Not bought an apartment but liked the look of the resort plan and the location - on the shores of the Mar Menor. Seen a sign for the resort last year on the road to La Manga but could not see any building work. Maybe you are right - and this resort as been cancelled or postponed until after the credit crunch/recession.

Firstly, you have very little (if any) chance of a refund if you do not have the 'Termination Agreement' from Polaris World. To get this 'Termination Agreement'  you need to be in possession of the bank guarantee for all the money you are attempting to recover.

Secondly, Polaris World will fob you off, and continue to fob you off, unless you instruct a solicitor to handle your case - even then it can take several months to get a resolution. Spanish solicitor's fees vary but you will be looking at around 5% of the total amount you wish to recover plus VAT. However, you could still receive more than you originally paid out as the value of the pound is now much weaker against the euro.

I received ONE bank guarantee which covered the full amount paid to Polaris World (deposit plus both stage payments).

Would you buy a property in the UK without a solicitor ??

Not using a solicitor is a risk - if everything goes according to plan then you may save yourself abit of money but if things don't then who knows what could happen - and what it could cost you. Are you prepared to take this risk ? 

Personally, I think the best time to appoint a solicitor is before any money is handed over (the same as in the UK).
