Money Returned!

Hi all

At long last after 11 long years, we have had our money finally returned and payed back into our account, although the interest is still pending as Bank appealed against that.

I would like to thank Keith and Maria and all her team at CostaLuz for all their hard work achieving this for us, they are the fourth solicitors we have used!

And me to - my money came in this morning!   We must have been on the same law suit as you as 4he bank appealed against our interest.  At the moment I have received back in sterling more than I paid out but not quite enough to cover my legal fees. It took us 8 to 9 months to get our money back after winning the case. 

We would also like to thank Maria and Keith for all their efforts.  

My advice to everyone else is keep going - it may take a while but you should eventually get your money back.

Try to keep us informed of the interest payment please, my case is heard in February (Maria/Costaluz is also our chosen case lawyer). 

How long was there between the trial and decision and payment in your case?

May I ask did you have to use an enforcement to get the Bank to deposit monies into the court prior to you regaining your monies?

Case was won at end of feb 2016,I can't say either way if there was enforcement of money to be paid as not had futher communication as yet with CostaLuz regarding the issue of payment.

I will however, get all facts etc and let you all know once I have it. Weird thing is we both thought we would be jumping through hoops after this and mega euphoric news, but just feel very numb!

We have all lost a decade of our lives of this, and I'm sick to death of this euro nonsense...one rule for one judicial system and one for another???

Yes we have our capital invested back, fantastic, but should this whole process have happened in the first place? We can''t claim back the years lost due to this worry, what about the OAPS who hoped to have a nice life in sun enjoying their retirement?

What about people who were looking to retire there in the future?, Everyone assoiciated with Huma should be hunted down like Nazis after the 2nd world war! I know you can't compare the two in reality but I am sure you understand what i mean...Huma's directors are no doubt very rich leaving hundreds of working class people severely out of pocket with a massive impact on their lives and sadly on many people's health, with the weight of the worry....I wish they could be held to account for their criminal actions.

I so relate to your frustrations vcolvill.

I wish you and Costaluz all the best with any outstanding claim, but thanks obviously go to Costaluz for their resilience in what has been ( and still is) questionable and inconsistent  timeframes (some regions massively under resourced to cope with the volume of litigation) re court administration and judicial ruling delays etc that in all honesty are compromising the rule of law ( insufficient resources to ensure timely justice). But the EU do nothing to resolve this. 

My reason re the enforcement query is I'm trying to see if this is becoming another Banking abuse not to return monies to the courts within the 20 day timeframe following successful rulings, which then requires an enforcement procedure.

As for Banks seeking continual clarification of this law, given SC rulings have demonstrated to date in favour of innocent claimants, IMHO they were just playing the system of delays in order to be obstructive in the hope that claimants would run out of money to fight their corners in the abusively lengthy interim periods whilst appeal after appeal was presented.

It's become a David and Goliath battle. Stay strong everyone!

just checking as I am having problems with sending reply

I had e mail off Maria to say  even though we won the case in February our interest as now been revised.

We can now only claim from when our Lawsuit was filed December 2014 and not from when we paid the Developers in 2005.

How can we win the case  .flus interest and then the interest can be revised.Almanzora people are still being taken for mugs. Seems lik the Law is always on the Banks side and never ours.

Maria said we can file an Cassanation appeal at the Sureme Court would probably take 12/18 months and then not knowing if we will win or lose. So it is pay out once again.

So it goes on and on,once again the Villians always win and the law always seems to be on their side.

Well we will appeal why should they get away with it my Husband says no we have paid enough out but with the help of Maria we will will fight them tooth and nail.

Can you please clarify was this a Bank appeal against interest awarded, and where in Spain was this judicial ruling? On what legal grounds did they appeal? 

It has been said here many times Legal Interest is calculated from the date deposits were paid i.e. 2005/06 until all deposit is paid back i.e. 2015/16

I'm not aware this has changed anywhere maybe Maria can clarify this?

when you said you won you're case and were awarded deposit plus legal interest, was this in the First Intance Court? You say Maria said to take it to Supreme Court, but there is a stage in between at the Appeal Court. Have you been through this?

Have you appealed against the provincial court's revised interest ruling to the Supreme Court or have you accepted the lower interest amount?

were you awarded the costs in your case?  

The only reason I ask is that the banks will appeal for any old reason if they aren't being responsible for your costs, they have much greater funds than the individual, do you think?   

Had some good news today from our solicitor saying the judge has ruled in our favour with a full refund plus interest and legal fees ?I dont know where we go from here but keeping fingers crossed ?

Did you get your interest backdated to date of deposit or date of claim?

Sorry to be vague about all this ,but we only found out from our solicitor a couple of weeks ago that we had got a court hearing ,and then as I said we had an Email this morning informing us of the judges ruling ?he said the bank will probaby appeal but the way the court cases have been golng he seems quite positive .We are not counting our chickens and will post any news as soon as we get it  .PS not sure about the forum rules on nameing our solicitor?

No rules on that as far as I know.
