership. The signing over process is different than you might experience in the UK and we'd rather have some there who knows the ropes. We will have their advice on any purchase agreement before going ahead.  They can also arrange Power of Attorney which may save you money going back and forth.

I think if you have bought in Spain before you could be more confident. Obviously its each to their own but we are cautious and if I remember rightly their fees are hundreds rather than thousands.

Regarding NIE numbers, if you apply for it in person at a Spanish Consulate it's free. We got ours through the post today from the Spanish Consulate in Brussels only 9 days after we applied for them.

Our Spanish solicitor was going to charge us €150 for getting them on our behalf, and even though Polaris World can arrange them for you for a smaller fee you still have to go into Murcia in person to collect them.

Fortunately for us we live close to Brussels so the Consulate was close by, and it only took 5 minutes to complete the application (take your passports with you to verify you're who you say you are). I think it's also possible to do it by post if you send a legally authenticated copy of your passport, but I'm not 100% sure.

Anyway, it's something to bear in mind if you live or work near a Spanish Consulate.

I can highly recommend a company in La Zenia who have assisted numerous clients with signings on Polaris Resorts. Their charges are sometimes up to half of what other solicitors are charging.  The company is called Spanish Solutions, not sure of their address but their e-mail is info@spanishsolutions.com and their telephone number is 0034 966761741.
