I'm meant to be completing on a phase 3 apartment next week (hoorah!) but have just been informed by my lawyer that "Roda Golf & Beach Resort has not got Habitation Licence for you property". 

Has anybody else come across the same issue and if so any guidance would be gratefully recieved.

We completed on Phase 2 in July and was told Habitation Certificate was issued though I have not actually seen it.

I do know that you are not obliged to complete if not issued and it may just be a hold up from local authority but you solicitor is best to advise you.

Hi, I think it's unwise to sign without receiving all required licenses. The Habitation I believe is required to supply services to the property.

I did a google search and there is a link to eyeon spain which confirms this which states " legally required before services Water & Electricity can be connected "

I would recommend you take a look at "http://www.eyeonspain.com/spain-magazine/snagging-survey.aspx" and not to sign anything without ALL licenses in place, your solicitor should know this !

In all the time that we have checked properties in this site we have never had any issues with the connection of utility connections

In the past RODA have delayed the completions when the Certficate has not been available and I would be very surprised if it had not been issued on Phase 1 & 2 as all utility connections are permanent from the suppliers

I would always advise not to complete without the Certficate because it is not possible to get utility connections and what RODA did, because they could not get gas initally on phase 2 was install temporary electric water heaters but it would mean that you have no central heating.

Legally you are not required to complete in the Certifcate of Habitation is available

Thanks for all of the advice everybody.   I have decided with your advice and the advice of my lawyer that I won't complete without it.

Having spoken to Roda this afternoon, apparently there is a delay in getting the licences for Phase 3 because of the latest council changes at the town hall.  They say the licences could be through in the next few days but they can't guarantee it.

This is probably something that other prospective owners on phase 3 want to watch out for before they plan completion schedules.

I have now had confirmed that the Habitation Certifcate has not yet been issued yet however RODA claim that it will be available within a few days

They have howevever asured me that all utilitues are aleady connected including gas, water and electricity so the license will have no effect of the immediate use of the properties

I will be checking this early next week when I am onsite
