hi

 

anyone done a will for spain

as their interpertation is different from here to spain

 

if you have done did you use a english one with spanish law here in the u.k

We haven't done our Spanish will yet & when we do it will be done in Spain.

See the post below from the main EOS forum:

If it is not notarized in spain and therefore not in the wills registry then it wont be recognized in Spain and will have to be translated (unless already in Spanish) apostilled and then shown to the courts on death.

A Spanish will should cost approximately €175 per person, this includes the Notary cost, legal fee and Madrid Registry Wills.

That quote is outrageous .. unless of course your joint estate is very complicated and subject to IHT/CGT or other tax implications.

Our Spanish solicitor quote 150 euros each to prepare straightforward wills and I would expect an English translation to be included in that price too.

We did our wills over in Spain as we were told the Spanish would not recognise anything in an  English Will concerning a Spanish property.

The price was round about the 175 euro mark for each of us. We had to do a Will each as we are not married and had to name the three children we have between us from previous marriages.

Hope some of that made sense

Hi

It is correct that you do need a spanish will for spanish property owners.   Ours cost 120 Euro's each plus the VAT through our spanish solicitor in Vera.

I can only echo what Suzi has said.

The general consensus seems to be that the Spanish wills will cost €150 - €175 each which is around the £110 - £130 mark.

About 6 years ago we had our UK wills drawn up by a solicitor & that cost us approx £80 each. Therefore, I would have thought £300 - £400 for non complex wills to be drawn up in the UK & Spain would be a more realistic cost.

I think given your quote for £1000, I would certainly shop around.

Appantly you can get a WILL FORM from the notarys office in vera and do your own, theres no need to go to a solicitor to do it , i'm led to believe it only costs a few euros to register the will.

Hi all,

I checked with my solicitor today and they charged me 140 Euros for my will. This has to be signed at the notaria so normal practice is to do it at the same time as completion.

She's emailed me the form to complete so if anyone wants a copy, send me a PM.
