Hi,

We just received a fax from our solicitor stating that block 17 has received the habitation licence and that completion could be before end November.  We must rush now and get NIE numbers etc.  These may take 3 months to get if organised from home.  Should have organised this earlier!

Is there anyone else out there who are in block 17 also.  Is it habitable, as is worth furnishing etc? at the moment?

Would you recommend being there to complete or give power of attorney to solicitor?

Fionnuala, don't panic!! 

Firstly, take your lawyers advice!  You are, I would venture to suggest, better to complete in January (if it suits you) to avoid any wealth tax this year.  When the habitation licence was granted for our block in phase 2 (it was September or October 2006., if I recall correctly), we delayed, on our lawyers advice, until the new year and eventually completed in February this year.  I don't know what the completion date is on your contract from the developer, but would anticipate that they are well overdue in handing over the property (we were meant to complete in March 2006).   So, sit back and listen to your (hopefully) competent lawyer.

Don't worry about furnishing it either, unless you want to use it immediately!  Think about that after you know when you are going to complete.

We, personally, used power of attorney to complete, given to our lawyers, as we are here in Dubai and it wasn't practical to do it any other way, but this is a decision you should make yourselves.  Get your lawyers/yourselves started on your NIE (we organised for our lawyers to do this the summer before we completed, but I believe the law may have changed regarding getting your NIE numbers).

When we were there in August, block 17 was coming along nicely, as was block 15, but, again, listen to what your lawyers tell you and don't rush to complete!   Wait until the new year, at least.

Agree with Pitby's comments, wew were thinking of trying to delay till New Yr anyway, but Tax position (which I had not considered) makes that even more attractive.

We gave our Solicitor Power of Attorney when we visited Spain in July. That specifically included an authority for him to apply for NIE numbers on our behalf. We thought this best for us as we are restricted on when  we can both get out to Spain, although if possible I would still like to try & get out for the completion meeting, although possibly on my own hence Power of Attorney.

Fionnuala..I have just posted , yesterday, some photos which show the state of block 17. It does look almost complete now so taking everybody's advice I would say january would be ideal to complete and then furnish. Good luck.

Thanks, we saw the photos and can't believe the progress since July.  It looks great.  Appreciate all the advice and looking forward to getting over to complete in the new year.

We went out in July/August and Block 17 was completed then, our apartment was being cleaned the day we went, and they were starting on the gardens.  We are going out there at the end of the month to sort out a few other bits and pieces and are due to complete almost immediately.  We have been told that completion must be before end of November and once we have had our second viewing the clock starts ticking for completion.  You do need to get your NIE numbers sorted out.
